SOUTHOLD TOWN BOARD

WORK SESSION
Present: Supervisor Francis 'J, Murphy, Justice Raymond W. Edwards, Councilman

9: 15 A.M. -. The. Board met with Fred Lehn, Long Island Office Equipment, and Receiver
of Taxes George Mellas to discuss the purchase of new Olivetti ETV 260 Work Stations
for the Tax Receiver's. Office, to replace the present obsolete Olivetti machines. The
machine combines typing, word processing, personal computing and computer terminal
access,' are MS-DOS compatible, with dual disk drive, and printer. Mr. Mellas would
like to 'purchase three machines at a cost of $3,000 each, plus $1,500 for the software
and $60T for battery pack. The .Town Board, who is considering various methods of
computerizing the Town Hall, will' consider the proposal, and Mr. Mellas will' speak to
the. North. Fork: Bank relative to compatibility with their equipment.
9:55. A.M. Town Historian Antonia Booth met with the Board to review her proposed
members of the: Steering Committees for the Celebration of the Bicentennial of the
Constitution on September 17th, .1987., and the 1990 celebration of the 350th Anniversary
of the. Founding of the Town of Southold. Councilman Stoutenburgh emphasized that
the community should be involved in' these committees, and Mrs. Booth assured him'
the community would be involved in' the sub-committees which will' be formulated by
the Steering Committees. See resolutions 24 S 25 for the appointment of the committees.
10:05. A.M. - Richard T. Girards, Newbridge Plants; Inc. , appeared before .the Board
to discuss his 'request for temporary permits for two office trailers at his 'property at
6900 Wickham Avenue, Mattituck. Mr. Girards assured the Board that his 'goal is 'to
construct an office building and eliminate the trailers with a years time. Upon this
assurance the. Board placed resolutions 26 and 27 on the agenda for six month permits,
with possible extension for an additional six' months.
10: 15 A.M. - Carl Vail 'and Joseph Zimmer. appeared before the Board to make a
formal presentation of a shellfish measuring scale (Vail 'Scale) designed by Mr.
Vail. and manufactured by Mr. Zimmer. Mr. Vail 'thanked his 'family, Ruth Oliva
of the NFEC, Southold Town Baymens Association, especially Steve Latson, and Mr.
Zimmer for their cooperation in producing the scale. Mr. Vail 'and the Southold
American Legion donated 2,500.'scales to be. given to individuals purchasing shellfish
permits at the Town Clerk's Office. Mr. Zimmer explained that when future scales
are purchased from the Legion at 50� 'each, 18� .of that sale will' go to the Legion
Scholarship' Fund. He will' be. turning over all . rights to the design and mould to
the Southold Ameirican !Legion, Griswold-Terry-Glover. Post. The .Board thanked
Mr. Vail 'and Mr. Zimmer and Supervisor Murphy presented Mr. Vail with a mounted
Seal of the Town of. Southold.
10:30 A.M. - Board audited outstanding vouchers.
11 :00 A.M. - Merle Wigging Peconic'Associates, Inc. and Roger Wilhelm, Charles R.
Velzy Associates, appeared -before the Board to advise that. they have been following
the Windom, Connecticut incinerator plant, which,is.'comparable to the size' and need
for Southold Town. The Board will make arrangements to travel to Windom to view
the plant. Mr. Wiggin' also resubmitted his 'May 1985' Solid-' Waste-To-Energy Feasibility
Study for the Village of Greenport and Town of Southold.
11 :25 A.M. Robert W. Brown, Rich Slutzer, Christine Leopold and their'Consultant
Raymond C. Dean of Sidney B. Bowne. & Son, met. with the Board to discuss their
capabilities for designing a computer system for the Town Hall. through their'subsidiaey
Bowne Management Systems, Inc. They have experience with the Towns of North
Hempstead,. Brookhaven, Huhtingtioh, Oyster Bay, and Islip in' various departments.
Ms. Leopold demonstrated their computer program for a :Highway Department client.
Mr. Brown was asked to draw up a�,System Plan Document containing projected cost
for hardware, software and consulting. services.

