SOUTHOLD TOWN BOARD

WORK SESSION ,
Present: Supervisor Francis 'J. Murphy, Councilman Paul Stoutenburgh, Council

(10: 15 A.M.) , Councilman James A. Schondebare (7:30 P.M.). Absent: Town
Attorney Robert W. Tasker.
9:20 A.M. - The Board met with Robert Sansone and his 'associate, Association for
the Help of. Retarded Children, Suffolk Chapter, concerning the proposed construction
of a nine unit 'group home (seven units for 14 clients, and two units for house super-
visors) on the%east side of Horton Lane, Southold, a residential' zone. In' accordance
with the. NYS Mental Hygiene Law, "a community residence established pursuant to(the
law) and family care homes shall be' deemed a family unit, for the purposes of local
laws and ordinances. This 'provisi'on allows such a "multiple residence" in' a residential'
zone. The residence would be a privately owned, non=profit 'facility, licensed by the
Office of Mental Retardation. Mr.. Sansone assured the. Board that covenants and
restrictions would be filed with-the Town ,and the deed, as 'they have done in"the
towns of Islip and. Brookhaven. He will"submit Health Department approvals and have
the covenants and restrictions prepared for Town Board approval, which will be sub-
mitted to the Town Attorney for an opinion.
10:45 'A.M. - Superintendent of Highways Jacobs discussed the need for engaging the
_services of an engineering firm for road inspections, site inspections, etc. The Super-
visor will' requests proposals from various engineering firms for the Town Board's review.
10:50 A.M. - Francis 'J. Yakaboski,:'Esq. , 'of Counsel to Town Attorney Tasker met
with .the. Board to discussion (1) the AHRC group home proposal: State law defines
a family unit-'and such a residence is 'permitted in' a residential-agricultural district.
(2) Ciacia abandoned home on the south side Route 25, east of Pipes Neck Road,
Greenport. (3) Possible Special Attorney to replace former Special Attorney Lark:
suggested the Board wait a few weeks until 'he has had a chance to discuss the
pending matters with the Building Department, Chief Winters, etc. (4) Reviewed
the proposed Local Law relative to amending Chapter 32 of the Code with respect
to Boats, Docks, Wharves and Moorings at West Harbor. He will' make necessary
amendments so the Board may proceed with setting a hearing date at their'7:30 P'.M.
regular meeting. (5) Reviewed the William Heins complaint (he appeared before the
Board at their�-4/21 work session) concerning the denial of a variance to divide his '
lot in Orient. (6) Advised the Board that Herbert Mandel, who was denied a variance
by the Board of Appeals to divide a three acre parcel in' three one acre lots, is 'taking
the ZBA to court.
11 :00 A.M. - For Discussion Items :. (1) Proposed special' attorney to replace Richard
Lark. Was discussed with Frank Yakaboski (see above) who recommended the Board
wait a few weeks. (2) Letter from J. Kevin' McLaughlin' concerning parking on
Youngs Road, Orient. He requested that a new ordinance be enacted to restrict
parking along Youngs Road from May 1 through September 30 to vehicles displaying
Town of Southold resident- permits. Town Clerk was instructed to respond to Mr.
McLaughlin' advising him' the Town cannot, by law, restrict parking on-a pu.blic'high-
way to only,Town of:Southold. vehicles. (3) Need to create a Waterfront Advisory
Committee under the Local Waterfront Revitalization Program grant. Town Clerk to
advertise for resumes (see resolution no. 20) . (4) Letter-from from East End Community
Services, Inc. requesting $15,000 support from the Town for fiscal year 1987 Super-
visor Murphy to respond advising provision has not been made in'the Town 1987 Budget
for such an allocation, therefore they should resubmit their'request for consideration
at the time the__1988 Budget is 'being prepared. (5) Leter from Pebsco of New York
offering a deferred compensation plan. They will' be invited to the May 19th Work
Session for a presentation to the Board. (6) Letter from CSEA President Christine
Stulskly concerning a salary adjustment for Sylvia 'Rouse (discussed in' the Executive
Session at 12:25 P.M.) . (7) AHRC request for approval of a community home on
Horton Lane, Southold (discussed at. 9:20 A.M.) . (8) -Receipt of proposal from Sidney.
B. .Bowne 8 Son, for the design of a computerized information management system for
the Town. This 'will be held until 'Councilman Penny has made• arrangements for two
other consultants to meet with the Board relative to a similar proposal.

