Edwards, Councilman Paul Stoutenburgh, Councilman James A. Schondebare, Councilwoman Jean W. Cochran, Councilman-George L. Penny IV',. Town Clerk 'Judith T. Terry. Absent: Town Attorney Robert W. Tasker. 9:09 A.M. - Master Plan Review. Councilman Schondebare absent. Justice Edwards present fors-three issues. . 10;05' A.M. - Historian Antonia Booth met with the. Board to discuss two forthcoming celebrations: the. Bicentennial' of the Constitution, proposed for September 17, 19871 and the '350th Anniversary of the founding of the Town of Southold (1'990) . At the April 7th work session Mrs. Booth wilF present a list of names fora committee designed to serve both 'functiohs; naming a committee will serve to qualify Southold as a designatec Bicentennial. Community. . Both Federal and State committees for the Constitution are moving very slowly and 'Suffolk. County's .committee was just designated last week. A stumbling block for Southold's. plan to celebrate Constitution Day on September 17th is'the fact that most, if 'not all, local schools plan to be in' session on that Thursday. 10:10 'A.-M. --- Landmark Preservation Commission members John Stack, Chairman, Ralph , Williams, and Joseph Townsend, Jr. , along with Historian Antonia Booth, appeared before the Board to discuss the proposed amendments to the current Landmark Law. Mr. Townsend led the discussion, stating the proposal has been reviewed and changed by the Code Committee. The law will' be submitted to Town Attorney Tasker for drafting as a Local Law. Mr. Stack advised the Board they are aiming to have 350 landmarks designated by Southold's .350th year; approximately 35 have been designat so far. The second part of the survey will' be completed by June and more designations will' be forthcoming. . They are planning to scan-out "Constitution Houses for the Sept- . ember celebration. It was agreed that the Landmark Commission would send notices to all designees and proposed designess of the proposed amended law prior to a public hearing. 10:30 A.M. - Joseph Townsend, Jr. . brought the Board up to date on the plans for the Village Green, corner of Route 25 'and Youngs Avenue, Southold. It is 'planned to keep the property as open as possible, with perhaps the construction of a gazebo or band stand toward the rear of the property. He anticipates a final plan for review this coming Friday. 10:35 A.M. - Ted Rosenberg and David Rosenberg, owners of the Old Mill' Inn, Mattituck, met with the Board to discuss an easement on West Mill' Road to .install a sewer line to cesspools to be placed across the street from the property by direction of the. Suffolk County Department of Health. They were advised the will' need a High- way Excavation Permit; perhaps a permit 'from the Town. Trustees, DEC, and Corps of Army Engineers permits, Cesspool Construction and.Operatioh Permits, and should consult with Town Attorney Tasker relative to the proposed easement. They have applied to the DEC, and will' be meeting with the Trustees this 'coming Thursday. 10. 45 A.M. - For Discussion Items: (1) Proposed Soil Removal Permit 'for Brewer Yacht Yard at Greenport, Inc. (resolution no. 23) . (2) Proposed policy- relative to authorization of Bond Anticipation Notes. (resolution no. 24) . (3) Proposed Local Law to establish a Landmark Preservation Commission and prescribe its duties, - refer to Town Attorney Tasker to draft a Local Law. (4) Letter from Secretary of State, Gail 'S. Shaffer, announcing the designation of 103 Significant Coastal Fish and Wild- life Habitats in.' Nassau and Suffolk Counties, including 18 habitats in' the Town. of Southold. .(5) Proposed Local Law for the regulation and control of alarm systems in: the Town of Southold - Chief Winters met with the Board at 11 :20 A.M. to discuss this and the proposed law is being referred to Town Attorney Tasker to draft a Local Law. (6) Letter from Troy Gustayson, The Suffolk Times, . to Bobra Wetmore, President of the Greenport-Southold Chamber of Commerce, asking the chamber to reconsider their'policy ofirefusing to distrubte copies of The Suffolk Times/News-Review Is North Fork Vacation Guide at the tourist information booths in' Greenport and Laurel because it contains advertisements from non-chamber members. Board determined Mr. Gustayson MARCH 24, 1987 41 has a brochure that promotes his business, and the matter should. be resolved between he and the chamber. . (7) Letter from Garrett A. Strang, Architect, maintaining that a maintenance cost at the Dog Pound in'the amount of $26. 