EXECUTIVE SESSION

9:15 A.M. - The. .Board met in' Executive.Session with Special' Attorney Richard L.
Lark and Executive Administrator Victor G. Lessard to discuss Building Department
pending litigation. Following this 'discussion personnel matters were discussed with
Mr. Lessard.
WORK SESSION
10:'00' 'A.M. - The Board met with Glenn Moller, Director,of The. North Fork Early- Learn
-
ing--:Center;•:Mattituck1 and his;head .teadher. The Center has been in•operation since
May '11982, -and. they are currently researching areas of funding to continue-its operation.
Community Development Administrator James McMahon, also present, advised the. Board
that this `is .an eligible Community Development Fund expense. Mr. Moller .requested
$18,'000. in:'support from the Town so the Center may continue to•.operate. ,Along with
tuition, foundation 'support and corporate support they will' be able to operate full-.time
to serve the needs of the community. Letters of support have been received from The
North. Fork. Bank 8. Trust Company, Eastern Long Island Hospital, North Fork Housing
Alliance, Inc. , Community Action of Southold Town and members of the community who
use the center for their children while they are at work. The Board agreed to submit
a igrant application to HUD for Town funding 'support of the Center (see resolution no.
.45)'.
10:25 A.M. - For Discussion Items : (1) Reappointment of John Stack and Joseph L.
Townsend,. Jr. as members of 'the Landmark Preservation Commission (see resolution
no. 37) . (2) North Fork Early Learn Center (see 10:00 A.M.). (3) Amending agree-
ments with Special Town Attorneys Lark, Cron and Yakaboski, 'relative to restricting
them from representing any clients in' any matters before boards or agencies of the Town
The Board agreed this would not be a problem with Mr. Cron who represents the_ Board
in' certorari proceedings, but. :wish to add a clause to; the, Lark and Yakaboski agree-
ments, and iinarease:'.the ,.compensation of Mr. Lark to $1.25. 00, as is currently being
paid'Mr. Yakaboski (see resolution no. 47) . (4) Reappointment of Farmland Committee
members Villa;.:Orlowski and Hargrave (see resolution no. 38Y. 1.51 Pending resignation
of Recreation Supervisor Susan Fossett - Supervisor authorized to call for Civil Service
list. - (6) Letter Paul Roth, Regional Solid Waste Engineer, NYS-DEC, rescinding his '
letter of March 12, :1986' with respect to the scavenger waste pits at 'the Cutchogue
landfill; since it has been brought to his 'attention tha hazardous wastes may have
been dumped at the site (later discussion with Gary Loesch, H2M - Mr. Loesch will'
follow-up with the DEC who may order hydrogeological investigation to determine if:
there is 'a high level of toxic'pollutants). (7) Discussion of Carr property at Mattituck.
Board will:wait 'until transcript of the public hearing on the zoning ordinance and maps
is received -and will'then schedule work sessions to discuss implementation of same.
(8) Reviewed bids for carpeting areas of the Town Hall (see resolution no. 39) . '(9)
Discussed interviewsof Building Inspector applicants on civil 'service list, and appoint-
ment.-:of Gary Fish (see resolution no. 36).. (10) Receipt of change order .for construction.
of concrete ramp and roadway at the Scavenger Waste Treatment Facility; work to be
accomplished by Ferran Concrete, original general contractor for the. plant (see resolution
no. 40)'. ,
10:50 A.M. - Community Development Administrator James McMahon submitted the 1986
Hard Clam Seed Rafting Planting Program final report to the Board and discussed the
results and the upcoming :1987 program, requesting permission to purchase clams from
the Shinnecock Indian Hatchery,. and again' engage the services of David: Lessard, Marine
Consultant, Project Supervisor (see resolutions no.' 5 & 6) .
11 :00. A.M. - Off Agenda Items- Supervisor Murphy asked Town Attorney Tasker for
an explanation of why he rendered a decision that the Supervisor was not entitled to
indemnification and a Town retained attorney to defend him' in'the Ron Morizio case
concerning the alterations made to his 'office in' early 1986. Town Attorney Tasker

