SOUTHOLD TOWN BOARD

WORK SESSION
Present: Supervisor Franci-s 'J. Murphy, Justice Raymond W. Edwards, Councilman

9: 15 A.M. - Receiver of-Taxes Geor a Mellas met with the Board to discuss the
possible purchase of new Olivetti multi-functional computers for receipting and
recording keeping for his loffi.ce. The present machines are fourteen years old
have. become obsolete and service is 'subject to the availability of parts. Mr. Mellas
will visit 'the Town of Babylon where the new system is 'iri' use, and request the
Olivetti salesperson to meeting with the Board in' the near' future.
9:25: A.M. - Board of Assessors Chairman Charles Watts met with the Board to
discuss a letter received from Greenport Village Attorney John J. Munzel advising
that the Village is seriously considering terminating its assessing functions and
delegating them to the Town (for discussion item 6) . Mr. Watts said the Board
of Assessors does not object to the Village using the Town's .assessment roll, but
they do 'not wish to defend or get involved in' the Village Grievance Day.
9: 35 A.M. - For Discussion Items: (1) Proposal of Holzrriacher, McLendon E Murrell,
P.C. to perform observation and inspection services with respect to the construction
of the Scale installation at the Cutchogue Landfill' at a fee of $3,500. Supervisor
recommends the Town use Inspector Jack Davis and will speak to him' about perform-
ing these services. (2) Expiration of term of Gerard Goehringer, member of the
Board of Appeals, on April 30, 1986. Board in' agreement to reappoint (see resolution
no: 21) . (3) Expiration of term of Kenneth. Edwards, member of the Planning Hoard,
on April 30, 1986. Board in'agreement to reappoint (s'ee resolution no. 22) . (4)
Letter from William S. Dempsey offering his services as an independent contractor
to implement a Town* management accounting computer system. He will be invited
to meet with the Board on March 24th. (5) Letter from Town of Brookhaven relative
to their Solid Waste Management Plan and Draft GEIS Scoping meeting. Planner Dave
Emilita will- be requested to review-. (6) Letter from Greenport Village Attorney
John Munzel advising the Village is 'seriously considering terminating its' assessing
functions and delegating to the Town. Per: Assessor Chairman Watts (see 9:25
A.M.) the Assessors have no objection to Village using the Town's .roll, but do not
wish to defend or become involved in' their 'Grievance Day. (7) Proposed resolution
-to promote Account Clerk Betty Wells to Senior Account Clerk. Accountant John
Cushman will be consulted to determine whether there has been a reassignment of
duties in' the Accounting. Department since Mrs. Wells' desk audit 'by Civil Service.
(8) Proposal of E. F. Kaldor, C.P.A'.; P.C. to conduct an orientation of the new
accountant and to bring all records into current status and restructure operating
procedures in' the Accounting Department. Board accepted the proposal - see
resolution no. 23. (9) Request by .tha New York Board of Fire Underwriters to
install a telephone in' the Building Department for their'electrical inspector serving
Southold Town.. Board agreed - see resolution no. 24. (10) Letter from the Board
of Town Trustees for the Town Board to adopt a resolution rescinding their'Decembe
17, 1985 resolution concerning a DEIS review. of the application of Thomas W. Cramer
for a wetland permit.: Board will' meet with the Trustees at the March 24th work
session. (11) Correspondence from County Executive LoGrande requesting the Town
Board to adopt memorializing resolutions relative to affordable housing to be trans-
mtted to the State Legislature (see resolutions 25, 26, 27,. 28) .
10:00 A.M. - Youth Services Director James McMahon appeared before the Board to
present the '1986 Community Service Program which handled 19 participants during
the year.
EXECUTIVE SESSION
10:05 A.M. - The Board met with Valerie Scopaz,' applicant for town planning
position to negotiate a contract for her services. It was concluded that M.s.
Scopaz would transfer to the Town as a civil service employee, Senior Planner,
the position she:currently .holds with the Town of Smithtown.