00 is 'not a construction- related item. Board agreed to pay the bill. '(81 Applications of Newbridge Plants, Inc. for two trailer permits at 6900 Wickham Avenue, Mattituck, for use as an office and office/employee break area. Applicant Richard T. Girards will be requested to meet with the Board at their'April 7th Work Session. : '(9) East End Institute seeking financial' assistance for a new project called Make-A Fried, which matches people with developmental disabilities with typical persons to promote friendships. They will' be requested to prepare a budget for submission to the Town Board before September 1st in: time for possible 1988 budget consideration. ` (10)' Letter from James F. Kelley, Director, NYS--DEC, Flood Protection Bureau, stating they have conducted a field inspection of the shoreline of Long Island Sound between Duck Pond Point and Hortons Point, Southold, and his 'staff is' 'currently developing .a Reconnaissance Report which will' contain' recommendations for future action, and a draft copy will be furnished to the Board for. review. If further study is *recommended, ' funds will' be requested in! their .1988-89 budget request to engage the services of a 'qualified consultant. The Town would be required . to fund 300 of the study costs. Councilman Stoutenburgh wanted to know if 'the Town wants to commit ;the funds. Councilman Penny said' this should be discussed when the draft is received as the total cost is 'unknown at this ' time. (11) Report from Councilman Penny on his 'attendance at the Waste Distillation Technology, Inc. demonstration at Upland, California; on March 10,' '1987. He said' it is 'an excellent operating facility, burning clean emissions. He would like to invite Prudential -Bache and Turner International Industries, Inc. to meet with the Board. (12) Letter from Sol Wachtler, .Chairman of the NYS Commission on the Bicentennial of the United States Constitution relative to a Community Designation Program, which was discussed with Historian Antonia'Booth at 10:05. A.M. during this 'Work Session. (13) Letter from Christopher Smith .of the Cooperative Extension, Marine Extension Program, to Community Development Administrator Jim' McMahon, 'concerning. Experimental Culture of The Blue Mussell in' Conjunction with a Fish Trap Operation in.' the Town of Southold. Mr. ' Smith thinks the.funding. could be. handled by Cooperative Extension on a cost reimburse basis 'not to exceed the fi'gure of '$3,500.* Mr. McMahon discussed this *with the Board later in' the day and advised the money is 'available in'the Community Development budget. Board agreed to the project.. � (14) Application of William Grigonis for the vacancy on the Board of Ethics, (only applicant) . ' Councilman Schondebare objected to the appointment of Mr. Grigonis; Democratic'Committ-ee Leader of the Town of Southold, as he would oppose the appointment of John Nickles, the Republican Leader. Councilman Stoutenburgh feels Mr. Grigonis *is 'well qualified, being' a member of the Farmland Committee, and having served as a member-of the Southold School Board. The decision on the appointment wily be held until the April 7th meeting to give suffici'eni time for additional applicants. (15)' Receipt of the report of Planner David Emilita. with respect to the petition of Calabrese and Pugliese for -a change of zone. The report. recommends a significant declaration. The Board will' request Mr. Emilita to. prepare. the declaration. (16) Receipt of the report of Planner David Emilita with respect to the petition of Herbert Mandel for a change of zone. The report recommends a negative declaration. Board,.will' request Mr. Emilita to prepare the declamation. (17) Receipt of Suffolk County Civil Service Certification for Senior Account Clerk with the certification of Betty Wells, Account Clerk, appearing thereon (see resolution no. 25 for Mrs. Wells'-appointment) . 12 Noon - Off-Agenda Items: Supervisor Murphy requested the appoint of Jane Rousseau as a Clerk Typist,' 90 day appointment in' his 'office, while they are await= ing the receipt of a Civil Service List (see resolution no. 26) .-- Councilwoman Cochran requested the Board to approve the expenses of Professor Walter Blogoslawski to travel from Milford, Connecticut federal facility..to meet, and evaluate the Plock property. Board agreed.-- Councilman Schondebare suggested .that,the .Board should consider self-insuranc and appoint a committee to study same. Councilman Stoutenburgh said' the Town should call on the State for assistance.—Justice Edwards clarified the Fishers-:A Island proposed water study matter. John Thatcher, President, Fishers Island ' Conservancy, Inc. states his 'group would help with a water study with $10,000 funding, but they do not want REM or H2M. Supervisor Murphy stated Joe Baier will' be meeting with that group on Fishers Island in' the near future to discuss the proposed study.--Justice Edwards stated that in light of the fact the people on Fishers Island will be paying, through taxes, for the Enhanced' 911 system, they would like to have their'' 911 billing paid' by the Town. The $262. 00 cost is 'now being paid' by the F.I. Fire Department. Super- Murphy said he would look into the possibility of that. 911 line, which is 4n'our 516 calling area, being connected to Southold Police Headquarters.--Supervisor Murphy informed the Board that the NYS Assembly has a generic' Landbank Bill'with local options, and it looks like it has a good chance of passing this 'year. The Five Town Supervisors will be sitting down to review it. EXECUTIVE SESSION 12:55 P.M. - The Board discussed the possible purchase of property for Town use. 1 :00 P.M. - Recess for lunch. 