Hulse, Assistant Town Attorney DATE: -December 22, 2011 RE: Starcic wetlands permit#3926 During the public meeting in the above referenced matter, Trustee Ghosio requested authority from the applicant with respect to work being performed in the 16 foot right of way running through applicant's property, SCTM# 1000-70-06-09. Upon review of the deed,the applicant has the right to perform work within the easement. The only limitation is that the applicant cannot impede the right of ingress and egress of the adjoining property owners. Mr. Ghosio questioned whether the extension of water and electric through the 16-foot right of way was permissible and also requested that we provide an identification of trees to be planted. Attached herewith please find correspondence from Martin Fishman, dated December 8, 2011 to this office confirming that water and electric can be installed across the right of way. In addition, I enclose three copies of the survey which identifies the trees that Mr. and Mrs. Starcic propose to plant. I have also added a note indicating that the light to be installed at the dock would be dark skies compliant and would be controlled by timer. It is my understanding that Ms. Starcic has been requested to provide an explanation of the rights and obligations relating to a 16-foot right-of-way running fiom Oaklawn Avenue through Lots 7, 9, and 11 to the premises known as Lot 10. The easement is described in a Deed dated July 14, 1989, between Mary E. Hammesfahr and Renato Starcic. Said Deed transfers Lot 9 "to an easement sixteen feet in width running across the northerly part of said premises running westerly from other lands of the Grantee herein and other lands of the Grantor herein to Oaklawn Avenue. This is the easement that runs across the property presently owned by Carla Starcic. The easement set forth in the Deed thus allows "ingress" and "egress" by travel over the easement to adjoining property owners. Ms. Starcic is allowed ' to use .said property including the easement for any and all purposes which do not defeat the use-of the right-of-way as set forth above. Ms. Starcic seeks to install a water line and electric cable under the surface of the right-of--way to the dock of the back of her property. This use does not affect the right of ingress or egress by others. So long as Carla Starcic does not interfere with ingress or egress, she has the right to use the right-of-way in any fashion whatsoever. As the proposed installation of a water line and electric cable under the surface of the property to the dock does not affect the easement holders' right to use the right-of-way as set forth above, the existence of this easement does not,in any'way, limit Carla Statcie's right or ability to install the water line and electric cable as set forth above. The present and future owners of adjoining Lots 7, 10 and 11 will still be able to use the right-of-way for ingress and egress unimpeded.