advised him that he is 'being sued individually and must retain' his 'own personal
attorney to defend him'. When asked why Mr.' Tasker did' not advise him' of the need
for a personal attorney, or provide a Town attorney, Mr. Tasker advised that he only
represents them in'an official capacity and not an individual capacity.---Discussed the
Clerk Typist. vacancy ins the Supervisor's. Office. 'Supervisor Murphy advised that his '
office had obtained the local civil 'service list and sent letters for interviews with only
one response from an individual presently in' California 'and who' will' not return for over.
a'month. He requested permission to interview willing applicants and appoint provision-
ally, but was advised he should call for the county list of applicants.---Letter from
Receiver of Taxes George Mellas was received transmitting information for a new system
for receipting and recording units for his department. Mr. Mellas will' be requested to
meet .with the. Board at their March loth work session.---Discussed material- to be
received by Youth Services from Planned Parenthood, and implications of same.
Community Development Administrator McMahon explained that New York State manda
certain topics to be coverdd in' the schools, and along this 'line' Juvenile Aide Officer
Martin' Flatley will be conducting seminars at the local schools concerning sexual abuse
awareness of children. Officer Flatley and a representative of Planned Parenthood will'
be invited to the March 10th work session to discuss other' proposed; programs they are
working on. ---Letter from Assemblyman Joseph Sawicki, 'Jr. concerning the Board's
request for the introduction of the "Land Bank Bill" was reviewed. Mr. Sawicki feels
it -would be much more realistic to set the limits of real property which will' be affected
by the legisl-ation at $200,000 improved and $100,000 vacant. Supervisor Murphy will'
bring this *topic before the Supervisor's .Association for discussion with the other town-
ships.---Councilman Penny asked that the next Waterfront Revitalization meeting be
advertise so there will' be more public'partici'pation.---He requested that-Troop 51
be granted permission to use the dishes of the Nutrition Program for a dinner. He
was advised he should check .with Venetia'McKeighan, Director of Senior Services.--
He submitted a copy of the -'.198T 88 .PiBk contract which is 'now in' final form, and it
will' be submitted to the PBA for review.---Councilman Penny discussed a request he
has received for the Town .to assume the electric'charges for a street light at Wendy
Drive, Laurel. He was advised this 'was installed by the residents when the road
was private, and wouldi.be_require'd to meet the criteria of:. being located at a.dangerous
intersection for the Town to assume the charges.---Mr. Penny submitted a proposal
prepared by Larry Tuthill; Engineer, for the possible solution to erosion at Kenny's -.
Beach parking area.---Mr-.',Penny presented. an elevation map of contour line area of .
Orient, as incorporated in' the master plan map, suggesting that the contour line should
be defined a little better. This 'will' be discussed further when the. Board discusses e
master plan hearing.
12:15 P.M. - Recess for lunch.
2: 15 P.M. - Fishers Island Garbage S Refuse District Commissioners Raymond Doyen
Howard Hancock met with the Board to review their 'five' years of preparation and
study leading to the construction of an. incinerator facility on Fishers Island. The
project, presently the subject of an environmental impact study, is 'to be located
at the westerly end of the Island near the present burning pits, where they are
allowed by the DEC to burn once a year. The DEC his advised them they are
looking for them to have a good recycling program and the Commissioners are looking
into the the purchase of a shredding machine. Two Consumat Model CS-325 incinerators
are proposed to be installed at a cost of. $300,'000 each, and equipped to handle 12 tons -
a day. This model is 'on the DEC approved list for. emission control. The Commissioners
presented the. Board with a map of the location and architectural drawings of the proposE
incinerator 'building.
2:45 P.M. Meeting with Bob Henderson, DEC, Albany, was cancelled due to Mr.
Hendierson's .illness. He will= be rescheduled for March loth.---Gary Loesch, Holzrriacher,
McLendon E Murrell,. P.C. , in' attendance to hear the discussion with Mr. . Henderson,
discussed with the Board the DEC's .letter relative to pumping the lagoons at the Land-
fill area, and advised he would be following-up on the matter and keep. the Board
up to date on the progress.
2':50 P.M. - J. Kevin'McLaughlin; Attorney for John A. Costello, met with the Boar
to discuss- the proposed( Convenants and Restrictions to be submitted with respect t
Mr. Costello's .proposed AHD district. Mr. McLaughlin'will' endeavor to have the
document executed by the principals before the Board's 7:30 P.M. regular meeting.
3: 10 P.M. - Board reviewed resolutions for the regular meeting agenda.--Lew is 'Edson,
real estate broker, appeared before the Board to advise he would be willing to do
appraisals for the Town at a cost not to exceed $100. 00. Board authorized Mr.
Edson to conduct an appraisal of "Oregon Heights" subdivision so the Board may
determine the amount to be deposited in' lieu of land for park and playground (see
resolution no. 4) .
4:00 P.M. - Board audited outstanding vouchers.
4: 30 P.M. - Board discussed memo from Town Historian Antonia'Booth concerning
plans and preparation for the celebration of the Bicentennial of the Constitution.
Supervisor Murphy will discuss this 'with Mrs. Booth and suggest she contact

other East End Historians to coordinate the plans.---Councilwoman Cochran reviewed
a memorandum from Mrs. Booth asking for guidance from the Board relative to attend-
ance at a March 2 meeting of Members of SOUTHOLD/2000, sensing the matter might
be political. The Board offered no objection to her attendance.---Proposed action
on the Costello change of zone petition to AHD was discussed (see resolution no. 46) .
4:35 P.M. Edward Siegmann, member of CANDO, a group in'opposition to the Carr
condominium project at .Mattituck, informed the. Board he had spent the entire date
in'the audience awaiting discussion of the master plan., and was disappointed to be
told at this 'point in'time it would not be discussed until 'a later date. He verbally
attacked Councilman Penny with respect to prior discussions he had had with him*
and his opinion he had not cooperated as he had promised.