42 MARCH 24, 1987 2: 30 P.M. - Work Session reconvened and the Board met with Account-John Cushman - and Community Development Administrator Jim' McMahon relative to amending a prior Town Board resolution concerning advancement of funds. from the General Fund Whole Town Account in' advances not to exceed $15,000 'from any one account (see resolution no. 30) 2:40 P.M'. - Board met with Gary Loesch and Paul Rossett, H?.M, and Tom Martin, Suffolk County Department of Health Services, relative to a memorandum from the DEC concerning possible contami nents in'the. lagoons at the Landfill. Mr. Rossett said'that a number of compounds and volatile organics and pesticides .were found in' the lagoons. .. Mr. Martin'stated that in' 1979 and :1980 'the Health. Department installed groundwater monitoring wells. The last time they were tested was 1980 and :1985'. They can test again' if 'the Board wants them to. Board authorized the tests. 3:05' P.M. - Town Trustee Ellen Larsen met with the -Board to discuss the Thomas W. Cramer wetland application SEQR review fee, and a resolution the Trustees asked the Town Board to adopt on December 17, :1985 stating:.that .the actual.. expense for reviewing the DEIS be paid' to the Town by the applicant prior to the issuance of a building permit.' Mr. Cramer and William Moore, Attorney, have questioned the large amount of the fee and asked for a revision. The NYS-DEC fee requirement, as well as that in' the Town Code of.:...1/2, of 1% was discussed, the Board admitting that the fee charged Mr. Cramer was excessive. They previously reviewed this with Planner David: Emilita who recommends the matter be referred back to the Trustees, the lead agency, for disposition, and the Trustees should meet with Mr. Emilita to discuss same. Mrs. Larsen with schedule a meeting with Mr_. Emilita to discuss the fee structure. 3:20 P.M. - William S. Dempsey, Brightwaters,. New York, met with the Board to offer his 'services in: a position as an independent contractor involved in the implementatio: -of town's management accounting computer system. Mr. Dempsey said the project to computerize' the accounting department would require his 'services for at least a year, and he would require a contractual fee of between $35,000 and $40,000 --Following Mr. Dempsey's appearance .the Board determined they are not ready for this 'type of in-house contractor. 3:40 P.M. Board . reviewed agenda resolutions. 4:00 P.M. - Audit 'of outstanding. vouchers. 4:20 P.-M. - Work Session adjourned. REGULAR MEETING 7:30 P.M. A Regular Meeting of the Southold Town Board was held on Tuesday, March 24, •1987, at the Southold Town Hall, Main Road, Southold, .New York. Supervisor Murphy opened the meeting at 7:30 P.M. with the Pledge of Allegiance to the Flag. Present: Supervisor Francis 'J. Murphy Justice Raymond W. Tasker SUPERVISOR MURPHY: I would like to officially call this 'meeting to order. The first order of business I'd .like a resolution approving the audit of the bills of March 24th, .1987. Moved by Councilwoman Cochran, seconded by Justice Edwards, it was RESOLVED that the following audited bills be and hereby are ordered paid General Fund Whole Town bills in' the amount of $88,825. 10; General Fund Part Town bills in' the amount of $38,395. 16; Fishers Island Ferry District bills in the amount of $12,706.39; Highway Department bills in' the amount of $6,043.77; Southold Scavenger Wastewater. District bills in the amount of $3,511.73. SUPERVISOR MURPHY: At this time I would like to acknowledge and welcome a local Scout Troop who's here,tonight on a project, and I think maybe Councilman Penny would like to introduce the boys. Want to? COUNCILMAN PENNY: I don't know them all by name, but I can introduce them as a unit. It's .Troop 51, representatives of Troop 51 from Greenport, and I think their'' Assistant Scout Master Keith Ward would probably introduce each one of the Scouts and. tell us why we're honored to have their presence here in' the audience this •evening. Keith? KEITH WARD, Assistant Scout Master, Troop 51: One of the requirements of the Communications Merit Badge is that the kids come to a Town Board meeting and find out what goes on at a Town Board meeting and actually take notes and discuss it ` afterwards between ourselves. So we're just here tonight to observe. SUPERVISOR MURPHY: Want to introduce all your boys? KEITH WARD: We still' have others coming. SUPERVISOR MURPHY: Okay. Welcome. What I'd like to explain to you boys is ' that we had a Work Session going on all day. It starts at: 9:00 o'clock in the morning and we didn't finish up until 'almost 5:00 o'clock, and that's where most of the discussior on the resolutions, the fifth item on your agenda, that you'll see tonight. But an awful lot of discussion goes on during the day and that's .when most of the decisions are made. We make it legal at