12:25 P.M. - Recess for lunch.
2: 15 P.M. - Work Session,\reconvened,. .and the Board met with Bob Henderson of
the New York State Department of Environmental -Conservation to discuss recycling
for the Town. Mr. Henderson, an expert in' this 'area, explained methods of. State
funding, contract requirements and need for a market for the recycled material to
qualify for the funding. He said' $500',00 has been earmarked for Long Island, and
the Town would be eligible for 500 of the total cost of equipment for the project up
to $50,000 'strictly for a recycling project. Mr. Henderson suggested Southold go
in with other townships with a central collection center for economy purposes. He
recommended a visit to the Islip Town recycling center, the largest in the U.S .
and second largest in' the world.
3: 10 P.M. - Carl J. Nelson , Superintendent, Greenport Public 'School, appeared
before the Board to submit a proposal for the school district to either donate or
lease property to the Town so the Town may construct tennis 'courts. Mr. Nelson
was asked to submit a proposal, including the probable cost, prior to the preparation
of the Town's '1988 Budget in' September.
3:25 P.M. - Frank Bear, Chairman of the Water Advisory. Committee, appeared before
the Board to the review the Committee's proposal for a Southold Town Water Resources
Management Program, the draft of which includes goals, objectives and criteria: Super-
visor Murphy made only one suggested - that on page 4, item 4 - "I f'not feasible,
Town services similar to those provided by the Home..Treatment Unit Program should
be made available" - instead of "should: be provided". Councilman Schondebare commentec
that "Objectives, "Groundwater Resource, item 4,. To ensure the overall population density
and concentration of commerce and industry, as provided for in' the Comprehensive
Master Pland and Zoning Map, do not exceed the capacity of the groundwater resource
within' the respective water budget area" should have been accomplished before preparatio.

3:45 P.M. - David - Emilita, Planner, met with the Board to review Transfer of Permitted
Residential' Development Rights District Provisions as provided- for in' the Code of the
Town of Southampton. Mr. Emilita will' look into the provisions of the Riverhead .Town
Code and report back to the. Board.
' a 4: 10 P.M. - For Discussion Items: (1) Possible resolution to accept the proposal of
Garrett A. Strang, Architect, to provide the Board .with an Energy Audit .of the
Police Headquarters. Board will hold for further .consideration as the cost to improv,
the conditions at Police Headquarters will probably be included in' the 1988 Budget.
(2) News Release from the New York State Department of Environmental Conservation
relative to a report from the DEC's Tidal Wetlands Advisory Committee' containing a
number of recommendations and findings concerning the .Tidal Wetlands Act. Council-'
man Penny v►'i.11'.review this matter with the.Town Trustees and Town Attorney. (3)
Possible resolution relative to a refund with respect to the inspection fee collected for
major subdivision "Blue Horizons". at Peconic: Board agreed. to deny (see resolution:
no. 28)'. (4) Request for temporary trailer permits by Richard Girards, Newbridge
Plants, Inc. , Wickham Avenue, Mattituck. (see discussion with Mr. Girards at 10:05
A.M.) Board •to grant temporary permits provided Mr. Girards constructs permanent
building. (see resolutions 26 8 27) . (5) Community Development Administrator Jim'
McMahon met with the. Board to suggest a salary increase for Youth Counselor Mary
Ann. Fleischman, who has assumed more. programs and far exceeds the 20 hours per
week provided for under the NYS Division for.Youth Grant of $10, 000.. Board agreed-
to salary increase (see resolution no. 31) (.6z7) Discussed the creation of two positions
of Scale Operator and the starting salary of a.:Sanitation Supervisor, all for the Land-
fill' (see resolutions 29 6 30) . : (8):.Counci lman Stoutenburgh advised the Board the
Farmland Committee would' be willing to draft proposed legislation for an Open Space
Bond and the. accept the responsibility to oversee the .program. Board in' agreement.
: (9) Proposal by Councilman Stoutenburgh to, issue,free of charge, resident vehicle
permits to the Recreation Director, Beach Manager, Lifeguards and Beach Attendants
for the 1987 season. Board agreed (see resolution no. 32) . (10) Discussed a proposal
to place vending machines in the Senior/Youth Center by the Adult Advisory group.
Board does not object to candy and soda machines, but must know the,specific'machi
before granting authorization. (11) Discussed need for a part-time Highway Constri for
Engineer. Town. Clerk to advertise for resumes (see resolution no. 33) .