11 :05 A.M. - Planner David Emilita met with the Board to review changes to the
proposed Local Law to update the Zoning Ordinance and Zoning Map. Board placed
a resolution on the regular meeting agenda- -(no. 23) to declare lead agency on this
proposal and authorize Mr. Emilita to prepare a Generic'Draft Environmental Impact
Statement.
11 :50 A.M. - Councilwoman Cochran discussed the need to replace a former part-time
Custodian for the Town Hall. Town Clerk will' advertise for applicants (see resolution
no. 22) .
12: 10 P.M. - Board reviewed regular meeting agenda resolutions.
EXECUTIVE SESSION
12:25 P.M. - Board discussed letter from CSEA President Christine Stulsky relative
to a salary adjustment for Sylvia'Rose. This 'matter :was previously discussed by the
Board at their December 30,' 1986 Executive Session, and it was agreed the request
should be denied, based upon the interpretatin of the CSEA Contract.- In addition,
this interpretation was affirmed by negotiator Charles Graves. The Board reaffired
their decision to deny the request. -
12: 40 P.M. - Recess for lunch.
2: 30 P.M. - Work Session reconvened and the Board audited outstanding vouchers.
2: 45 P.M. - Town Justice Frederick :Tedeschi and Town Justice William Price met with
the Board to discuss the increase in the number of cases, paper work, and inquiries
which are being handled by the same staff they have had for years, and the Clerks
cannot keep up with the workload. They requested one additional full-time person,
and a part-time person for the summer months. Further, their quarters are much too
small now, and they do not feel- it 'fair'to ask their 'staff to work in the basement.
The Board discussed several means of increasing space, including renting outside
offices for the Justices and their staff, and will' pursue the matter until it 'is 'resolved.
They also created a new full-time Clerk Typist position (see resolution no. 24) , and
wi II fill the job as soon as possible.

A Regular Meeting of the Southold Town Board was held on Friday, May 1,
1987, at the Southold Town Hall, Main' Road, Southold, New York. Supervisor
Murphy opened the meeting at 3:00 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR MURPHY: The first order of business is 'a resolution approving the
audit of bills of May 1st.
Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was
RESOLVED that the following audited bills be and hereby are ordered paid General
Fund Whole Town bills in the amount of $16,929. 37; General Fund Part. Town bills in
the amount of $9,551.29; Highway Department bills in the amount of $5,201. 36; Fishers
Island Ferry District bills in the amount of $1,573. 10; Southold_ Wastewater Disposal
District bills in the amount .,of. $16',944. 30; Southold Wastewater. Capital Account bills

April '21, 1987, be- and hereby are approved.