the time when we now pass the resolutions. But, welcome here and you're welcome at any time. And keep up. the good work, Keith. KEITH WARD : Thank you. 1. REPORTS. SUPERVISOR MURPHY: Moving on to the first item on the agenda is 'Reports. I would like to- at this time now ask any Town Board members if they have anything to report, starting on my left- with Judge Edwards. JUSTICE EDWARDS : At this time nothing, Frank, thank you. SUPERVISOR MURPHY: Jean? 44 MARCH 24, 1987 COUNCILWOMAN COCHRAN: Yes, on Thursday the 12th Councilman Stoutenburgh, myself, Jim McMahon met with Chuck Bowman of the Land Use Company in' relation to the Plock property and the Board received the report this `morning and they have agreed to bring Dr. Walter Blogoslawski. to Southold for consulation in relation to the property. On the 16th we had a Buildings and Grounds meeting to discuss the replace- ment of windows and insulation at the Police Headquarters, and also discussion'on the storage building. It was decided to hold on the storage building, but we are proceeding as far as the window replacement. I had contacted Gary Strang. Unfortunately his 'information came in' sometime during the day and I wasn't aware of it, so I'm going to put it 'on the agenda for a discussion for the next meeting. x Also on the 16th I attended the meeting in' relation to the Village GreenwhichAs ' being developed down on the Hartranft corner, and Dick Ward did' presented the proposed plan for the Green. Some additional.'suggestiohs were made and he will', be coming back with a final plan, we hope, for the meeting on the 27th. In addition to that we've been meeting in' relation to the Master Plan Review. On the 18th I had a Landmark Preservation meeting,, and again you've heard some of. their'plansand, they're beginning to plan for the celebrations that are coming in' relation to the Constitution and Southold's .350th Year Celebration. Also 1 had the opportunity to attend a meeting of the committee in' relation to the Cast 'Substance Abuse Committee. I met over at Southold School with representatives from each of the three schools and Peg Katzenberg, the Chairman, and Dr. Helen Price, who will' be serving as chairperson of Substance Abuse Week, and they came up with some absolutely fantastic 'ideas in' relation to Sub- stance Abuse Week when it's held this 'year. Also I attended the Land fill' meeting, of. which Councilman Schondebare will be reporting on. And inbetween I had the opportunit,, to meet with Dr.. Nelson--Mr. Nelson--actually the three principals, Nephew, Nelson and Burns, from the three high schools, in' relation to the Youth Recreation Advisory Board which we are developing. They've been very cooperative and supportive and feel that it's .an excellent opportunity for young people to have the opportunity for input as to activities and services that the Town provides. So I have hopes that within the next month we should begin meeting with that group. Thank you, Frank. SUPERVISOR MURPHY: Thank you, Jean. Paul? COUNCILMAN STOUTENBURGH : As Jean has said' 1 met with her on the Plock property on the 12th, and the 16th we had a Water Advisory meeting in'which we got our first maps from the. County.: Remember what we're trying to do here is Ito get the basic'maps of our Town and then get overlays of where the areas are and things of this sort so that we can find out exactly where perhaps the best water dome, and then go see if 'we can find some funds to purchase these to protect our freshwater areas in' the Town. We are having aerial maps now put on--gathered so that we can actually pinpoint these places on our maps. The Water Advisory Committee -- also met with the Utility Company of Greenport Utility, and hopefully through these two water people they're going to get an understanding of each other's policies, and think that's .a most important thing because the Village of Greenport has, of course, the only so-called city water in our Town and if'we're working on a Water Advisory for the whole Town here, we surely should know what the Village is 'doing, and they are very cooperative and we're working out very well .with them. I again' was with the Landfill Committee, which Jay will report on. We've had a series--and I'm sure Jean sat: in:on many of these—our Master Plan. We've had two and a half days of them, and 1 don't think we'll report anything more, 'but we made very good progress on a lot of loose ends on our Master Plan, and I think we're pretty well set on our ideas of where we should go with our Master Plan. 1 guess that's .about all, Frank. SUPERVISOR MURPHY: Thank you, Paul. Jay? COUNCILMAN SCHONDEBARE: Yes, we did' have a Landfill meetin' .. One of the things we came away with is that we're going to try to separate the tires--vehicle tires--from the rest of the garbage and trash at the Landfill. We're going to have a roll-off and put it 'up where we presently have thel oil deposits for. disposal of tires. For the boys in the audience, what happens is 'if 'you bury a tire in' the Landfill and