10: 30 A.M. - The Board met with Insurance Agent William Price,. Jr.,B'Gene Jennings,
Tim O'Malley, and Jim Graziono of Utica Mutual Insurance Company concerning an
insurance premium due Utica, in"the amount of $16,949, based upon audits for the
years '1983, 1984, :1985'. Although Utica. claims they did* not conduct an audit 'during
this three year period, the Supervisor has a record of stating an audit 'was conducted
after the first year and no additional premium was due. The Utica representatives
stated they would be willing to reach a compromise, agreeing to accept $10,000. They
will' submit 'a revised statement agreeing to the $10,000 to Town Attorney Tasker for
review.
10:30 A.M. - -Dr. Stanford J. Searl, Jr. , Executive Director, East End Community
Services, Inc. , met with the. Board to discuss the 1986 annual report of his health
care faciliiy, and to make an appeal to the Board for $15,000 in' funding for the
facility's .second year to develop a nursing program, strengthen their 'case manage-
ment, develop financial assistance capacity. and meet increased demand for services.
Dr. Searle was asked to submit 'his "1986 audit"report for the Board's review, 'and
advised he should contact the Towns of Riverhead and Shelter Island for contributions
since individuals in' those townships avail 'themselves of the services of East End.
11 :50 A.M. - Patrici'a 'C. Moore, attorney with the law office of Edson 8 Biru.er,
and her client Kevin" Knobloch, met with the Board t'egarding Mr. Knobloch's.
nursery operation on Route 48,' Southold. Ms.- Moore read a prepared statement
concerning "the Building Department being asked to enforce an interpretation on
the operation of nursery and landscaping in' Agricultural-Residential zone. Neither
landscaping nor lawn care, as an accessory use of a nursery, are defined in' the
Southold Town Code. The arbitrary definition being given to a nursery operator
with accessory operations are being lumpted together under "contracting". Ms.
Moore stated that Mr. Knoblock has requested the Building Department to put their "
charges against him" in'writing_ so he could address the matter legally, but the
Building Depairtmcent has refused. He said' the problem stems from a complaint
he made against .a neighbor for an oversize' sign. He has two signs on his "property,
both of wick have approved permits. Ms. Moore and Mr. Knobloch were advised
the Town Board is 'not the proper place to address their'"complaint". They should
petition the Board of Appeals for an interpretation of those sections of the Zoning ...
Code which are in:question.
EXECUTIVE SESSION
12:05 P.M. - The Board met with Executive Administrator Lessard concerning pend-
ing litigation.
12:40 P.M. - Recess for lunch.
2: 10 P.M. - Work Session reconvened.
2: 15 P.M. - The Board met with Mario " Fusaro, AI Fusaro and,-Arthur DeRosa to
discuss their"request for a refund of $8,000 in inspection fees for Blue Horizons,
an abandoned subdivision. They advised the Board their 'two previous subdivisions
(1 /2 acre and 1 acre) were abandoned and they now have a filed map with 7 lots
on 55 acres. . .the 7 lots being on Sound frontage and the remaining acres open space.
A February 11 , 1987 letter from the Planning Board, transmitting a chronological list
of events concerning work performed by the Planning Board, Superintendent of High-
ways and Town Engineer from 1973 through 1985, and the Planning Board's recommenda-
tion of denial was reviewed. Initially the Board did" not favor any refund of the $8,000,
but in' considering the amount of open space now appearing on the filed map, they
advised the applicants they would review the matter further and discuss it "with the
Planni ngi,Board. again'.
3: 10 P.M. - Greenport Village Trustee Gail Horton and Village Community Development
Director.Bill Gillooly, met with the Board to discussed the proposed baymen's dock to
be constructed at Sterling Creek. The Village expects to receive $20,000 in* Water
Revitalization funds which they will contribute toward the project. They ask that
the Town contribute $2,500, and they will share in-kind services for a total project
cost of $34,500." The Board is in" complete agreement with the projects and looks
forward to seeing it accomplished.---Mrs. Horton briefly discussed the Village's
consideration of using the Town's assessment roll and discontinuing their 'own services.
She said it "is 'an option open to them, but she personally has not made a decision.
3:30 P.M. -. Town Board reviewed agenda resolutions.
4:20 P.M. - Frank Bear, Chairman of the Water Advisory Committee, read his report
to the Town Board on the progress of the Water Resources Management Program. His
report stated he has had the full cooperation of the, other members of the committee,
and outlined the background of the committee members. They will' be receiving from
the Suffolk County Planning Commission water information which is 'essential to the
completion of their water management program proposal. They will have water supply

