and buttons to be printed and she requested an allocation of $60G-from Community
Development funds (see resolution no. 29) . (7) Copy of a resolution by. the Smithto vi..
Town .Board-urging legislation to amend the Environmental Conservation Law with
respect to the: extractive mining industry.--No action by the. Board the State Legis=
lature will' be adjourning within the week. (8) Memorandum from Accountant: John
Cushman relative to overpayment of Architect Garrett A. Strang with respect'to the
Dog Pound kennel.:building construction. A letter received from Mr. Strang _this-
date documents his 'fee of eight percent based on prevailing market rates as determined
by. McGraw-Hill' Construction Analysts.
2:00 P.M. - Board reviewed proposed resolutions for the regular meeting.
2: 30 P.M. - Board met'with Special Attorney Frank Yakaboski and the following items
were discussed Proposed building by Suffolk Hostels, Inc. on Horton Lane, Southold;
Daniel Ross letter relative to Magill property in Mattituck; Garrett Strang purported ,
overpayment relative to kennel building; proposed local law for architectural and design
review.

7:30 P.M.
A Regular Meeting of the Southold Town Board was held on,Tuesday, June 30,'
1987, at the Southold Town Hall, Main' Road, Southold,. New York. Deputy. Super-
visor Kujawski opened the meeting at 7:30 'P.M. with the Pledge of Allegiance to the
Flag.

DEPUTY SUPERVISOR KUJAWSKI : ' 'I'd like to call the meeting to-order. I'm Deputy
Supervisor Frank Kujawski. ' Mr. Murphy is 'up in' Albany doing a-little lobbying.
I'll speak-about that under the, Supervisor's Report, and Jay Schondebare is 'not
here .because of a death in the family. Otherwise I think we're all here. The first,
order is 'the approval of the audit of the bills of June 30th.
Moved by Councilwoman Cochran, seconded by Councilman Penny, it was
RESOLVED that the following audited bills be and hereby are ordered paid: General
Fund Whole Town bills in'the amount of $21,435.79; General Fund Part _Town bills
in'the amount of $4,841.80; Highway Department. bills in' the amount of $8,592.28;
Fishers Island Ferry District bills in'the. amount of $6,188.36; Southold Scavenger
Waste Treatment Plant bills in'the amount of $13,579. 83; Truck Scale and Scale House
Capital Account bills in' the amount of.$100,.350.:40; Agricultural Lands Development
Rights Capital Account bills in' the amount of $1,200. 00.

DEPUTY SUPERVISOR KUJAWSKI : The next would be the approval of the minutes

RESOLVED that the minutes of the June 1'6, 1987 Southold Town Board meeting be
and hereby are approved.