COUNCILMAN PENNY: You notice we're starting late because we couldn't get all
our work done.
I ;' REPORTS:.
SUPERVISOR MURPHY: Okay, the first item on the agenda is Reports. We have
no reports this 'early in'the month from other departments, except for now the
Councilmen, and I'd like to start on my right with George Penny.
COUNCILMAN PENNY: Yes, on the 23rd I attended a meeting with the Southold
Town Fire Commissioners in' Gr-eenport, and it 'was very interesting and we're hoping
to follow up with some more discussion. On the 29th I went with the Town- Board to
Connecticut where we..visited a recycling plant run by Peter Carter in Groton. An
incinerator in Windom, and the Earth Grow Composting Plant. On the 29th was a meet-
ing of the Commerce and Industry Committee, where we're still entertaining more dis=
cussion on the Master Plan. . We're getting into it 'zone by zone. On the 30th, which
was last night, I attended a meeting of-the Water Advisory Committee, which I'm certain
that the chairman will comment on. Thank you.
SUPERVISOR MURPHY: Thank you, George. Jay?
COUNCILMAN SCHONDEBARE : I had ten beautiful days in' Florida, and now I come
back to-the Town Hall and it 'was one beautiful day of the trash of Connecticut.. A
wonderful opportunity to see somebody else's garbage for a change, and that's it.
SUPERVISOR MURPHY: Paul?
COUNCILMAN STOUTENBURGH : Yes, we said' we had a Water Advisory meeting
last night, and we're just about ready to hand in' the report. We don't quite have
everythi.ng.together, but hopefully we're going to be almost on target. We may be
a little late, but hopefully we'll be on target. We're gettting much better maps now.
George has gotten some good topographic maps and they're working very well. Basically
we're moving very well on this whole project. I had the opportunity, through our
Town Historian, to travel around the Town with the a State Forester to observe and
record historic trees in the Town. You'll hear more on this later. Of course, we all
visited the Islip Landfill, and I'll leave that for you, Frank. That's it.
SUPERVISOR MURPHY: Jean?
COUNCILWOMAN COCHRAN: I also attended the Commerce and Industry Committee
meeting on the 29th, on which it has been reported. I went to Connecticut, as Jay
reported. On Monday we did' go to Islip' to view their'Recycling Plant. In comparison
to the one in Connecticut, it's a..much c earier p ant in Islip, and a pretty well

organized operation, and I hope the rest of the Board has an opportunity to go view
that plant, because I think it's something that we can work with very well. That's
it, Frank. -
SUPERVISOR MURPHY: Thank !you, Jean. Ray?
JUSTICE 'EDWARDS: On a week ago today Supervisor Murphy, Joe Baier and another
gentleman from the Health Department came over to Fishers Island and we had a sit-
down. They're going to write up some guidelines so we can go out to bid on Fishers
Island for starting on our aquifer, and I think it 'was very informative meeting, and
I'm very glad to see that the County is 'getting behind this program, and it will be
very interesting to see the end results of this. Also, on our--jumping ahead on publ'
notices, Number 1, thie DEC is having public meetings to discuss Water Supplies, and
I wish I were going to be here, because this 'is very, very interesting. One is at k
Mineola, and another one down at Stony Brook Union, off Nichols Road. I think that
anyone who is interested in' Long Island's water should make this 'meeting. Thank you,
Frank.
SUPERVISOR MURPHY: Thank you, Ray. Just to add to Paul--we went and saw the
Islip Town WRAP Program. That?s where they take out their recyclables before they
loaded them on to the barge and sent it around the world. We also did see a build-
ing for storage of hazardous waste which would be an on-going STOP Program, and
Harold Berger has asked us to draw up some plans and specs for what we want to do
and submit it. There's a good chance that we'll receive matching funds on this.
II . PUBLIC NOTICES.
SUPERVISOR MURPHY : Moving on to the second item on the agenda isPublic Notices.
There are six of them. They're on file on the Town Clerk's Bulletin Board, and any-
one concerned about anyone in particular can read them.
1. As Ray mentioned on the. water, to make comments. NYS-DEC invites you
to public meetings to discuss water supplies in the Long Island Substate Region,
Tuesday, May 12, 1987, Nassau County Planning Department, Mineola, Wednesday,
May 13, 1987, Stony Brook Union.
2. NYS-DEC, Notice of Complete Application of Orient Mosquito District to
maintain 4750 linear feet of existing mosquito control ditches and place the excavated
material on both sides of the ditches, south side Main' Road, and east side of River
Road, Orient. Comments -by May 15, 1987.
3. Suffolk County Department of Department of Health Services announcing
May is National High Blood Pressure Month, with free blood pressure screenings and
Awareness Classes available to the public.
4. NYS-DEC, Notice of Complete Application of Russell E. Planitzer to construct
a single family dwelling landward of Freshwater Wetlands, install stone deck landward
of the Freshwater Wetlands and place a maximum (of 6 inches of gravel on proposed drive-
way landward of Freshwater Wetlands, sanitary system and swimming pool, greater than
100 ft. of Freshwater boundary, Wilderness Point, Fishers Island. Comments by May
22, 1987.
5. NYS-DEC, Notice of Complete Application of the Incorporated Village of
Greenport to construct one storm water outlet including pipe and headwall to provide
discharge which would include 50 leaching rings with total capacity to contain 2 in.
of rainfall, Silver Lake wetlands system, North Street at Kaplan Avenue, Greenport.
Comments by May 22, 1987.
6. Village of Greenport, SEQR Positive Declaration, Notice of Intent to Prepare
a Draft EIS Determination of Significance, relative to the adoption of a Local Waterfront
Revitalization Program pursuant to the NYS Waterfront Revitalization and Coastal ResourcE
Act of 1981.
III . COMMUNICATIONS.
SUPERVISOR MURPHY: There's two Communications. 1. From CAST on the Substance
Abuse Committee thanking the Town for thei r'help in arranging a program on Ray's
Island, Fishers Island. So often Fishers Island is forgotten. In' fact some Town Bo
members.-even forget the name of the. Island, they call it Shelter Island.
COUNCILWOMAN COCHRAN : Watch it; Frank.
JUSTICE EDWARDS : I'll sue.
SUPERVISOR MURPHY: Communication 2. is from The State Insurance Fund. We've
been 50 years in' their Workers' Compensation program.