contour overlays which will outline water supply areas at the two foot contour and
above, and also the fresh water interface lines. They .are also awaiting essential
information from the Long Island office of the State Department of Environmental
Conservation. With that alli that data they should then be able to complete their '
project. .
4: 30 P.M. - Board audited outstanding vouchers.
4:45 P.M. - Work Session adjourned.
REGULAR MEETING
7:30 P.M.
A Regular Meeting of the Southold Town Board was held on Tuesday, March
10, 1987 at the Southold Town Hall, Main Road, Southold, New York. Supervisor
Murphy opened the meeting at 7:30 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR MURPHY: . Thank you for coming out on such a cold night, after
such a beautiful weekend. First order of business I'd .like a motion to approve
the audit 'of the bills of March _loth.
Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was
RESOLVED that the following audited bills be and hereby are ordered paid': General
Fund Whole Town bills in the amount of $54,629.74; General Fund Part Town bills
in the amount of $13,809. 13; Highway Department bills in' the amount of $19,492. 01;
Fishers Island. Ferry District bills in the amount of $14,272. 34; Southold -Wastewater
Disposal District bills in the amount of $16,191.54; Elizabeth Airport capital account
bills i n' the amount of $14,738. 44; Waterfront. Revitalization Program bills i n the
.... amount of $2,100.00; Scavenger Waste Plant Construction Grant bills in' the amount
of $1,700. 00.

minutes of February 24, :1987.
Moved by Justice Edwards, seconded by Councilman Schondebare, it 'was
RESOLVED that the minutes of the Regular Meeting of the Southold Town Board
held on February 24, '1987 be and hereby are approved.

_ JUSTICE EDWARDS: . Thank you, Frank. " A week ago Friday I had the opportunity
to go down to the Emergency :Preparedness Center in' Yaphank. I have been. in'
communications with the. gentleman .there for the past_ five years in regards to Mill-'
stone's monthly drills, and I've never met the man and they had an open house and
little meeting there and I was very impressed with the center and what they have
set-up for lodgings in' case of an emergency. The communications they have there
is 'fantastic 'and it was very, very enjoyable morning down there. Other than that,
five days down in: Puerto Rico and back in' this 'cold, I don't know. Thank you,
Frank.
SUPERVISOR MURPHY: That's .tough. to take; Ray. Jean?
COUNCILWOMAN. COCHRAN: Yes, on Thursday, March 26th I met with MaryAnn
Fleishmann to further clarify the role of Youth Services in' the Recreation arena.
Also we discussed the program proposal using Planned Parenthood as a program
resource, and as agreed by the Town Board, Miss Fleishmann will' be making a
Presentation to the. Board in' the near future. Also on Wednesday, March 4th
met with the Code Committee. I apologized to. the Committee for arriving a little
late. Sometimes those things happen, but the- Landmark Preservation was meeting
with the Code Committee to review the Landmark Preservation. Ordinance. I'm sure
Jay will' filly you in on that a little bit more. On Thursday evening I attended the
Hospice Board meetin' . I have been asked to serve on the Advisory. Board and
it's my pleasure to do so. Friday morning I traveled to Smithtown Sheraton with
Frank--Supervisor Murphy, and Jim" McMahon. County Executive LoGrande--oh,
gosh, I don't know what word I'd .want to use, let's see--sharing with many people
from throughout the County, his 'proposed possible County involvement and helping
to provide affordable housing. Then last evening I was a guest speaker on a panel
for the Eastern Long Island Executives andspoke on affordable housin . So it's been
a busy week in relation to affordab a housing. Thank you, Frank.
SUPERVISOR MURPHY: Thanks, Jean. Paul?
COUNCILMAN STOUTENBURGH: On February 26th we had our Water Advisory
meeting which Frank Bear did; a very good job of reviewing, but just to get
the audience to know what we're doing, is we're. getting maps from the Planning
Commission of the County. , These are coming now and there was a little mix'-up
in them, but now we have it 'cleared up. We have our goals and objectives pretty
well squared away, and we're working on bringing our report to the Town Board
in' April. They also sent a letter, or made a resolution to send a letter to the
County and the State asking that they use as little salt as possible on our roads.
We're fearful that this salt wily contaminate our water supply, which I thought was
a very good idea. Since that time we also have met with--the Water Advisory
Committee has met with the Greenport Utilities, and here we're trying--that is
the Water Advisory Committee and the Greenport Utilities, which is :the Greenport
water supply, are trying to become more familiar with each other's roles and their
objectives and goals so that they can be worked into this final report which we're
all waiting for. The next meeting, by the way, is 'on March 16th--of the Water
Advisory Committee. On February 28th I met with the Southold Green Committee,
and that's the group that are working on the laying out of the green opposite the
bank up here, that George Wells gave, and now we have a preliminary lay-out.
That's all be done, sketched out, and we're waiting to get all our people together.
We had too many of them on vacations to follow through on it; but that's already
been set up and at our next meeting we'll start working on that as far as getting
things moving. Also a member of the Code Committee, and we're going to leave
that for Jay to review. On the 4th I was out on Farmland Preservation applications,
trying to get some people to follow through on things they said they would do. And
on, as I say, last night we were at the Utilities in Greenport. That's about it, Frank.