you bury it way down deep, sooner or later for some reasori- that 1 don't know, but I'm sure physicist will tell you what it -is; the tire always comes back up to the top. And you take the tire and you bury it down there, and you cover it all up again, and within a short period of time the tire is 'going to come back up to the top again. So what happens to you if'You go to any landfills, and we went to Brookhaven one time and saw their:.landfill' and they had these areas nicely covered and you see all these tires all over the place. They all pop. up to the top. So we know we've got a. problem, so we have to separate the tires out from the rest of the trash. So we're going to set up a roll-off and have the people drop their'tires off in an area designated, so we're not going to bury them anymore. We're also probably going to wind up hiring a.superintendent for the Landfill'. We realize' we have a need for basically personnel up there that have more experience then what we presently have, because the situation is 'such that the biggest expense in: this Town basically is going to be our Town Landfill. So as much as it 'behooves us to start talking about garbage all the-time, that's what we do: We start a lot of MARCH- 24, 1987 45 time here talking about garbage and what we're going to do with it.' We have a Code Committee meeting coming up next week and an agenda out on it.* There's no way I don't think we're ever going to get through everything that's in' that Code Committee for next week, but it 'will' be very interesting. There's a lot of topics up there'that I think people will! be interested in' and I would suggest more community participation, or at least awareness of it; because by and large the only ones who show at'the Code Committee meetings are, in. fact, the members of the committee. Thank you, Frank. SUPERVISOR MURPHY Thank you, Jay. George? COUNCILMAN PENNY: Yes, on the loth' I was.. lucky enough to pass through Los Angeles' and I was able to attend a demonstration project on a waste distillation system. Jay just got through talking about garbage. and I'd like you to know that even the islands like the Virgin Islands have the same problem that we do. Where do you put the garbage? There were representatives from the Virgin Islands there and also other representatives from Putnam County, New York. The waste distillation, I feel, is �a viable alternative for our Landfill i n' ll.'990, and the main' reason is because it 'has a uniqu' e way of handling wood, rubber and plastics. A. lot of the other systems that we've talked about we have to bypass these products, but this 'one handles every- thing very nicely. It turns everything into 'charcoal. On the 16th I attended a meet- ing of Buildings and Grounds. On the .16th bgain' a Police Committee meeting, and a Water* Advisory Committee meeting. - On the 17th- a work session on the Master Plan, where we addressed the marine uses. On the 17th the Kenny's -Beach Shoreline Erosion Committee met to discuss some alternatives for what we're going to do to hopefully spruce up Kenny's Beach for the springtime. We've applied' to the County for some dredging spoilage, and I 'Understand the County Dredging Committee met today, so we're just waiting anxiously to see what the results of that meeting is: On the 18th we had a Commerce and Industry Committee,- and amount thethings that we discussed was the Master Plan, home occupations, the Landmark Law, accessory apartments, and the new laws and modifications that are being offered, the North Promotion Committee and also the Water Advisory Committee and their'Water Management Report. On the 19th I attended a meeting of the Landfill' Commi ttee, which Councilman .Scho- ndebare already reported on. And then again'on the 19th and the -20th we had several--I'm sorry, on the .19th we had several sessions on the Master Plan work sessions. On the 19th I attended a public�hearing­not to listen, but to speak, and that was a Coastal Erosion Hazard Act hearing run by the DEC in' Riverhead, and the Coastal Erosion Hazard Act is. a very, very suspicious bill that is 'being presented by the DECat this time, and what it 'says is 'that if 'you have a house that is 'along the shoreline and if 'it's in' a certain' area and it's knocked down by a 'storm or by a flood, that the possibility is 'isAhat the State may be ,telling you that you can't re- build. Well, I found exception to this 'and I found out also. by talking to several legislators that there are amendments that are already in the works on this; so hopefully this bill'will be buried somewhere up in' Albany. - On the 23rd we had a meeting on the Master Plan, and on the 23rd again the Water Ad I vi,sory Committee meeting, and again today on the Master Plan. So it's been pretty busy for the last week or ten days. SUPERVISOR MURPHY: Thank you, George. Paul, you had one more thing? COUNCILMAN STOUTENBURGH: Yes, I neglected to tell the audience that I attended the Farmland Preservation meeting last week, and we've added one more farm to our list. And for you boys in' the audience I think that. you should understand that your Town has a program where they're buying what they call Development Rights. Now, we all know what a farm is; and we know that a lot of our -farms are being taken up by houses, and pretty soon we won't have any more farms, and so the people of the Town voted a large sum of money, millions of dollars, to buy these so-called Farmland Rights. Now what this means is 'that if 'I owned a farm, or i.f 'you owned a farm, we would go in2 and say we'll :buy your development rights, which means you can't ever sell that to a developer, but you can still'-go ahead and farm it.'