SOUTHOLD TOWN BOARD

WORK SESSION
Present: Supervisor Francis J. Murphy, Justice Raymond W.. Edwards (11:15 a.m.),
Councilman James A. Schondebare, Councilwoman Jean W. Cochran, Councilman George
L. Penny IV, Town Clerk 'Judith T. Terry,. (Absent: Councilman Paul .Stoutenburgh.)
EXECUTIVE SESSION
9:00 A.M. - The Board met first with Board of Appeals Chairman Gerard Goehrinc�er,
then with Planning. Board, Chairman Bennett. Orlowski and Planner Valerie Scopaz, to
discuss personnel.
10:10 A.M. - PTannirigBoard .Chairman Bennett Orlowski reviewed. with the Town Board
a recently compiled outline of Planning Board procedures with respect to the receipt
of new applications by that Department. There are close to 200 pending applications
before the Planning Board at the moment, -but this number should be reduced quite
rapidly 'due to a proposed reorganization of that department.
10:25 A.M. - Catherine Simicich, representing the Grape Growers Association, and
Larr Fuller-Perrine,, Research Support Specialist-Grapes, LIHRL/Cornell University,
met with the Board to review Mr. Fuller-Perrine's research report concerning "Bird
Damage and control in' Long Island Vineyards", a copy of which is on file in' the Town
Clerk's Office.
10:55 A.M. For Discussion Items: (1) Board determined that they do not wish to
increase for- 1988 any of the permit fees for beaches, shellfish, landfill, Scavenger
Waste Plant; Fishers Island Sewer District will be reviewed at Budget review time.
(2) Request .from Director of Senior Services Venetia 'McKeighan for the Board to
consider providing fringe benefits to independent contractor--fullrtime van driver
Webster McNeill'. At the Board's request Account John Cushman prepared an analysis
of such benefit costs which would amount to $6,'070 for such a full-time employee.
Presently:the sub-contractor is 'paid' through a Suffolk County Grant which does not
provide fringe-benefits. Board agreed the Town would be unable to provide these
benefits to the sub-contractors. - (3) Receipt of a proposal from IBM for a new
Model 50 copier machine for Town Hall. To be discussed further-at budget review
time. (4) Submission by Supervisor Murphy of the. Code of Ethics for the Town -
of Greenburgh. To be submitted to the Code Committee. . (5) Receipt of a Civil
Service List. for the position of Ordinance Inspector with only one name on .the list.
Board to review other civil service positions which would cover the same field. (6)
Letter from Szepatowski Associates, Inc. concerning .the Local Waterfront Revitalization
Program which is being coordinated by Planner ValerieScopaz.
11 :30 A.M. - Board. reviewed proposed regular meeting resolutions.
11 :50 A.M. - Valerie'Cardona. met with the Board to register her objection to the
word "charity" with respect to the 9/18/87 "Southold Town Charity Cruise" to
benefitCAST; Recreation Program for Handicapped Children and Young. Adults,
Southold Hospice in' Progress, Greenport Single Parent Residence, and HUGS '(Human
Understand and Growth Seminar, Inc.) . Mrs. Cardona specifically objected to the
term "charity" iri' regard to the handicapped children and young adults program, which
singles them out into a separate class, which they have worked to avoid: The .parents
and concerned individuals are very upset over this.' Mrs. Cardona was advised that
this is not a Town of Southold sponsored event, and suggested she contact one of those-
individuals involved in'organizating the fund raiser.
11 :55 A.M. - Board audited outstanding vouchers.

REGULAR MEETING
1:30 P.M.
A Regular Meeting of the Southold Town Board was held on Tuesday, September
8, 1987, at the Southold Town Hall, Main Road, Southold, New York. Supervisor
Murphy opened the meeting at 7:30 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR MURPHY: I'd like to welcome everyone .here tonight. The first
order,of business is the approval of the audit of the bills of September 8th, 1987,
I offer that resolution.
Moved by Supervisor Murphy, seconded by Councilwoman Cochran, it was
RESOLVED that..the following audited bills be and hereby are approved for payment:
General Fund Whole Town bills in the amount of $34,030.28; General Fund Part Town
.bills int he amount of $41,454.70; Highway Department. bills in..the amount .of $6,373. 88;
Fishers Island Ferry District bills in' the amount of $11,410.66; Brief Respite Program

25th, 1987 Town Board meeting. I offer that resolution.