SUPERVISOR MURPHY: Thank you, Paul. Jay?
COUNCILMAN SCHONDEBARE : Thank you, Frank. The Code Committee did meet
on March 2nd and we discussed some of the old business. We had the Landmark
Preservation people in. We went over their proposed law that they gave us. We're
basically putting together the nuts and bolts of the working law. It's all done and
we've completed the work and the review on it.` We made changes and recommenda-
tions. They came back to us a second time and they had the changes and recommenda-
tions incorporated in their report. Basically, Jean, 11m _waiting, I believe for it 'to
typed up into a final form by Chris Hogan, and I'm still wating. Just so you're aw
started going into the question as to whether or not the desig

We got into quite a conversation in the Code Committee as to that issue. Basically
ended the conversation simply by saying that it's .a decision that the Town Board will
have to make, rather than the Code Committee-, and- it-'w-i-F be- re-feared to- the_ Tow-n
Board. We then went over the accessory apartments and bed and breakfast that's
on for a resolution tonight, to make sure .you can only have one in' a single family
home, either a bed and breakfast or an accessory apartment, not both. Jerry
Goehringer is 'getting together some information for us still'with regards to homes
on waterfronts and whether or not the property in' back of their 'house, facing the
water, should be considered their :front yard, as opposed to that part of their'
home which fronts on the street. They consider it:'the rear yard, we consider it
the front yard and we get into trouble. Under new business we discussed the
Architectural Review Code that's been submitted to us. We had a lot of questions
for 'Mr. Orlowski who asked us to consider it.' We requested it 'to go back to him'
and he's going to sit 'down with Mr. Ward, who helped to bring it 'about,- and they're
going to go over it and submit 'another one to us. I'm . still awaiting that. We should
have that on, hopefully, by the next meeting which is 'the first Wednesday of each
month. We then went into the trailer permits which is 'something this 'Town Board
has gotten into many a time, and the conversati'6h§, discussions, the pros and cons,.
and the problems we have with trailers and trailer permits sounded very familiar.
It sounded like we were back at the Town Board arguing the same issues all over
again. That will again be back on again'.the first week in' April for further consider-
ation, because we were not able to resolve it: There are a number of other things
that have been referred to the Code..Committe.e which will likewise be on for new
business. Thank you, Frank.
SUPERVISOR MURPHY: Thank you, Jay. As you could see, the Town Board has
been very busy, and I would just like to add a couple more. One, I did travel
to Albany with the lobbying with our County Executive Michael LoGrande, and also,
as Jean mentioned, the Housing Summit, and 1 would lust like to comment how good
it is to be working with the County Executive who is 'a ex-supervisor. And it
certainly is 'different. It a certainly different aspect on town problems. The
County Executive certainly realizes the many town problems on all of the things
that we discuss here each meeting that we have, and it really is 'very good.
think we're going to see a tremendous difference in' town and county government
cooperation this 'year, and it's only for the better for all the people in the county
and this 'town.
COUNCILMAN STOUTENBURGH : Could I ask one question? Jean, when you met
with MaryAnn, you said. she is going to bring her program-71 thought we were
going to have the---
COUNCILWOMAN COCHRAN : The woman from Planned Parenthood is also coming in:
COUNCILMAN STOUTENBURGH : Oh, okay, fine.
COUNCILWOMAN COCHRAN: It's going to be the two of them. She wanted to review
some of the films and so forth, and then---
COUNCILMAN STOUTENBURGH: But she will be coming in?
COUNCILWOMAN COCHRAN : Oh, yes, definitely, both. They'll both be coming in'
at that time.
11. PUBLIC NOTICES. --
SUPERVISOR MURPHY: Moving on to the second item on the agenda, Public Notices.
These .are all on the Town .Clerk's .Bulletin' Board, by the way.