V. RESOLUTIONS.
SUPERVISOR MURPHY: Weill,move on to Resolutions. At this time I'd like to remind
everybody of the policy of the Town Board. If anyone in the audience would like to

now is 'the time to do it. We will hold a time- after the resolutions for any other comments
from anyone in the audience. Anyone like to address the Town Board .on any proposed
resolutions? (No response.) If not, let's move on to Item V, Resolutions. The first
one is to set a public hearing.
1. Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran,
WHEREAS, there has been presented to the Town Board of the Town of. Southold a
proposed Local Law entitled, "A Local Law to amend Chapter 92 of the Code of the
Town of Southold in relation to traffic regulations", now, therefore, be it
RESOLVED that the Town Board hereby sets 8:00 P.M. , Tuesday, May 19, 1987,
Southold Town Hall, Main Road, Southold, New York, as time and place fora public
hearing on the aforesaid proposed Local Law which reads as follows, to wit
LOCAL LAW NO. - 1987
A Local Law to amend Chapter 92 of the Code
of the Town of Southold in relation to traffic regulations
BE IT ENACTED by the Town Board of the Town of Southold as follows :
Chapter 92 of the Code of the Town of Southold is hereby amended as follows:
1. By amending Section 92-41 (Parking Prohibited at all times)-'by adding
thereto the following:
Name of Street Side Location
Traveler Street South At Southold, from the southwest corner of
Traveler Street and Beckwith Avenue proceed-
ing westerly for 111 feet to the guardrail.:
2. This Local Law shall take effect upon its filing with the Secretary of State.

SUPERVISOR MURPHY: Number 2 is 'to authorize to enter into an agreement with
Suffolk County for the 1985 Affordable Home Ownership program. I offer that
resolution.. ,

2. Moved by Supervisor Murphy, seconded by Councilwoman Cochran, it was.
REOSLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Francis J. Murphy to execute an agreement between the County
of Suffolk and the Town of Southold for participation in the. 1985 Affordable Home
Ownership grant, as a participating Consorti.um municipality, to undertake the re-
habilitation of residential property owned by low and moderate income persons .in
designated target areas.
2.-Vote of the Town Board : Ayes: Councilman Penny, Councilwoman Cochran, Council-
man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.