COUNCILWOMAN 'COCHRAN: Yes, on Wednesday, June 17th I attended at meeting.
As you know, there is a committee between the Town Board and the Peconic Land
Trust in relation to the lovely, lovely piece of.property down here on Youngs Avenue.
shad hopes that by this 4th of July weekend that we would ,be able to announce
that between pledges and donations we had reached the $50,000 mark. Well, we
just had another meeting and I'm -very' pleased to announce that between pledges
and donations our grand total to date is ' $521-822; so it looks like things are moving
as. far as our Town Green is 'concerned and very shortly I'm sure you'll see some
activity down there because they're going to begin to construct the gazebo. Also
on the 17th I attended a Beach Committee meeting for Lifeguards and Beach Attend-
ants, of which Councilman Stoutenburgh is chairman and he'll be reporting on that.
On the 1.9th the members of the Town Board did meet with Paul Roth of the DEC,
and H2M in relation to our Landfill, and it 'was decided that we would begin to gook
for RFQ's. I love government. Everything goes with initials, and up to this 'point
we used to say RFP';s, which is requests for proposal. Now we have RFQ's,w.hich
is requests for qualifications. So we're beginning to go in' this 'direction as far as
looking to see what technology is 'out there and available for composting of solid''
municipal waste. Also I've had two, three meetings over the last two weeks with
the Buildings. and Grounds Committee. . We're trying to solve the problem of the
shortage of office space within the Town Hall here. Town government is growing
so quickly-as the community is 'growing that we find that we're very limited in
space and we have people tucked away in one little cubbyhole after another.�.• So
the. B�Ui.lding and Grounds Committee is 'working on putting a small modular addition
to the back of the building here because we're just desperate as far as help and
space is concerned. I met on Thursday the 25th .with Jim McMahon who is 'our
Community Development person -and MaryAnn Fleishmann who works with. Community
Services, and the three of us sat down and developed a program, ca Publi.c'Awareness
Program for the Town of Southold in' relation ,to designated driver. We feel we have
active in'the. community the Substance Abuse Committee which works with CAST,
and they have done some things over the past year and again they're planning quite
an extensive week in' relation to Drug Abuse Week, and other.-ongoing things for
public'awareness as far as substance abuse. It *was my feeling that the Town govern-
ment, or--any government, does. have a certain' responsibility when it's a societal
problem- 'such -as .drug abuse. So as a beginning we have established, or developed
a Designated Driver Program of which you'll be seeing this many places. There
will-be bumper stickers, there will be buttons, and how we're getting community
involvement, these wily be distributed to--many of the businesses throughout the
community as far as your restaurants, some of your stores, 7-11, and so. forth.
We're going to distribute these throughout the entire community and hope that
people will'.use both the -buttons and. the bumper stickers as a way of educating
people. .` Also, we find that not only people of my age and below and- above, and
our youth--I .don't like to just single out our youth, because it's a universal problem,
it spans all ages. We find that many people do not realize the penalties involved
for alcohol, drug related driving offenses, so another piece has been developed,
and this 'is 'being-distributed through our Juvenile Aide Bureau, and will' also be
distributed through this 'program, telling the public 'of the penalties that are involved
in'drinking while, driving, and they're quite impressive in' themselves, because it
is not an easy situation when you are placed in' this kind of situation. So with that,
thank you; Frank. It's been a busy two weeks.
DEPUTY SUPERVISOR KUJAWSKI : Thank you, Jean. Paul?
COUNCILMAN STOUTENBURGH: As Jean has said, we have a meeting of our Town
Green Committee and probably you've seen the Green vacant with one building. We
finally got rid of the old garage that was on it 'and so' we're ready to go now. We-
should be starting to break ground there, almost any day now. As a matter of fact .
there was a meeting just tonight and we couldn't be there. As--a matter of fact
they're still' meeting I believe in the back room. . We had a Beach and Parks meet-
and all our beaches have opened 'and were all geared for summer. --We had only
one little mishap .and that was only a minor. thing. Somebody- didn't get their cash
box or .something, but we.took care of that. We did find" out that we're a little
weak ,on our beach at Southold, that's Town Beach. We. only had one person there
during the week and two people on weekends. We're now beefing that up a little
bit so that we'll have three people on the weekend and two during the week. So
we should have our beaches well covered and should you people in the audience see
something wrong with our beaches that you .don't like, that you feel that is 'wrong
and can be corrected, give Jean or myself or Paul or Jay Schondebar.e--w.e make
up this 'committee--and we'll be more then happy to look into it 'for you. I think

DEPUTY SUPERVISOR KUJAWSKI :' Thank you, Paul. George?