2. D.E.C. notice of Easing of Coastal Erosion Hazard Area Restrictions

3. This 'is 'one that is more important for the people around here: Public'
Informational Meeting for the project on the replacement of the existing 2-lane
structure carrying Route 25 over Dam Pond Channel, East Marion - 2:00 P.M. to
8:00 P.M. , March 12, 1987, Oysterponds Public'School, Main Road, Orient. Any-
one who's interested in� the plan can sit 'down and review them. That's this 'coming
Thursday.
4. N.Y.S.-D.E.C. notice of complete' applicatioh of Robert Miller to construct
a single. family dwelling and associated sanitary system 70 ft. and a minimum of 100 ft.
respectively from freshwater wetlands on Lot 3 of the minor subdivision .for Robert
Miller, off Main' Road, Fishers Island. Comments by March 20, 1987.
5. N.Y.S. Divi;si'on of Housing and Community Renewal, Notice of proposed rule
making, concerning the Uniform Fire Prevention and Building Code. This is 'one
Victor Lessard has written comments for this hearing. This 'is amending the Building
Code. Most people don't realize*! -the State Code--most people don't realize: some of
the aspects of it.' One of' the proposed changes--I don't think it will' go through--
is 'the enclosing of pools. That access from a house into an area where a pool is
will be eliminated and will' cause many, many problems, and we're making some comments
officially. I know we brought this 'up at the East End Supervisor's meeting and many
towns are making comments on it.' The fencing proposed is 'maximum of 15 ft. from
the pool,7-will be enclosed by fencing. So it will' throw all of these old regulations
that we have--we have very stringent regulations and we were one of the first towns.
Our local ordinance was much more stringent than the State Code and I know like the
Town of Southampton, just catching up to us on making sure all pools are fenced in:
But now the State is 'considering other changes., so we're making some. comments that
we think are important too. So if'anyone--this 'will' be held in' Hauppauge on March
24th from 10:30 A.M. to 12:00 Noon at the State Office Building at Hauppauge.

IV. PUBLIC HEARINGS.
SUPERVISOR MURPHY: There is 'one public'hearing at 8:00 o'clock, which we'll
recess for (application of Brewer Yacht Yard at Greenport for a soil 'removal permit)'.
V. RESOLUTIONS.
SUPERVISOR MURPHY : 1'd like to move on to Resolutions. I'd like to remind anyone
in' the audience at this time if 'they would like to address the Town Board and make
any comments on a proposed resolution this 'is 'the time to do it: After the resolutions
are all done, there will be a period of time for anyone in the audience to address the
Town Board on any other matter. So, is there anyone who would like to address the
Town Board on a proposed Resolution? Left? Middle? Right? (No response. ) Okay,
if not, we'll move on to the first, and it's .the authorization for a police officer to
attend a conference.
COUNCILMAN SCHONDEBARE : Paul, didn't .you say someone was going to come in
and talk to us about a resolution that we have on tonight?
COUNCILMAN STOUTENBURGH : I did' and he didn't show. Perhaps something fell
through, because I spoke to him* personally and he said' he was coming in'. .
COUNCILMAN SCHONDEBARE : That was with regards to the land
right? fill and the scale,
COUNCILMAN STOUTENBURGH : Yes.
1. Moved by Councilman Schondebare, seconded by Councilman Stoutenburgh, it :was
RESOLVED that the Town Board of the Town of Southold hereby authorizes Police .
Officer Dennis Bannon to attend the Annual Governor's Conference on Crime
Prevention being. held at Albany, New York, on April 7, 8,' 9, '1987, and the actual
expenses for travel, meals and lodging shall be a legal charge against the Police
Department '1987 Budget.