SUPERVISOR MURPHY: And number 3 is to set a public'hearing.
3. Moved by Justice Edwards, seconded by Councilman Stoutenburgh,
WHEREAS, there has been presented to the Town Board of the Town of Southold a
proposed Local Law entitled, "A Local Law in relation to boat operators, boat equip=
ment and anchoring in West Harbor", now, therefore, be it
RESOLVED that the Town Board hereby sets 8: 05 P.M. , Tuesday, May 19, 1987,
Southold Town Hall, Main Road, Southold, New York, as time and place for a public
hearing on the aforesaid proposed Local Law which reads as follows, to wit:

operators, boat equipment and

BE IT ENACTED by the Town Board of the Town of Southold, as follows:

I . Article I I I ' (Boats) of Chapter 32 of the Code of the Town of Southold, Section
32. 31. Definitions. is 'amended as follows :
BOATS - Every vessel propelled in any manner. [, except vessels having a valid
marine document issued by the Federal Bureau of Customs or any
foreign government. ]
11. Article 111 , Chapter 32 is amended by adding two new sections thereto, to be
Sections 32-36. 1 and Section 32-36.2, to provide as follows:
Section 32-36. 1 Equipment.
A. All pleasure- vessels and uninspected commercial' vessels shall be equipped
and lighted while. under way or at anchor with any person aboard, as
required under the Federal Boat Safety Act of 1971, as amended, and
the regulations adopted pursuant thereto and contained in' Title 46 of the
Code of Federal Rules, Subchapter C, Parts 24, 25 and 26, and pursuant
to the provisions of Section 40 of the Navigation Law of the State of New
York. Failure to comply with the equipment -and lighting requirements as
set forth above shall be a violation of this Chapter.

B. The provisions of this section shall not apply to vessels competing in' duly
authorized regattas and trials preceding such regattas.
Section 32-36.2 Boat Operators.
A. No person under the age of sixteen (16) years shall operate a mechanically
propelled vessel unless:
(1) The operator, who is 'under the age of sixteen (16) years, is accompanied_
therein by a person who is sixteen (16) years of age or older; or
(2) The operator is ten (10) years of age or older and is the holder of a
boating safety certificates issued to him by the Commissioner of the
Office of Parks and Recreation of the State of New York, pursuant
to Section 78 of the New York State Navigation Law.
B. T_he failure of a person specified in Section 32-36. 2(2) hereof to exhibit
a boating safety certificate upon demand to any peace officer or other
officer having:,authority to enforce the provisions of this Chapter shall
be presumptive evidence that such person is not the holder of such
certi fi.cate.
C. No person who is the owner of a motorboat shall knowingly authorize or
permit the operation thereof unless:
(1) The operator is sixteen (16) years of age or older; _
(2) The operator, who is under the age of sixteen (16) years, is '
accompanied therein by a person sixteen (16) years or older; or
(3) The operator is -ten (10) years of age or older and is 'the holder
of a boating safety certificate issued to him- by the Commissioner
of the Office of Parks and Recreation of the State of New York.
D. No person shall operate a vessel' while in an intoxicated condition or
while his ability to operate such a vessel is impaired by the consumption
of alcohol or by the use of a drug.
Ill . Section 32-39.2A (anchoring in'West Harbor) of Article III (Boats) of Chapter
32 of the Code of the Town of Southold is amended as follows:
A. All boats temporarily anchored in' West Harbor at Fishers Island shall
anchor [north of Goose Island. ] in* an area assigned by the Harbor
Master or Bay Constable.'
(1) Anchoring shall not be permitted for a continuous period of more
than three (3) days unless authorized by the Harbor Master or
Bay Constable, which authorization may only be granted for
emergency situations.
IV. This Local Law shall take effect upon its filing with the Secretary of State.

man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.

SUPERVISOR MURPHY: Number 4 is to authorize the placing of an ad.
4. Moved by Councilwoman Cochran, seconded .by Councilman Stoutenburgh, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes Town
Historian Antonia Booth to place a display ad in: The Suffolk Times and the Long
Island Traveler-Watchman seeking volunteers for the Celebration of the Bicentennial_'
of the Constitution on Septemb er 17, 1987, and the 11990 celebration of the 350th
Anniversary of the Founding of the Town of Southold.