RESOLVED that the next Regular Meeting of the Southold Town Board will be held

COUNCILWOMAN COCHRAN: Yes, I would just like to say that our Designated
Driver Program kick-off was most successful. I'd like to publicly thank Michael
LoGrande, County Executive, for joining us on that day. He add, certainly, to
the festivities. We did' have a meeting of the Dog Pound, of which, unfortunately,
was twenty minutes late so when Frank and I have time to sit down, then I can
find out what I missed the first twenty minutes. I think things did'work out though
with Garrett Strang.
SUPERVISOR MURPHY: I think so. There's a letter that has just come in. I
didn't even read .it yet.
COUNCILWOMAN COCHRAN: . Okay, good. That's it:
SUPERVISOR MURPHY: Thanks, Jean. Ray?
JUSTICE EDWARDS : Only the ferrys were running overtime yesterday and today
to get people off the Island and we're going to have our Island back to ourselves
shortly. And we have a resolution on this evening to'extend our Mosquito Program
over there---the BTI Program which I'd like to add is very, very--has been very
successful this summer. That's it.' Thank you, Frank.
SUPERVISOR MURPHY: Thank you, Ray. Okay, the only thing I would like to
add also is 'we had a. very safe weekend out here, thank heavens. And also this
Saturday is the Bicentennial Parade and would ask everybody to attend.. Ask the
:papers to write'—it 'up and get a little. publicity for it.

SUPERVISOR MURPHY : Under Communications, there are six of them.
1. From Mary A. Fallon, Deputy Commissioner of Consumer Affairs, County
of Suffolk thanking the Town Board for inviting her on the annual trip to Fishers
Island.
2. Letter from Michael P. Flynn thanking the Town for the improvements
made to Kenney's Beach. And it certainly is an improvement this year.
3. Letter from Bernice Mack, Director of the Riverhead/Southampton Community
Center, thanking the Town for their participation in the housing forum on July
23, 1987. This happened to be excellent.
4. Letter from Bruce G. Blower, Director of the Suffolk County Office of
Handicapped Services, thanking the Town for inviting him on the annual. trip to
Fishers Island. The reason we put this on is to get a little publicity for the reasons
of the trip'. Bruce Blower, in' particular, is 'head of Handicapped Services in Suffolk
County and a very fine man, but he's also head of the Emergency Medical .Technician
Task Force, and EMT training program for the County. He had a very informative
and a very good meeting on Fishers Island and we're very anxious for.him. to be
there and I guess Tom Dougherty and Catherine Jenssen had a very good meeting
with him'. Again' this is one of the reasons for bringing officials over to Fishers
Island. This" is 'what we were trying to point out.
5. Memorandum from Executive Administrator Victor G. Lessard relative to
a.potential' Community Residence site at 700 Skunk Lane, Cutchogue.

6. Letter from John Charuk, Deputy Clerk of the Suffolk County. Legislature,
transmitting a certified copy of Resolution No. 855 of 1987, adopted at the August
11, 1987 meeting of the Suffolk County Legislature, entitled "Amending the 1988
Capital Program';'to Provide the County Share for a Study of Erosion Control in the
Vicinity of Goldsmith Inlet Park, Kenney's Beach and Horton Beach, Town of Southold. "
Provides $10,500 'for Planning, Design E Supervision. f

SUPERVISOR MURPHY: We'll move on to Resolutions, Item V on our Agenda.
know everybody here knows the policy, but if 'anyone would .like to speak on any
of the proposed resolutions at this time you may. Anyone in the audience? (No
response.) The first one is 'to grant permission.
I.-Moved by Justice Edwards, seconded by Councilwoman Cochran, it was
RESOLVED that the Town Board of the Town.of Southold hereby grants permission
to the southold P.T.A. to use Oaklawn Avenue as part of thei r'parade route for
their annual Halloween Parade to be held at 3:30 P.M., Saturday, October 31, '1987,
provided they secure and file with the Town Clerk a Certificate of Insurance naming
the Town of Southold as an additional insured.