-: You can't build on it"' but you can farm it.' And seeing you're giving up something, we'll pay You for that, and usually it's about half the value of the land. So you can get a fairly nice chuck of money back, and still keep farming, and we have taken in--how many have we had already? Do you recall, Frank? SUPERVISOR MURPHY: Numbers? COUNCILMAN STOUTENBURGH : Yes, in' farms. SUPERVISOR MURPHY: Fourteen, twelve. COUNCILMAN STOUTENBURGH: Yes, about fourteen farms we've saved, and they'll always be. So when you grow up and your children are your size there'll always be farms they'll be at least able to go around and see. This "is 'the way the Town is trying to preserve some:of their land. And that is 'the Roy Latham farm out in Orient. We've just taken that one in and we're waiting Town Board approval on that. 4 & MARCH 241. 1987 TOWN CLERK. TERRY: The public hearing is'April '7th, the next meeting. COUNCILMAN. STOUTENBURGH: The next meeting. And we are looking at two other ones, and Orville Terry farm in:Oriebt, and also a Jim Cross farm in Mattituck. So your. Farmland Preservation Committee is very active. SUPERVISOR. MURPHY: : Thank you, Paul. The only others I would like to add--the Town had a very successful food distribution of'surplus food two weekends ago. 1'd like to publicly thank Reverend Beaven from the Cutchogue. Methodist Church for providing a large group of volunteers, as well as members of the Southold Town government who volunteered their'services--employees of the Town who volunteered to work that day--and -as well as a. few other volunteers that Jim' McMahon on his ' Community Sentencing Program provided. It went off very well and about 1400 people received parcels of food, which was a tremendous help to an awful lot of them. We also had our local Congressman, George Hockbru_eckner, go over to Fishers Island, which is`-for your boys--is 'a part of Southold Town. t s .the extreme east end of New York State, and it's only a couple of mite's off the Connecticut shore, over near New London where the ferry goes in. That school district is getting so small that your group of Scouts is about one third of the school population, and they have a school that provides from all the way from Kindergarten all the way to 12th grade in' high school. So we were trying to work a program to get the service to have some more personnel assigned over there. And lastly is 'a note that was on my desk tonight from our Planner, Diane Schultze, is 'that she sent off our Master Plan maps to the mast r planner._to start the progress again of hopefully by the summer we'll have the Master Plan adopted. The Town Board has agreed not to make any more changes, and we're starting the process. The maps are being sent off tomorrow morning. So that's very good news. II . PUBLIC NOTICES. Moved by Justice Edwards, seconded by Councilwoman Cochran,, it 'was RESOLVED that the Town Board of the Town of Southold hereby authorizes- the Board of Commissioners of the' Fishers Island Ferry District to accept the bid'of Thames Shipyard S Repair'Co. , New London, Connecticut, for drydocking the MV RACE POINT, at the bid price of $6,050.'00, plus $40..00 each for the installation of sacrificial anodes and for the accomplishing of the following supplemental work as may be found necessary at the time of drydocking: 1. Shaft removal and. gauging (per shaft) - $1,250.'00; 2. Renewal of strut bearing (per bearing) $850. 00; 3. Hull Plating renewal - $25. 00 per hour, $..35 per pound. JUSTICE EDWARDS : I'll make a little explanation on this.' All of the steel vessels, even some of your newer wooden vessels and fiberglass,. will have what we call zinc anodes on the shafts--on the propeller shafts, because there's a lot of electrolysis in the water between the dissimilar metals and electrical circuits that are in' the water that shouldn't be there, and rather than have a propeller, or a rudder, or a shaft disintegrate with this electrolysis. the zinc will go first because it's a soft metal, so, every time they haul it 'out they replace the zincs on the shaft. Now, when they pull the Motor Vessel Race Point out--she's only a couple of years old--but they pull the shafts out of it 'to make sure the shafts are straight. If'they hit 'a lobster pot bouy sometimes it 'will throw it off, and if it is 'thrown off and they don't correct it; then it 'can cause some serious damage inside the hull, and the last item here, hull plating renewal, if when they get the boat hauled out they see there's some bad spots in' there that they have to cut the steel out and replace, they have a price' -on there of $25. 