COUNCILMAN PENNY: On the 25th the Dog Pound Committee met with the Animal
Welfare League to discuss the on-going construction. The construction schedule
site clean-up, and there was some general discussions regarding procedures. On
M. I attended a meeting of the Housing Committee, which the chairman will report
on. On .4/1 also I attended a meeting of the Code Committee, which the chairman will
report on. On the 2nd I attended a meeting of the Highway . Committee, which the
chairman will report on. And on the----

COUNCILMAN STOUTENBURGH: Yes, I'd -just like to--did you speak about the
Trustees at all, Jay? Jurisdiction?
COUNCILMAN SCHONDEBARE: I did'.
COUNCILMAN STOUTENBURGH : I wasn't listening. I'm sorry. I just wanted to
make sure because I thought that was rather important.
COUNCILMAN SCHONDEBARE : You weren't listening to my report?
COUNCILMAN STOUTENBURGH: No, I wasn't.
COUNCILWOMAN COCHRAN: Can't say as I. blame him'.
COUNCILMAN SCHONDEBARE : My\ report?
SUPERVISOR MURPHY: Bring him up on charges.
COUNCILMAN SCHONDEBARE : You were not listening, Pau?
SUPERVISOR MURPHY: Paul, how can you do that?
COUNCILMAN SCHONDEBARE : Aren't you chairman of anything?
COUNCILMAN PENNY: Just the Dog Pound. And on .the 3rd and 6th attended
a meeting of Parks and Beaches, two meetings of Parks and Beaches, which the
chairman will report on. Just wanted to let everybody know I was there.
SUPERVISOR MURPHY: Thank you, George. Jay?
COUNCILMAN SCHONDEBARE: Yes, as chairman of the Code Committee, the Code
Committee met on April '1st. We had a nice meeting with the Trustees. They're
going to get back to us. We d1scussed their jurisdiction on the Long Island Sound,
and we also discussed some of the problems that they were having. They've recommEMed
an amendment to our Code with regards to the placement--placement in-kind of bulk-
heads so that they can be viewed as simple repairs without the necessity of going
through the whole permit -process. So hopefully we can reduce the time period from
three months to one month. We went over the trailers. There's a number of recommenda-
tions. 1 think we finally came out with a concrete proposal to submit to the Town
Board on the trailers. And we discussed, once again, the limitations with regards
to any time period on how long a subdivision can exist after it's been approved. Like-
wise the ZBA advises what they're doing is=-their approvals are limited to three years
and after three-years their'approvals are void: We discussed the possibility of doing
that with regards to subdivisions and the possibility of doing that with regards to
zoning. . The idea basically being is that we don't have problems like the Carr and
Norris property popping up thirteen years after previous approvals have been granted.
also attended the Highway meeting, of which the chairman will report on. There's
a special meeting for the Code Committee for this Tuesday, April 14th. These members
don't know because I lust did it at the request of Victor Lessard, who told me that
information with regards to the construction and the Flood Plain area should have been
on our books as of March 31st, and since it's not on our books as of that date people
who are-living in that district could wind up being penalized in some manner with regards
to their ability to rebuild. So at his request I have called for a special meeting on
Tuesday night, April 14th, 7:00 to 9:00 to discuss this and hopefully we put it in place
at the next Town Board meeting. And that's it. _
COUNCILMAN SCHONDEBARE: At least you're honest, Paul.
COUNCILMAN STOUTENBURGH : All right. We had a Highway Committee meeting
on the 4th7-the 2nd rather, in' which we reviewed a lot of subdivisiohs,. .and we're
having, as you know, our Highway Superintendent goes over these subdivisions and
wants clarification through the Highway Committee and we sit down and discuss these
various proposed, such as thickness of roads, should we let this man make his roads
wider or narrower. . .ThisAs the kind of thing we continually do at these meetings.
We did come up with an idea that we should be looking into some of our sumps and
trying to locate some spots for natural sumps, which are most important. As you
know with this rain problem that we've had. lately we've had all kinds of water
problems and unless we start looking for places for this water to go, we're going
to be in trouble intthe future, so Ray is getting: a list of those for us. I think
the big news in the`highway area, and it doesn't have too much to do with highway,
but it does relate to our Landfill, which Ray Jacobs reported on, is that we have
,n our compactor, and I think this 'is-'one of the big things everyone was looking for.
s° I've seen it, and it looks good and hopefully it's going to do a lot for our Landfill:-
We had a Farmland Committee meeting on the 2nd, and we reviewed with the owner
of the property, Jim Cross in Cutchogue. There's some concern about values and
we're rethinking the value of the land. The people also wanted to know about the
movement of Krupski's house off the Farmland Procirarr-'s property, and wanted to