man Schondebare, Councilman Stoutenburgh, Justice. Edwards, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 5 is 'to authorize the renewal of a trailer permit
application for David Horton and Gerry Horton for a single family house trailer,
which expires May 7, 1987. 1 offer that resolution.
5. Moved by Supervisor Murphy, seconded by Councilman Stoutenburgh, it 'was
RESOLVED that the application;iof-. David S. Horton and Gerry S. Horton for renewal
of a single family house trailer permit, for trailer located at Ki rkup Lane, Mattituck,
New York, which permit expires on May 7, 1987, be and hereby is ranted for a
six (6) month period.
5.-Vote of the Town Board : Ayes : Councilman Penny, Councilwoman Cochran, Council-'
man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 6 we're going to hold for a little while (place a
display ad in the newspapers for applications for the Southold Town Affordable
Housing Program) . Number 7 is to accept a resignation.
7. Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was
RESOLVED that .the Town Board of the Town of Southold hereby accepts the
resignation of Harold P. Schwerdt, Past Commander of the Griswold-Terry-Glover
American Legion Post No. 803, Southold, as a member of the Council 'an. Veterans
Affairs, effective immediately, and be it further

Company will provide a trailer at the Southold Town Landfill Site, Cutchogue, to be
filled by Town employees, picked up by CTR and delivered to their scrap tire shredding
and storage facility in Bloomfield, Connecticut, at a cost to the Town of $1,000. 00 per
trailer load, for a period of one (1) year from this 'date, May 1 , 1987.

navigation channel at Gull Pond, Town of Southold; and
WHEREAS, the County of Suffolk proposed to do said' dredging of Gull Pond, in' the
Town of Southold, at a nominal cost to the Town of Southold; and
WHEREAS, in order to accomplish said dredging, plans, specifications, agreements
and other documents must be executed on behalf of the Town of Southold; and
WHEREAS, this approval shall remain in effect for the period of the required permits
(Expiration Date: May, 1987) ; now, therefore, be it
RESOLVED that the Supervisor be and he hereby is authorized to execute, on behalf
of the Town of Southold, all necessary plans and specifications, spoil area agreements,
assurances to the County of Suffolk, license and/or dredging permit 'applications to
Federal and State -Agencies and all other documents that may be required to accomplish
said dredging work.

COUNCILMAN PENNY: Yes, a couple of things.. Number one, I'm very happy to se
Resolution No. 23 in place, on the environmental impact statement. That's consistent
with the way I voted back in' last December, and -I'm glade to see that we're doing this
because it shows that we do have a concern for the environment here and I know it's..
one of the main criticisms that we got ins the Master Plan, the fact that we were not
doing this: Now I'm glad to see .this 'being corrected. Number two, is ' I'm very happy
to, see also that the dredging is going on Deep Hole Creek.' In spite of some of the
reports to the contrary. There were some articles in the papers which alluded to the.
fact that maybe,,-it 'would be done, maybe it wouldn't be done, maybe the Town had
other priorities. I'm sure that by seeing the dredge now all this will be cleared up.
Deep Hole Creek has been for well over a year a number one priority in .Southold Town
and it 'is now being done. Thank you.
SUPERVISOR MURPHY: Anyone in' the audience like to address the Town Board on
any item? Yes.
FRANK BEAR: I'd like to just ask. -a question.
SUPERVISOR MURPHY: Would you identify yourself,, si'r.
JOE BLOW (alias Frank Bear) : I'd like to ask,.a 'question as a taxpayer. Item number,
81, added to the salary proposed for this Steno ra Wr is thirty-two cents. _ -
TOWN CLERK TERRY: That's what the salary. scale first step is, Frank. It appeal{
in the Civil Service Contract.
SUPERVISOR MURPHY: We have: to abide by the contract.
TOWN CLERK TERRY: On that January scale they all have odd cents added to them.' .

Town Board thanking Sue Fossett.

the Southold plaque that we give on special occations, thanking Sue Fossett for the
fine job she's done as our Recreation Director. As you know, and I know Paul andlli=7
1--we're on the same committees, the Beaches and Recreation, and we're upset that
we're losing her, because she did' give us a good strong foundation. So we'll be
interviewing next week and we hope the next person that comes in--they'll have
an easier job because it is .in' place and we hope that they can fill Susan's shoes.
She has a bad cold today and she's out sick. But .for the. record .the .entire Town
Board expresses good luck and our best wishes and our thanks. -