00 per hour for cutting it 'out, replacing and grinding, and $. 35 a pound for the steel that they have to put in' there. Chapter 76 of the Code of the Town of Southold is 'hereby amended by adding a new article thereto, to be Article 11, to read as "follows: Article 11 Sewer, Rents Section 76-20-. Purpose- Pursuant to the provisions of Article 14-F of the General Municipal Law, the Town Board, acting for and on behalf of the Fishers Island Sewer District (FISD) does hereby establish a scale of annual charges to be called "sewer rents" for the use of the sewer system within' the FISD. Section 76-21. Sewer Rents. _ - In addition to any and all other fees and charges provided by law, the owner of a parcel of land served by the sanitary sewer system of the FISD shall pay an annual sewer rent for the use of such sanitary sewer system, which shall be based upon an annual charge of one hundred fifty ($150. ) Dollars for each separate dwelling unit 'served by the system. Such- annual . sewer rents shall be paid in' semi-annual installments of seventy-five ($75. ) Dollars on the first days of January and June of each vPar. MARCH 24, 1987 V 55 If such sewer rents are not paid'within'.30 days of the due date, a penalty of 5% shall be paid: Section 76-22. Liens Sewer rents shall constitute a lien upon the real property served by the sewer system or such part or parts thereof for which sewer rents shall have been established or imposed. The lien shall be prior and superior to every other lawful charge imposed by or for the state or a political subdivision or district thereof. Section 76-23. Actions to Collect Rents The Town :Board, on behalf of the sewer district., may bring and main- tain an action (a) as- upon contract for sewer rents in' arrears, including penalties and interest, or (b) to foreclose liens for such sewer rents. As an alternative to the maintenance of any such action,. the Town Board may annually cause a statement to be prepared setting forth the amount of each lien for sewer rents in' arrears, the real property affected thereby and the name of the person in' whose name such real property is 'assessed. Such statement shall be presented to the board or body empowered to. levy town taxes, on or before a date to be specified by such board or body. Such . board or body shall levy the amounts contained in"such statement against the real property liable at the same time and in' the same manner as town taxes, and such amounts shall be set forth in' a separate column in' the annual tax rolls. The amounts so levied. shall be collected and enforced in' the same manner and at the same time as may be provided by law for the collection and enforcement of town taxes. Section 76-24. Sewer Rent Fund Revenues derived from sewer rents, including penalties and interest, shall be credited to a special fund, to be known as the "sewer rent fund". Moneys in' such -fund shall be used in'the following order: 1. For the payment of the costs of operation, maintenance and repair' of the sewer system or such part or parts thereof for which sewer rents -have . been established and imposed. 2. For the payment of the interest on and amortization of, or payment of, indebtedness which has been or shall be incurred for the construction of the sewer system or such part or parts thereof for which sewer rents have been established and imposed (other than indebtedness, and the interest thereon, which is 'to be paid' in' the first instance from assessments upon benefited real property) . .3. For the, construction of sewage .treatment and disposal works with -necessary appurtenances, including pumping stations, or for the extension, enlargement or replacement of, or additions to, such sewer systems, or part or parts thereof. Such revenues from sewer rents shall not be used (1) to finance the cost of any extension of any part of a sewer system (other than any sewage treatment and disposal works with necessary appurtenances, including. pump- ing stations) to serve unsewered areas if 'such part has been constructed wholly or partly at the expense of real property especially benefited, or. (2) for the payment of the interest on, and the amortization of, indebtedness which is 'to be paid'in' the first instance from assessments upon benefited real property. 