make sure that was going along. I went up and reported that it was. It should
be off by this week if the rain stops. They're already to move the house on to the
new foundation. Also there was -,a Village.,Green meeting, and we're getting together
with more exact figures as to cost and who's going to contribute what. It 'becomes
a little sticky when you get more than one person involved in' wanting to give money
for one thing, and I think the policy has been set by the group that they will no
longer let anyone put money towards say a gazebo, or towards a walk, or planting
of particular trees. What they're going to do is take that money, put it into a pot
and then do the job accordingly without a name on each one of these things. Eecause
these people were trying to compete to do them. On the 3rd we had interviews for
- our Recreation Supervisor. We had four candidates of which one or two looked fairly
good. We're waiting for a decision or. that because Sue Fossett, our now Supervisor,
is 'off on a convention and she thought she would find some of these names popping
up with people she was going to meet and so we are going to act on this quickly and
I'd like to make a recommendation that if 'we do come up with something we call a
special' meeting some morning at 8:09 o'clock and act on this 'thing, Frank, because
we *do. need, and I think. we'll try to have those as soon as she gets back here.
That's most important. On Monday. the Park and Beaches met. We had a good meeting
there and we got a lot of things lined up for thi s 'comi ng year at 'our beaches. As you
well know this 'is 'starting to run down to the season now when we'll have to be opening
our beaches. We're going to open them up on the 27th and 28th. Those are the days
we're going to open our beaches.. We have, I think, a pretty good ,control of our
beaches as far as our attendants-, our lifeguards, our beach manager. We now have
duties for each of these people, where years ago it was sort -of a-run-around. We
have a police person who travels to each beach. I think it's much better run then
it has in the. past and I'm looking forward to a real good season. We have hired
our. Beach Manager, Bob Muir: once again'. ..We did have a meeting on the Plock.
property, which I'll let Jean fill us in'on, and I think that's about it:

COUNCILWOMAN COCHRAN: . Thanks, Paul. Since Councilman Stoutenburgh gave
my report as Highway Chairperson, I have very little. to report.
COUNCILMAN STOUTENBURGH: I didn't think I did' a very good--I didn't think
I did very well on it.'
COUNCILWOMAN COCHRAN : I think you did very well. But I had planned to report
on it: Paul did' cover everything pretty: ir.uch. There were only one or two other
things as far as a change in'-specs for asphalt bidding, and that Superintendent Jacobs
will put the Long Island Rail.-'fRoad::on notice as far as the bridge on Bridge Lane,
because that is 'Rail Road property, the bridge, and he feels it's time for inspection.
In' addition I attended the Parks and Beaches Committee, of which Councilman Stoutenbur
has reported on. Also, as Paul mentioned, yesterday we did' meet: in relation to the
Plock property. It 'was a very productive meeting I felt. Not only were Paul and I
there, and Professor Walter Smith from the Marine Center here in' Southold, we also
had Ellen Larsen from. the Trustees,. Greg Riviera `and Chris Smith from Home Extension,
Bayman Wentzel and Latson, and, of course, Jim' McMahon, and we had Dr. Walter
Blogoslowski from Milford. He's a federal employee, but he is 'one of the top five
authorities on purging of clams to remove the pollutants in clams--depa ratio n I believe -T
it's .called, Paul, right?
COUNCILMAN STOUTENBURGH : Yes.
SUPERVISOR MURPHY: Quite a claim to -fame..ish't it?
COUNCILWOMAN COCHRAN: Yes, it 'certainly is: But he's the top man in' his field,
and we vent down and spent about an hour or hour and a half at the Plock property,
and then came back and discussed it: He felt that the first step that the Town should
take 'is 'to have coliform tests done in' both the pit and the lake under the building.
So, I did contact Jim Redman today and the State would be helping us with that. The
only thing is 'I have to notify the Bay Constable so that this 'is 'who they'll work
together to do these tests, Frank, so 1 have to take care of that in the morning. f•r
There is some possibility that the facility might prove valuable, but we have to qo
by steps and the first step is 'the testing, getting the DEC involved, and Mr.
Blogoslowski i's 'attending a conference in two weeks and he will' be talking to one
of the DEC .people--it 'won't be Jim' Redman because he is 'not going to this *conference,
but one his 'people is 'going so they're going to discuss it and see if'the land does
have a value and it 'would be a positive step..for the Town to take it 'over. Also 1
had the pleasure of guest speaker at the League of Women Voters, and the topic was
"Women in' Government". I think it went very well. . I thank them for their'kind