COUNCILMAN PENNY: Yes, on-the 17th we' 'maid a meeting of the Commerce and
Inudstry Committee and we discussed several items--parking problems that are aris=
ing Southold Village; size of the parking sighs; Greenport's never ending dog problem
which we're check into; the Laurel Booth--we have a parking problem down there
due to the road construction and the lack of signs in' that area; better ways of
notificatiic6 .to tourists that there is 'a bus to the Orient ferry on weekends and where
they can pick up these buses and we're going to look into 'that a little more; gutters
and shutters on the Laurel Booth; and the proposed Architectural Review Law. On
the 18th, as a follow-up to that..meeting, I met with Ray Jacobs and Peter Kren; .
President of the Mattituck Chamber, down at the Laurel Booth and we're making a
provision for temporary parking there, because with the construction that'sgoing
on there people don't know where to park and they're constantly being asked to
move -because of all the heavy equipment in' that area. • And that's it.', Thank-.you.
DEPUTY SUPERVISOR KUJAWSKI : ' Thank you, George. Judge, did' you have some-
thing to add?
JUSTICE EDWARDS: _ Yes, something I forgot. The world has been going around
in circles here. At my last meeting I did' bring -up the fact that the Motor Vehicle
Department was allowing the Motor Vehicle picture camera to go to Fishers Island,
which I brought over two weeks ago on Wednesday, and last weekend I took 33 Motor
Vehicle license pictures on Fishers Island. It's the first time ever that the camera
has been out of the clutches of the .Motor Vehicle Department. I took 33 pictures
and brought the camera -back a week ago on a Tuesday. I couldn't make .it Monday :..
"because of the fog, and they're going to expand the program whereas they're going.
to allow me to bring it 'over there once every three months instead of once every .
six'.months because it 'looks -like the print-out that they sent me from Albany has
all the driver's licenses on Fishers Island and wheni.fhey come due, and I think
between now and next June it would be like 60 of them coming up. So rather than
do 60 'a time they're going to allow me to bring it over every three months: . And
it's a real help to the" people on the Island not to have to fly.over here or drive
down to White Plains to .get their pictures taken. So.now-we just have to wait 'and
see how good the photographer did:
DEPUTY SUPERVISOR KUJAWSKI : Thank you, Judge.. As I mentioned, Supervisor
Murphy is in Albany lobb in' , along with many others from the East End of the
Island for the--it's been called several different things--the Land-Transfer Tax,
the 2% Tax. As. Legislator Halpin' said' the other day, how about the Land" Bank and
not the word ''tax". This 'has been approved by the Senate and presently is 'in the
Ways and Means Committee, and the lobbying effort is 'to get that out of"Ways and _
Means before the weeks end and to be adopted by the Assembly_. This;_ of course,
would be .a tax on major real estate transactions that would be then banked by the,
Town and used to purchase valuable Wend such as wetland and other areas that are
endangered, without taxing--or an additional burden upon the taxpayers. I think
--that's all I really have to add. Anyone like to add any information on this? (ND
response.) _

the support of the Suffolk Recource Recovery Agency.
6. A petition from the Laurelwood Drive Property Owners Association regard

five public hearings scheduled, we will'move on to resolutions.

cultural land of James E. Cross. 8:02 P.M. - proposed "Local Law in relation to
License Fees for Peddling and Soliciting Licenses. " 8: 04 P.M. - proposed "Local
Law in relation to Parking Permits at Beaches. " 8:06 P.M. - proposed "Local Law
in relation to Taking of Shellfish. " 8:08 P.M. proposed "Local Law to establish
a Landmark Preservation Commission and to prescribe its duties. ")

V. RESOLUTIONS.
DEPUTY SUPERVISOR KUJAWSKI :: I would first like to read to you a resolution
adopted by the Town Board on June 3rd, 1986: "RESOLVED tht the Town Board
of the Town of Southold hereby establishes the policy that at scheduled Town Board.
Meetings the public attending shall be allowed five (5) minutes to address the Town .
Board in' relation to agenda resolutions prior to their enactment and the public will
also be given time, at the conclusion of the regularly scheduled business agenda,
to. address the Board on any given topic:" At this time then is there anyone in'
the audience that• would like to address the Town Board regarding the resolutions
that are on your agenda? Anyone on this 'side of the room? Middle? This '.side over
,.
here? (No response:) Okay, then I think we can start the resolutions. Number
1 is *to 'authorize the Town Clerk to place help-wanted. ads .for the position of Water
Safety Instructor.
1. Moved by Councilwoman Cochran, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of the Town of Southold 1hereby auth-
orizes and directs the Town Clerk 'to place a "Help Wanted" ad in The Suffolk Times
and The Long Island Traveler-Watchman on June 25th and July 2nd, 1987, requesting
applications for the position of Water Safety Instructor- to teach swimming lessons.

DEPUTY SUPERVISOR KUJAWSKI : , Number 2 is '.an agreement regarding the inventory
.....,of historic sites and landmarks.
2. Moved by Councilwoman Cochran, seconded by Councilman Penny, it was.
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Francis *J. Murphy to execute an agreement betweent he Society for the
Preservation of Long Island Antiquities and the Town of Southold, to render professional
services, at a sum not to exceed $14,000..'00, to inventory historic sites and landmarks
within the Greenport area, to be completed by December 30,' '1987, and submit 'an
Inventory and Analysis and Report with respect to sake, to be completed by June
'30, 1988.