11. It's .curious, 1 think, that the Town Board maybe should look into this: When I was at this 'public'hearing in' Riverhead, which as I stated earlier was the first public 'hearing that I've ever attended 'outside my functions here as Town Board member in: the Town of Southold. it was rather curious the way that it's handled. The Chair recognizes the people from the audience and responds to questions from the public=-gives them direct answers, tells. them when they're in' line and when they're out of line with their 'comments, and it's a much more workable program, and I feel that in the public hearings that I've attended here that have been run by the Town of Southold, this 'hasn't been done and I see a certain sense of frustration with the people in' the audience. I've been told that our meetings are just for the public'to give us information. Well, that's not the way this one was run and I'd like to look into this a little bit further, because it 'was an entirely different way of looking at things and maybe it's the way that the audience can get a better sense of participation with our Town Board. It is 'monitored very carefully by the moderator or by the Chair: Questions- are referred to members of the panel, and they answer them if'they can, and if 'not--and all of this 'goes into the public'record. It may take a little more time, but I feel it's .a lot closer working relationship' with the audience and I feel that I'd like the policy committee to look into this 'and find out if'this 'is ' consistent with the way other towns run their meetings. 56 MARCH 24, 1987 SUPERVISOR MURPHY: I'd suggest that you talk to the Town Attorney. JUSTICE EDWARDS : I just want to make one comment, Frank, to. go on record. i presented you with an envelope today regarding' the 911 charges that the Fishers Island Fire Department are incurring with their.'911 system, and that inasmuch as the taxpayers of Fishers Island are paying for the Enhanced-911 in' the Town of Southold, it's only right that somehow Southold should make amends and pay for the 911 at Fishers Island, and Supervisor Murphy is 'going to look into this 'and possibly the: 911 from Fishers Island can come into Southold PD at no cost to the individual districts, but only on the taxpayer basis.' Sometimes you'd have to be somewhat patient with me, and I hope that.continues because we were encouraged by the three "yes" votes that we had today, and we hope that by the time the public'hearing "is 'held that we'll be able to advance the information that some people need in' reference to voting, and that will be done at the public hearing that you call. 1 also would like to make a suggestion to the Board. 1 think that the Town ought to make a study in' reference to what the cost is 'between having an in=house counsel and paying legal fees the way you do at the present time, and I think if'You were to come to the conclusion that having in-house .counsel would. not cost you more, or possibly even less. then it 'does at the way you operate now, that we then wouldn't have to worry about decisions being made on the basis 'of whether something is going to go to court or not. Because if'you had an in=house counsel at that point you have. the representation, you don't have to pay additional money for a lawyer, and I think it 'would be a worthwhile thing to look into and see what the difference would be. COUNCILWOMAN COCHRAN: It's well noted, Ed. Thank you. JUSTICE EDWARDS : I'd like to make a comment, Frank. I think in� regards to more information at the public hearing, I would like to have that information before the public hearing so I could digest it. MR. SIEGMANN- if we have it before--see we're in' a find with having to wait for the engineering company that's working for us to give us the information.. If we have the information prior to the meeting we would be willing to do that. if we don't have it=-in fact we called him' today and asked him to please get to -work faster then what they are in' reference to the information that we need. SUPERVISOR MURPHY: Thank you, _Ed. In the middle? Ruth? RUTH OLIVA: Back to the Master Plan. We would agree with Councilman Cochran--- COUNCILMAN SCHONDEBARE: Who's "we"7 RUTH OLIVA: I'm sorry. Ruth Oliva, North Fork Environmental Council.' We would agree with Councilwoman Cochran that the revisions to the Master Plan have been handled in' an unethical manner. Certain' people have been invited in, or heard by word-of-mouth, to express their'specific'concerns without benefit of a public. hearing whereby all sides of an issue can be represented. This 'is not good government. Most of the basicissues have not even been discussed. Specifically, the goals and objectives of a comprehensive master plan are inconsistent with the zoning implementation map. This 'plan is; for the most part, a legalization of what is 'already there. Would it 'not be better to take a step back in"order to evaluate our environmental constraints first, and then devise our Master Plan around these findings, as was done in' Medford, New Jersey's Master Plan. The timeframe in'order to accomplish. this :would not be extra- ordinary. Most of the studies are already in' existence. Southold would then have a Master Plan that would ensure the qualify of life that we all enjoy. Thank you. COUNCILMAN STOUTENBURGH: Ruth, I'd like to comment on that. 1 would be glad to go along with that if'I could get any additional votes. SUPERVISOR MURPHY: I'd be glad to go along with it 'too if"we had any land to worry about at_the time when that was finished.