JUSTICE EDWARDS: We over on the Island got the. same amount of rain" as you have
here and the reservoir 'is 'over the top and some .wet spots in' the road. Also I couldn't
fly out last night, I had to take the long ferry ride and left Fishers Island quarter to
five and got over here about 8:30. The new terminal, I'm surprised that none of the
newspapers have gone over there and .taken, pictures of the new terminal. in' New London.
It's moving right. along and looks like that will' be open some time in June. I've been
working on my new office over thereat the movie:theatre at the Island. We put: some
electricity into it an now we're crosing it 'inl Going to' put. some paneling on the walls. :
It's going to be a nice meeting room this 'summer when I have to hold court over there,
other then the State Police Barracks, which 1 have been, using. And the Fishers Island
Telephone Company just cut over a new computerized alarms stem this 'past..week, which
was involved in, and it was quite a bit of.work. And also the sewer system on the
Island was one of the first people--customers that were cut into the alarm business.
And we have over 1'00 workmen commuting every day from New London to Fishers
Island, there's .quite a bit of building, reconstruction and: construction over there,
and it's ,been a. very active winter and spring and I can imagine what the summer is :
going to be like. . Our two State Troopers have been chosen. The first one will be
there the. first of May. He'll stay. .unti l the fir§F of November. The second one will'
come sometime in the middle of June through the middle of Septerrber. So the Island
is starting to get.alive. Thank:you, Frank.
SUPERVISOR MURPHY: . Thank you, Ray. .. Pd:just like to make a couple other comments.
One, we almost had a rear tragedy .in' the Dog Pound, and hopefully we'll get completed
in' there. It has gone on much too long and it 'really is 'terrible and thank Cod nobody
really got hurt. 1 would like to acknowledge publicly the report from the Econorric'
Advisory Committee. I think they did an excellent lob and gave an excellent report,
and maybe we'd want to discuss it--the aspects of it--
COUNCILMAN SCHONDEBARE : We've asked them to come. in' the first Board meeting
in May to make a little presentation to. us. I just did' that today.
SUPERVISOR MURPHY: Yes. The only other one. is'I almost becair.-e very farrous.
was invited to the fourth grade at one of the grammar schools to discuss 'the .history
of Southold Town and its Town Seal; and it seems this 'little kid--each one had to invite
a Supervisor of the Ten Towns, and about the history--so 1 brought ours down and a
little history of the Town and was talking to them. . Well this 'kid' goes home at night
and tells his 'father, he says, "Eddie Murphy.-was in'our class today. " And the father
sais, "Eddie Murphy? Why was he there?" And the kid' says, "Yeah, Eddie'Murphy.
You know, the Governor of the Town. " So it 'was good. The kids had a good time.
It's a good program and we're very happy to participate on behalf of the Town.
COUNCILMAN STOUTENBURGH : Could I say one thing? Just for the people who
weren't here two or 'three weeks ago when we talked about this 'Plock property--you
might not quite understand why we're investigating this.' As you know, many of our
creeks--not many, but two of our creeks have already been closed and there's a
possibility of other creeks closing, and the only way a Bayman can utiliie' his.'clams
then that he gets out of an area is 'to take them in: and have them purged or cleansed,
and that's basically what we're thinking of using this 'area for. If'itcan't be used
for that, I don't see too much other need for it; right Jean?

SUPERVISOR MURPHY: Number Ill is 'communications. There is one letter from
Assemblyman Sawicki to a Peter VanVolkenburgh asking that Ma;ttituck Creek and
Mill Creek be allowed to stay open longer, and we do have it extended a little
longer. We're asking that the conditional testing be gone on through the summertime.
It's impossible this year evidentially, but hopefully next year we could arrange for
this'testing.

the people in' the audience of a Town Board policy of allowing anybody to speak on
a proposed resolution at this 'time. After the resolutions are done we will' have a
period of time for public'comment on anything that you want to address the Town
Board on. We ask you to limit 'your comments to the proposed resolutions that we're

the first is 'a tribute to Sergeant Barney Harris who is 'retiring as a Sergeant in' the
Southold Town Police Force.