SUPERVISOR MURPHY: Number 2 is 'to authorize the Bay Constable, Donald
Dzenkowski, 'to attend a Marine Law Enforcement Training Seminar at Lake Luze'rne.
I offer that resolution.
2. Moved by Supervisor Murphy, seconded by Councilman Stoutenburgh, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes Senior
Bay Constable Donald Dzenkowski to attend the New York State Marine Law Enforce-
ment Training Seminar being held at Lake Luzerne, New York, on May 4, 5, 6, 7,
8, 1987, and the actual expenses for travel, meals and lodging shall be a legal
charge against the Bay Constable 1987 Budget.

York State representatives and urge them to work to restore the reduced program
funds to the :1987 New York State Budget; which reduction will impact our senior

WHEREAS, currently in Suffolk homes sell for a median price of $150,000 and were
generally affordable only to purchasers with annual incomes greater than $45,000, a
WHEREAS, an affordable housing crisis 'currently exists in Suffolk County and in'
New York State's other downstate suburban counties, which could severely impair
Suffolk County's future economic •prosperity, and
WHEREAS, over 7,000 of Suffolk's .elderly are on waiting lists for senior citizen
housing, and
WHEREAS, New York State's downstate suburban counties are desperately in need
of affordable housing and must encourage the development of such housing imme-
diately in:order not to lose their first and last generations of citizens, now, there-
fore, be it - ,
RESOLVED that the Town Board of the Town of Southold hereby memorializes the
New York State Legislature to establish a New York State Suburban Affordable
Housing Bond Issue, and be it 'further

Issue be designated to finance low interest loans to developers for the construction

the very high cost of shelter, and
WHEREAS, New York State's downstate suburban. counties are desperately in' need

WHEREAS, most of Suffolk County and other downstate suburban counties are not
eligible for the broad range of rural housing programs that Upstate counties do
receive, now, therefore, be it

WHEREAS, an affordable housing crisis -currently exists in Suffolk County and
in New York State's other downstate suburban counties, and
WHEREAS, the affordable housing crisis 'could severely impair�Suffolk County's
future economic'prosperity.in' that affordable homes for its own younger generation
and for the growing number of people required to maintain an adequate local pool
=-- f_q_ualified labor are no longer available, and
WHEREAS, the differential created between shelter costs on Long Island and certain
fast-growing sunbelt areas is 'as much as 50 percent, and

WHEREAS, because of the lack of affordable housing many of Suffolk's major employers
are relocating and/or expanding in other parts of the nation, and
WHEREAS, Section 18A of New York State's General Municipal Law limits the use of
proceeds from Industrial' Development Authority (IDA) Bonds to economically related
activities, and
WHEREAS, an adequate supply of affordable homes isessential if the area's economy
is to remain vibrant, now, therefore, be it '
RESOLVED that the Town Board of the Town of Southold hereby memorializes the
New York State Legislature to amend Section 18A of the New York State's General
Municipal Law so that housing related activities are defined as economically related,
thus allowing the proceeds of IDA bonds to also be used for housing related, activ=
ities, and, be it further
RESOLVED that copies of this resolution be forwarded to the Majority and Mlnority
Leads of the New York State Senate and the New York State Assembly, together
with members of the Long Island Delegation to the New York State Senate and the
New York State Assembly.