SUPERVISOR MURPHY: Just reminds us that the summer season is over and Halloween
is 'coming.
COUNCILMAN SCHONDEBARE: I've 'got a pumpkin in the house already.
COUNCILWOMAN COCHRAN: I've had one for years. Pep. He's a little pumpkin!
He is.
JUSTICE EDWARDS : I just got a commitment from Eddie Latham for pumpkins for
the kids on Fishers Island. He told me to come down the patch and help myself.
SUPERVISOR MURPHY: Number 2 is 'a trailer permit renewal for. six months for
Walter and Frank Sawicki on the Old North Road, Southold. It expires on Septembe
23rd, 1987. 1 offer that resolution.
2.-Moved by Supervisor Murphy, seconded by Justice Edwards, it was
RESOLVED that the application of Walter and Frank Sawicki for renewal of their single
family house trailer permit.' for trailer located on the north side of Old North Road,
Southold;. New York, which permit 'expires on September 23, 1987, be and hereby
is rag nted; for a six (6) month period.

SUPERVISOR MURPHY: . Number 3 is 'to authorize an ad for the publicity for the .
recently enacted Alarm System Local Law. I offer that resolution.
3.-Moved by Supervisor Murphy, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes. the
Town Clerk, and Chief of Police to place a display ad in' The Suffolk Times and The
Long Island Traveler-Watchman informing the public of the recently enacted Alarm
Systems local law.

This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: And. Number 4 is an environmental assessment on our on-
going STOP Program.
4.-Moved by Councilman Schondebare, seconded by Councilwoman Cochran, it was
RESOLVED that pursuant to Article 8 of the Environmental Conservation Law, State
Environmental Quality Review, and 6NYCRR Part 617, Section 617. 10, and Chapter
44 of the Code of the Town of Southold, notice is hereby given that the Southold
Town Boad, as lead agency for the action described below, has-determined that
the project, which is unlisted, will not have a significant effect on the environment.
Description of Action: Proposed construction and operation of a Solid Waste Manage-
ment Facility for the storage and gransfer of household toxic wastes at the Southold-.
Landfill, Cutchogue.
The project has been determined not to have a significant effect on the environ-
ment because:

1. Only unwanted or out-dated'hazardous`."'toxic house and garden chemicals
will be accepted.
2. The safety storage containers are designed to comply with regulatory
standards for storing hazardous materials. - -
3. Two or more Southold Landfill employees will be trained and licensed to
handle, package and store the hazardous household waste in accordance with"any
and all laws.
4. The project will have a potential large beneficial impact. Those wastes
collected at the site will not enter the groundwater reducing the risk of aquifer
pollution.

SUPERVISOR MURPHY: . And Number 5 is to declare lead agency on. a change.of
zone petition for James Gray, from "A" Residential to "C" Light Industrial, on property
located onAhe north side of Route 48,' west of Cox's-Lane. in* Cutchogue, next to
our Landfill. I 'offer.that.
. -.COUNCILMAN (PENNY: . 110 ;like .to make a disclosure at this time. I do business
with James L. Gray and also with Gray Electric: I'm supplying some materials to
the shopping center that they're.doing next to...the Chinese restaurant. There are
no arrangements, agreements or other--anything going on between .us .on this particular
parcel of property, so that I feel that it's-safe for me to. vote on it; because I have
no idea what he wants--1 don't even know what he wants to, make the zone change
for. I just want to say at this time that there's nothing contingent upon my decision.

SUPERVISOR MURPHY: And Number 6 is 'a resolution to engage Dave Emilita, at
a cost not to' exceed $180. 00 to review the Long Environmental Assessment Form
on this 'petition. I offer that resolution.
6.-Moved .by Supervisor Murphy, seconded by Councilwoman Cochran, it was
RESOLVED that the Town Board of the Town of Southold hereby engages the services
of Planner David Emilita, at a cost not to exceed $180. 00, to review the Long Environ-
mental Assessment Form with respect to the petition of James L. Gray Sr. for a
change of zone; said review to include applicant's Part I , prepare a Part II and
lil , draft a proposed declaration, including a field inspection; the cost of said review
to be paid by James L. Gray Sr. prior to the commencement of the review.

Council-man Schondebare, Justice Edwards, Supervisor Murphy.