DEPUTY SUPtRVISOR KUJAWSKI : . Number 3 is 'a resolution on accepting the bids
for furnishing and placing asphalt concrete.
3. Moved by Councilman Stoutenburgh, seconded by Councilman Penny, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts the following
bids for Annual Contracts for Funishind and Placing Asphalt Concrete within the
Town of Southold, as may be required, for a period of one (1) year, at the following
bid prices:
Paul Corazzini 9 Sons, Inc. - Item 1W: 0 - 350 tons - $41. 00
htbm 2W: 350 = 650 tons - $41. 00
John T. Montecalvo, • lnc. - L Item 3W: 650 1000 tons - $38. 70
Item 4W: Over 1000 tons - '$37.76. . . . .and be it further
RESOLVED that Supervisor Francis 'J. Murphy be and he hereby is authorized and
directed to .execute contracts between the Town of Southold and Paul Corazzini l
Sons, Inc. and John T. Montecalvo, Inc. for said Annual Contracts, all in accordance
with the. Bid Specifications.

DEPUTY SUPERVISOR KUJAWSKI..: ' . Number 4 is to amend Resolution 21 back on June
:1987 on the. Oregon Heights bond.
4. Moved by Councilman Penny, seconded by Councilman Stoutenburgh, it was
RESOLVED that the Town Board of the Town of Southold hereby amends thei r'Resolution
No. 21 , adopted June 2, 1987, determining the amount of '$13,750 00 to be deposited
with the Town in lieu of land for park and playground in the subdivision of "Oregon
Heights", to provide for the .sum of $80. 00, . being. the appraisal cost, to be deducted
and payable to, the General Fund and the balance deposited in a Park and Playground
Trust Account; and be it further
RESOLVED- that the Town Board of the Town of Southold hereby amends 'their"Resolution
No. 27, adopted June 2, 1987,' determining the amount of $10,750. 00 to be deposited
with the Town in lieu of land for park and playground in the subdivision "Papadopoulos
and Maragos", to provide for the sum of $80. 00, being the appraisal cost, to be deducted
and payable to the General Fund and the balance deposited in a'.-Park and Playground
Trust Account. .

_ RESOLVED that the Town Board of the.Towni)of Southold, in accordance with Chapter
27, Section 27. 1. (B) of the Code of the Town of Southold., hereby grants the Old
Town Arts and Crafts Guild, Inc. a Special Permit 'to hold their annual outdoor Guild
Artists Snow Fence Art Show on the Cutchogue Village Green property of the Cutchogue-
New Suffolk Historical Society, on July 4, '1987, from 9:00 A.M. to 5.00 P.M. , provided
they secure and file with the Town Clerk a Certificate of Insurance nami.ng: the Town
of Southold as an additional insured.
5.-Vote of the Town Board : Ayes : Councilman Penny, Councilwoman Cochran, Council
man Stoutenburgh, Justice Edwards.

MR. BARTH: Just a minute, you left out half'of Number 4, to amend Resolution
No. 27.
TOWN CLERK TERRY: We did Number 4, Mr. Barth.
MR. BARTH: Yeah, but you didn't do the other half of it.
TOWN CLERK TERRY: . By adopting Resolution No. 4, that was all included in' it.
COUNCILMAN:;STOUTENBURGH: It was all one thing.
MR. BARTH: You're amending Resolution No.. 21 for Oregon Heights, and Resolution
No. 27 for Papandopoulos and Maragos.
DEPUTY SUPERVISOR KUJAWSKI : The actual resolution that you're speaking of
is actually-even more lengthy then that, but it has been adopted in full.

RESOLVED that .the Town Board of the Town of Southold, in' accordance with,_Chapter

DEPUTY SUPERVISOR KUJAWSKI : Number 7 is 'to appoint Charles Knispel as a
provisional Scale Operator. _.
°7. Moved by. Councilman Stoutenburgh, seconded by Justice Edwards, it was
RESOLVED that. the Town Board of the-Town of Southold hereby appoints Charles
Knispel as a provisional Scale Operator, effective July 1, -1987, at a salary of
$18,948. 00 per annum.