A Local Law to establish Sewer Rents
in the Fishers Island Sewer District
BE IT .ENACTED by the Town Board 'of the Town of Southold as follows:
1. Chapter 76 of the Code of the Town of Southold is 'hereby amended by adding
<..•:,.F . a new article thereto, to be Article 11, to read as follows:
Article II
Sewer, Rents
Section 76-20.. Purpose
Pursuant to the provisions of Article 14-F of the General Municipal 'Law,
the Town. Board, acting for and on behalf of the Fishers Island Sewer District
(FISD) does hereby establish a scale of annual charges to be called "sewer
rents" for the use of the sewer system within' the FISD.
Section 76.21. Sewer Rents
In' addition to any and all other fees and charges provided by law, the
owner of a parcel of land served by the sanitary sewer system of the FISD
shall pay an annual sewer rent for the use of such sanitary sewer system,
which shall be based upon an annual charge of one hundred fifty. ($150.)
Dollars for each separate dwelling unit 'served by the system. Such annual
sewer. rents shall be paid' in' semi-annual installments of seventy-five ($75.)
dollars on the first days of January and June of each year. -
If'such sewer rents are not paid within' 30 days of the due date, a penalty
of 5% shall be-paid*

Section 76-22.'. . Liens
Sewer rents shall constitute a lien upon the real property served by the
sewer system or such part or parts thereof for which sewer rents shall have
been established or imposed. The lien shall be prior and superior to every
other lien or claim except the lien of an existing :tax, assessment or other
lawful charge imposed by or for the state or a political subdivision or district
thereof.
Section 76-23. Actions to Collect Rents
The Town Board, on, behalf of the sewer district, may bring and maintain'
an action (a) as upon contract for sewer rents in' arrears, including penalties
and interest, or (b) to foreclose liens for such sewer rents. As an alternative
to the maintenance of any such action, the Town Board may annually cause a
statement to be prepared setting forth the amount of each lien for sewer
rents in' arrears, the real property affected thereby and the name of the
person in' whose name such real property is 'assessed. Such statement shall
be presented to the board or body empowered to levy town taxes, on or
before a date to be specified by such board or body. Such board or body
shall levy the amounts contained in' such statement against the real property
liable at the same time and in' the same manner as town taxes, and such
amounts shall be set forth in' a separate column in* the annual tax rolls.
The amounts so levied shall be collected and enforced in' the same manner
and at the same time as may be provided by law for the collection and
enforcement of town taxes.
Section 76-24. Sewer Rent Fund
Revenues derived from sewer rents, including penalties and interest,
shall be credited to a special fund, to be known as the "sewer rent fund".
Moneys in' such fund shall be used in' the following order:
I. For the payment of the cost of operation, maintenance and repair'
of the sewer system or such part or parts thereof for which sewer rents
have been established and imposed.
2. For the payment of the interest on and amortization of, or payment
of, indebtedness which has been or shall be incurred for the construction of
the sewer system or such part or parts thereof for which sewer rents have
been established and imposed (other than indebtedness, and the interest
thereon, which -is to be paid in: the first instance from assessments upon
benefited real property) .
3. For the construction of sewage treatment and disposal works ,with
necessary appurtenances, including pumping stations, or for the extension,
enlargement or replacement of, or additions to, such sewer systems, or part
or parts. thereof.
Such revenues from sewer rents shall not be used (1) to finance the cost of
any extension of any part of a sewer system (other than any sewage treat-
ment and disposal works with necessary appurtenances, .including pumping
stations) to serve unsewered areas if'such part has been constructed wholly
or partly at the expense of real property especially benefited, or (2) for the

payment of the interest on, and the amortization of, indebtedness which is to
be paid in' the first instance from assessments upon benefited real property.
If. This Local Law shall take effect upon its filing with the Secretary of State.