WHEREAS, the Town Board of the Town of Southold wishes to pay tribute to
SERGEANT BARNEY P. HARRIS' who retired from public'service on March 31 ,
1987; and
WHEREAS, SERGEANT BARNEY P. HARRIS' joined the Southold Town Police force on
June 8,' 1949, terminated service on April 9, 1953, rejoined the force on August 29,
1957, attained the rank of Sergeant on November 7, '1962:, and faithfully served the
people of the Town of Southold throughout his entire career as a Police Officer; and
WHEREAS, his 'record of fine service to the Town deserves the sincere gratitude of
those with whom and for whom he has served, and has made our community a better
and safer place to live; now, therefore, be it :

York State Senate to adopt the New York State Assembly proposed Federal Revenue
Sharing Program which .will (1) increase the amount of new State revenue sharing,
particularly in light of the Federal cutbacks, (2) change the existing formula for
distribution which penalizes towns and unfairly benefits the. cities, and (3) use
current census data to determine the amount of revenue to be provided to our towns.
The Assembly proposal will' provide a base aid' program, and would provide a new
permanenet program ditributed according to a modified Federal revenue sharing
formula representing 4.7% of all State general fund revenues; and be it further
RESOLVED that the Town Clerk be and she hereby is directed to transmit 'a certified
copy of-this resolution to each member of the Long Island delegation to the New Yor
State Senate, and the New York State Assembly.

opposition to Senate bill 1880 and Assembly b1112690, entitled "AN ACT to amend
the Environmental Conservation Law, creating a marine resources advisory council
and repealing subdivisions one, two and three of Section 13-0335 and subdivision
five of Section 13-b347 of such law relating thereto," which establish, for the first
time ever in the State of New York, a commercial' fishing license, which legislation
would establish another license fee upon the backs of an industry which has already
suffered severe setbacks; and be it 'further
RESOLVED that the Town Clerk be and she hereby isdirected to transmit 'a certified
copy of this resolution to each member of the Long Island delegation to the New York
State Senate and the New York State Assembly.

adverse off-site_ drainage impacts are possible. . These can be eliminated by Planning
Board. approval of a drainage plan that recharges all drainage flow on site above that
rate naturally flowing off site.
(3�)' During construction, adverse air quality impacts are, possible. The.use of
standard 'dust control and vehicular emissions control measures will' eliminate air quality
impacts. Dust control measures shall be approved by the Planning Board.
(4) During construction, adverse noise impacts are possible. Scheduling con-
struction during normal working hours and buffering existing dwellings with landscaping
and earth berms will' mitigate against any significant adverse impacts.

I. . That pursuant to the provisions of Article 8 of the Environmental Conservation
Law, Part 617 of Title 6 of the New York State Codes, Rules and Regulations, and
Chapter -44 of the Southold Town Code, the Southold Town Board, as lead agency,
does hereby- determine that the action, which is 'unlisted, is likely to have a significant
effect on the environment, as the_ proposal would introduce a significantly different
charcter to this primarily residential segment of Main Road and warrants preparation
of a full Environmental Impact Statement if 'the zone change is 'to be contemplated .by
the -Town at all.