SUPERVISOR MURPHY: . Number 7 is to transmit 'this petition to the Southold Town
Planning 'Board-and the Suffolk County Department of Planning. .I offer that resolution.
7.-Moved by Supervisor Murphy, seconded by Justice Edwards,
WHEREAS, a petition has been received. from James L. Gray Sr. for a Change of
Zone on certain property located on the northerly side of County Route 48, west
of Cox Lane, Cutchogue, New York, from "A" Residential and Agricultural District
to "C" Light Industrial. District, now, therefore, be it
RESOLVED that the Town Clerk of the Town of Southold be and she .hereby is directed
to transmit this petition to the Southold Town Planning Board and the Suffolk County
Department of Planning, all in accordance with the Southold Town Code and the
Suffolk County Charter.

SUPERVISOR MURPHY: And next is Number 8, to declare the weeks of September
19th through October 12th as CoastWeek in the Town of Southold. I offer that resolution.

8.-Moved by Supervisor Murphy, seconded by Councilwoman Cochran,
WHEREAS, the Town of Southold has varied coastlines of rocky shores, sandy beaches,
productive estuaries and salt marshes, urban ports and small harbors, tidal flats
and dozens of islands; and
WHEREAS, the coast has provided us with a rich scenic; cultural and historic.
heritage; and
WHEREAS, the natural resources of the coastal zone are among our most important
economic. resources; and
WHEREAS, the marine environment is one of the most valuable resources supporting
an active fishing industry; and
WHEREAS, coastal landforms, especially barrier beaches, provide significant protection
from coastal storms, flooding and erosion;and
WHEREAS, we are strongly committed to the wise management of the coastline to
ensure for all the residents that the environmental and economic value of the coastal
zone will be sustained; and
WHEREAS, the coastline is also receiving nation-wide recognition during the weeks
of September 19 to October 12, 1987.. as a valuable but threatened resource, now,
therefore, i.t is 'hereby
PROCLAIMED by the Town Board of the Town of Southold that the weeks of SEPT-
EMBER 19 to OCTOBER 12, 1987 shall be COAST WEEK in the Town of Southold,...
and urge all citizens to take cognizance of this event and to participate fittingly,
in its observance._

SUPERVISOR MURPHY: And. Number 9 is 'to submit an application to HUD.
9.-M.oved by Justice Edwards, seconded by Councilwoman Cochran, it was
RESOLVED that the. Town Board of the Town of Southold hereby authorizes .and
directs Supervisor Francis J. Murphy to execute and submit a project description
application to HUD for the purchase of the quarry truck for the Landfill site from
Community Development Year 12 funds.

SUPERVISOR MURPHY: Number 10 is to authorize amendments to Community Develop
ment Year 12 Program.
10.-Moved by Councilman Schondebare, seconded by Councilman Penny, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs the Town Clerk to give public notice that the Town Board will be consider-
ing the following proposed amendments to the Community Development Year 12 Program
Budget at their-Regular Meeting to begin at 7: 30 P.M., September 22, 1987, at the
Southold Town Hall, Main Road, Southold, New York, at which time interested citizens
will be given. an opportunity to comment on the proposed changes:

SUPERVISOR MURPHY: This reflects the income--it had to go back to HUD--but
from the sale of a chipping machine that. we had sold last year, and now we have
authorization to buy a quarry truck, rather than use the Highway trucks to bring
the sand up for the Landfill cover.

SUPERVISOR MURPHY: Number 11 is to accept, with regret, the resignation of
Deirdre Fogarty as a part-time Clerk Typist for the Board of Trustees, effective
September 11th. I offer that.

RESOLVED that the Town Board of the Town of Southold hereby accepts, with regret,
the resignation of Deirdre M. Fogarty, part-time Clerk Typist for the Board of Town
Trustees, effective September 11, 1987.

SUPERVISOR MURPHY: Number 12 is to authorize Executive Administrator Victor
Lessard to attend a Building Officials Conference from October 7th to the 9th at the
Fallsview Hotel in Ellenville. I offer that resolution.

RESOLVED that the Town Board of the Town of Southold hereby authorizes Executive
Administrator Victor G. Lessard to attend the New York State Building .Officials
Conference, Inc. , to be held October 7th through October 9th, 1987, at the Fallsview
Hotel, Ellenville,. New' York, and the actual costs for registration, meals, lodging
and travel shall be a legal charge against the Building Department's 1987 Budget.

SUPERVISOR MURPHY: Number 13 is 'to authorize the Town Clerk to advertise
for bids."
13.-Moved by Councilwoman Cochran, seconded by Councilman Penny, it 'was

materials safety storage buildinq for the Southold Town Landfill site, Cutchogue.