SUPERVISOR MURPHY: Our former Supervisor, Mr. William Pell. Welcome..
WILLIAM R. PELL Ill; Thank you, Frank, . Town Board, Town Clerk, Counsel.
Something got me upset many years ago and .it 'stilFdoes. Our Landfill. Yesterday
was coming home from Hampton Bays and on Route 105', Riverhead By-Pass I call
it; and I came behind a pick-up truck loaded with house timber, plaster board.
wanted to pass it; but it was about 4:00 o'clock and a lot of traffic'on the road.
It was going down the road very slow, but it 'was heavy. It was a regular pick-up
truck, sides built up, tied down across the top. We come up to the light on the
Main Road, I said'. "I wonder where he's .going now?" So I got curious and I followed
him. through Riverhead Township; down to .the Southold Town line, followed him' right
down to our Landfill. I passed him just before he went into the Landfill. I pulled-
into the Landfill and told the man at the gate and said; "I followed that truck from
Southampton Township; through Riverhead down to ours. What right does he have
to dump that lumber here?" He said'. '.'He hasn't. " I said, "Good, don't let him'.
f you need me I wi If go to court for you. " I left there and called Frank last night
at home. It turned out he dumped it :there. Paid' his little fee and dumped it.
Landfills are: a problem in'all of our State, and especially here on Long Island.
Four years ago when I sat up there we tried to create the building, through counsel
have laws to regulate it: And I sat where you sit; Frank, and thought, "Well, by
God we got this 'under control. " Somehowi we have to improve on what we had in
the past. It's .something that I think--I wish the proper people, the Town Board,
Landfill Committee, Counsel get involved again' in' trying to tighten these reins up.
We residents of Southold Town are paying for that up there. Let it 'be used by
the people of Southold Town, not abused by others. Thank you.
SUPERVISOR MURPHY: Mr. Pell, thank you. We're very much aware and unfortunately
it's a very major problem. The Town did generate 50� of income for this 'large load
of out-of-town debris:
TOWN CLERK TERRY: Which was the incorrect fee.
SUPERVISOR MURPHY: A pick-up truck.
TOWN CLERK TERRY: A pick-up truck, single axle, commerciaf, is $15. 00, and
they charged the wrong fee at 504. We had another case today.
MR. PELL: I would just like to add one more thing. In Hampton Bays we had to
pull down a wall and a building, and we have a garbage man that comes and picks
it 'up. To get rid'of one container, twice the size' of those tables there, in the
landfill; $174. 00 that I'm paying. They can go in' the landfill in'our town for 50�.

' MR. PELL: Southampton Town. Our garbage man picks it 'up. He comes and he
takes the regular debris every two days he comes. Well we took a wall out of the
place, to get rid of the timber $174. 00.
SUPERVISOR MURPHY: Thank you, Bill: We're trying to address it 'and it's a very
hard problem.
COUNCILMAN STOUTENBURGH : I think you should go 'further then that, Frank.
thinkf_.you should tell him what we're going to do. We're going to have somebody
up there. We're going to hire someone finally to run that Landfill. The way it 'is
now we do not have a head-honcho, so to speak, and I think this 'is 'where many of
our problems are falling apart, because we need somebody we can say to, "What's
going on here? Why is this happening? How come you let: it.'happen?" Until 'we
have that person, and we are acting on that. I think we have a meeting coming
up. Jay is 'Chairm4an of it.', As soon as Ray Jacobs is 'on his 'feet we'll be on it.
MR. PELL: . Thank you.:
COUNCILWOMAN COCHRAN: Plus some training for the guards at the gate.
SUPERVISOR MURPHY: And for the Landfill employees. And 1 might add that
$175. 00 container that you're talking about in' Southampton Town, if 'you were in
the Town of Islip it would probably be $350. 00 for that same container. Any other
comments to the Town Board? Yes, ma'am?
JENNIFER COMBS: I just have a question. The guys in the booth up there at
the dump, do they get paid?
SUPERVISOR MURPHY: Yes. Does Carter have pills? Nobody works for nothing
anymore. Yes, they're paid on a $5.50 per hour rate, with no benefits. So it's
not a very high paying job. Any other comments?
COUNCILMAN SCHONDEBARE: Are you the new Traffic'Warden, Jennifer Combs?
JENNIFER COMBS: Yes.
COUNCILMAN SCHONDEBARE : Oh, I didn't 'recognize that. Our Town Clerk, as
usual, picked it up.
SUPERVISOR MURPHY: Welcome, Jennifer. Do a good job thissummer. I'm sure