SUPERVISOR MURPHY: Okay, that's the end of our prepared and added-on-to agenda.
Is there any Town Board Members like to make any other comments? Ray?
JUSTICE EDWARDS: Just a couple little comments here. Number one, normally we
give a little resume of what we've done in' the past couple weeks. I'm going to give
you a little resume of what I have coming up. I have court in here all day tomorrow.
Thursday morning I'm meeting with the Supervisor of Motor Vehicles in' Riverhead and
I'm going to get some instruction on using the camera and I'll be bringing the camera
over to take motor vehicle driver's license pictures on the Island two times a year.
So I have another hat that I can wear. And I also have to drive down to Hauppauge
to do some work for one of my constituents on the Island. So I'll be lucky if 'I get
home Thursday night. More like Friday morning. Thank you, Frank.
SUPERVISOR MURPHY: Thank you, Ray. Jean?
COUNCILWOMAN COCHRAN : Yes, more or less under good and welfare as far as
the community is concerned. As you know the straightening of the curves in' Laurel
has caused some negative feeling in' relation to the publi c'i n the removal of so many
trees and Councilman Penny at our.:Highway meeting did bring up the fact that on
Sound Avenue they are also planning to. straighten curves up there and we were
informed that they were just going to be removing trees from one side, but according
to their'cor respond ence they will' be removing trees from both sides of the road .for
a distance of 20 'feet, and if'you're familiar with the area, that means there's going
to be an awful lot of trees taken down. So we felt that we would place this in' our
tickler file and once the definite plans came down that we certainly would make sure
that the neighboring area would be aware of the fact of what was going on there and
not be promised a certain amount of trees come down and find out that it''s quite barren
the next day.
SUPERVISOR MURPHY: Thank you, Jean. Paul? (Nothing.) Jay? .
COUNCILMAN SCHONDEBARE: Yes, just one. On number 17 that we approved,
noticed that the Surety Bond is 'from the North River Insurance Company in' New
Jersey. It 'says they are authorized to do business in' the State of New Jersey. As
you know we've had the Union Indemnity Insurance on the bonds for a lot of these
and it went bankrupt. The State Insurance Fund took it 'over. Union Indemnity was
'authorized to do business in' the State of New. York. My question now is; we're goini
to start seeing the North River Insurance Company. Are they also, if 'anything happi
to them, going to be picked up by the State Insurance Fund? Are they authorized to
do business in' the State of New York? Remember we went through this 'before, between
approved and authorized? It:'doesn't say on their'bond. And I'm wondering if'they
go under are .we out of luck.or: will' the State Insurance Fund come in' and pick it 'up?
SUPERVISOR MURPHY: We could ask. This 'is 'not that critical as far as the insurance
policies that we'were trying to get for our liability coverage, but it 'is 'a point.
COUNCILMAN SCHONDEBARE: Well at the Highway meeting we were talking about it;
and some of them from the Union had gone under, and at least-the State Insurance
Fund came in' and picked it 'up. Now the question is 'is 'this `company authorized to
do business in' thisState?
SUPERVISOR MURPHY: Do you want to maybe amend it 'providing that this 'company
is:. . . .
COUNCILMAN SCHONDEBARE: Is' authorized to do business in' the'State of New York.
SUPERVISOR MURPHY: Any problem with that, George? (None.) Paul? (No. )
.Jean? (I ' have .no problem. I think it's a good point.) Ray? (No, no problem.)
COUNCILMAN SCHONDEBARE: Then amend the resolution to provide for it.':
COUNCILMAN PENNY: That's all the more reason for the Councilman to stay on the
Board next--year so he can pick up these things for us.

RESOLVED that the Town Board of the Town of Southold hereby amends their
Resolution. No. 17, adopted this date, April 7, 1987, accepting the $100,000. 00
performance bond from Greenport Development Corp. for the bluff plantings for
the condominium proposal to be known as "The Breakers at Lands' End", located
at Greenport, New York to add the following: "Provided the bonding company,
The North River Insurance Company, Nutley, New Jersey, is authorized to do
business in the State of New York.

SUPERVISOR MURPHY: I would just like to comment, Jean, on the trees. I think
it's very' important that we fix' real serious defects in' the highway. . . .
COUNCILWOMAN COCHRAN: I have no problem with that point.
SUPERVISOR MURPHY: The one in'Mattituck, in' particular, was terrible.
COUNCILWOMAN COCHRAN: Yes, it 'was, and I am well aware that the safety of
the people in' relation to the highways is 'number one*,, and- because you' can always
replant trees, you can't bring someone back to life, but I think in' fairness to the
community when .they are told that a certain' number of trees are going to go down
and then it 'becomes more barren, I dust think that it 'behooves us as Town officials
to 'put on notice the .people in' the area of Sound Avenue so they can.-go and check
the plan and understand so 'that when the final plan comes down they have the
opportunity to see and address it.
SUPERVISOR MURPHY: . The State does do this 'on all projects.
COUNCILWOMAN COCHRAN: I know they do.
SUPERVISOR MURPHY: I agree with you, most of the time people don't take the time.
COUNCILWOMAN COCHRAN: Don't take the time until 'after the fact, and they you
can't rectify it.
SUPERVISOR MURPHY: Those"' own in' Laurel did: The people on. the Main Road
who were affected, I know did go into our Chamber building.
COUNCILWOMAN COCHRAN: My point being that when something like this 'comes along
it wouldn't hurt..us, as Town officials, to give a second notification to the neighbors.
letting them know what the situation is 'and then they have the responsibility, Frank.