8. Moved by .Justice Edwards, seconded by Councilman Penny, it 'was
RESOLVED that the Town Board of the Town of Southold hereby authorizes Super-
intendent of Highways Raymond L. Jacobs to purchase, from the County Contract
Letting No. 128-86. 5.29, the following items :
Item #25 - Hi-Way Mode 10' E-2020 Spreader - bid price $6,294. 00

JUSTIICE EDWARDS:' What tihisKV6:a i is; in' transporting perishables from New London
to Fishers Island it's at least an hour from the time it's unloaded on to a flat in' New
London, to the time it gets to Fishers Island. So they have an air'conditioned van.
that they put all the perishables in; the milk and produce and so forth, and this
way the van can keep it cool. Sometimes it's three hours before the ferry departs
from New. London. So that's the only way we can keep all of the perishables safe
on arrival at Fishers Island, and this van that they're getting, a 1984 van, is going
to be set up for that. The other one that they have is an old Ford van. It's probably
10 .15 years old, It only has 15,000 miles on it; but has completely rusted out.
So they're starting all over again'with a new one.

that you would reconsider•i this: Was there any consideration. given to that request
at all?

-had to be picked, I would feel: that there's no set rule that says it has to be five,

to do ..things and become community-minded and be interested in the civic things that's
going on, I think that if 'you get six' people that say1hey would like to'.volunteer
to be on a committee, -arid naturally I'm talking about if 'they qualify for it; my
suggestion would be that you ought to increase the committee and doh't leave anyone
out on it: I know I sat here several meetings and I see Mrs. Oliva .here all the time
taking a very good part in everything that goes on and representing the public very
good, and I think that she should continue to do so if it's possible.
COUNCILWOMAN COCHRAN: We finished our interviews today and it will be discussed
at the next Town Board meeting.

DANIEL ROSS: Is' this 'the time to present something under the matters for discussion? .
COUNCILWOMAN COCHRAN: Yes.
DEPUTY SUPERVISOR KUJAWSKI : ' Sure.
DANIEL ROSS: It's a matter on number 5. .. .
DEPUTY SUPERVISOR KUJAWSKI : Would you identify yoursef,- sir:
DANIEL ROSS: Daniel Ross of Wickham, Wickham and Bressler. Regarding the
property on Seventh Avenue off Bray Avenue. We represent the Finoras and the
Vdokakis with respect to their'p.roperty. They bought their present property in
1971. Their property is 'on the south side of Bray Avenue. The Finoras built a
house in' 1972. At the time they bui It' the house the property across the street .was
a sand pit 'which they were told, and they understood, could no longer be mined,
and would remain'a sand pit.' That was.. .their'understanding at the time. The property
is :*a fairly large piece. It's a sm°all area of the property just adjacent to the road
that hasn't .been mined which really is the piece of property that's at issue here.
During the. 70's .the Finoras..and the Vdokakis didn't see when they..were at their
property any machinery stored on the property--being the property on the north
side of Seventh Avenue. In' 1980 the property was conveyed to its present owner,
Richard Magi 11: ' Mr.• Magi IF.began operating a cesspool company from the property.
Mr. Finora approached the Town Building Department, and- requested that something
be done to prevent the use of the property for operating a cesspool company out
of it: I believe--I ,:understand from speaking with the Building Department it's my
understanding that.' thei r�position is there was a.pre-existing use------
COUNCILMAN PENNY: Excuse me, Mr. Ross, if I could comment. We passed this
letter 'which you had sent us--because this is 'really not a Town Board. matter--and
we understand that there has been a difference with the interpretation there. You
differ with the interpretation of the Building Department. Now,- it's not up to the
Town Board to decide on this 'matter. We have referred your letter and a letter
from Mr. Magi ll's attorney to the Town Attorney today so it has been brought to
his attention for the first time, and I'm sure that he'll be probably in touch with :
you directly.
MR. ROSS: Fine. Just I do think it's a Town Board matter.

CD.CJNCILWOMAN COCHRAN: And they've made a decision. They said it. was pre-
existing.

COUNCILWOMAN COCHRAN: No comment, thank you, Frank. It was nice to have
you with us. You didn't break your record though.
COUNCILMAN PENNY: In fact we feel that you set another record tonight, though,
for being probably one of the longest Town Board meetings.
DEPUTY SUPERVISOR -KUJAWSKI : Oh, -now,..George, that's not true. Not true.
Oh, George, I don't know how you could have said that.
COUNCILWOMAN COCHRAN : This 'is •the longest since the airport.
DEPUTY SUPERVISOR KUJAWSKI There's a motion to adjourn. Is there a second?
Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, it. was
RESOLVED that this Town Board meeting be and hereby is 'adjourned at' 9:20 P.M. .