A Regular Meeting of the Southold Town Board was held on Tuesday, February
24, 1987• at the Southold Town Hall, Main'.Road, Southold, New York. Supervisor
Murphy opened the meeting at 7:'30 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR MURPHY: Good evening. I'd, like to welcome you all here, and the
first order of business I'd .like a resolution approving the .audit 'of the bills of
February 24th, '1987.
Moved by Councilwoman Cochran, seconded by Justice Edwards, it :was
RESOLVED that the following audited bills he and. hereby are ordered paid': General
Fund Whole Town bills in' the amount of $51,427.21); General Fund Part Town bills in'
the amount of $23,435.11; Highway Department bills in' the amount of $19,877. 01;
Fishers Island Ferry District bills in' the amount of $15,726.56.

18. Councilmen's .Reports: I'd .like to now ask the Councilmen if 'they have
anything special to report, starting on my right with Councilman Penny.
COUNCILMAN PENNY: Yes, thank you, Frank. On the 5th I attended a meeting
that was established between the Town Board and the Village of Greenport to discuss
some mutual concerns. One being the Scavenger Waste Plant. Two being finalizing
the 7th Street Sewer agreements. Three,the Town Water Mana ement Policy. Four,
a
to review for ny possible contaminated areas for County funding for water.main'
extensions, of which we really didn't get very far. And five, we were asked by
the Village Board and members of the community, to recommend to the Town Plannin'
Board to review the site plan for the Costello property for the best traffic'flow con-
cerning the Middleton Road community. I have done that. I made the recommendati:
and received this response today from the Planning Board that they've got a better
plan than some of the people were--some of the people were concerned that there was
only one way in�and out of the community there, and it 'seems that they've got a better
_. --,_-=traffic flow out of it.' On the 6th I attended a meeting at the Scavenger Waste Plant.
We checked out the potential' problems of tractor-trailers turning around. We're. going
to have some pretty big' traile'rs an'd ;there's speculation that the one coming from Shelter
Island would not be able to maneuver through our gates, but we checked that all out.
We received a maintenance check list from H2M which will: be an operational guidline for
our plant. And l' missed--I . had to leave--but Ferran, the contractor there, came out
and reviewed the ramp proposal and the result is ,on the resolutions tonight. On the
loth we had a special meeting, which I'm.'sure we'll .hear more about, with H2M and.
the DEC. . On the 11th we- had Master Plan hearin' s. On the 12th I attended a meet-
ing with the Village of Greenport. The Suffolk County Department of Health Services
has come up, through the EPA, with funding for a test of a ion exchange filter on
well number 6, which has had some nitrate problems, and the Village, I believe,
resolved to accept this: It's :coming free to them at this 'point, but they'll have to
pick up the maintenance on it; and then eventually they may have to purchase some
part of it 'in' the future when it's give&i up by the EPA. On the 18th we had a meet-
ing Commerce and Industry Committee and discussed the Master .,Plan, the Laurel booth,
the Scavenger Waste Program, and various things that are before the Code Committee.
On the .19th we interviewed Building Inspectors. The result is 'the hiring of a Build-
ing Inspector, which we're going to be doing later. And yesterday I attended a
meeting with the Village of Greenport, H2M, .their'consultant, and Dennis •Moran from
the Suffolk County Department of Health Services, regarding the nitrate notices that
the Village has been required to send out, due to the high nitrate content from time
to time in'their waters system, and they are developing a different operational procedure
which should lower the nitrates below the acceptable level, and hopefully by summertime
we won't .be seeing any more of these notices. That's .all. Thank you.
SUPERVISOR MURPHY: Jay?
COUNCILMAN SCHONDEBARE : Yces., Frank, thank you. The Code Committee met
and discussed bed and breakfast and .accessory ;apartment laws, and we'll be amend-
ing them tonight as a result of that meeting. We also met with the Landmark Preservatior
group for -.the proposal of the Landmark Preservation Law, which they have submitted
to us. They'll meet with us again' this 'coming Wednesday in' the Town Hall. We have
a meeting March 4th, I think it pis; if'that's this Wednesday--7:00 to. 9:00 we meet, and
we'll be discussing that again'. Also the issue with regards to trailers will' probably be
on the agenda. That's been referred to the Code Committee. And likewise the proposal

for an Architectural Review Board for the Town, with regards to business property, was
submitted also toithe Code Committee. So i f'you want to have an interesting and enjoya&
debate, attend the Code Committee on Wednesday night. It gets to be-rather raucous,
I guess. Thank you.

SUPERVISOR MURPHY: Jean?
COUNCILWOMAN COCHRAN : Yes, on February 4th I met with our Recreation Director
Sue Fossett and we have now completed the goals which will be used as guidelines for
the new. Southold Town Advisory Committee-Youth Advisory Committee. We feel it's
important that the youth--the teenage group ,in'the(.community have input as to
programming in'the Recreation Department, and I 'expect that letter to go out.
requesting support from the schools this week. We did' have scheduled on-Monday
a meeting with the Land Use Company on the Plock property, which was. cancelled,
and also a Labor Management meeting, which was cancelled in' the evening. -1 'Would
ljust like to highlight briefly, because) think it's Jnformatioh the Town Board should
be aware of, in' addition I think also the 'public.'- I attended the Association of Towns
..in' New York and I will'just highlight some of the comments, or capsule. The opening
session the Honorable Stanley N. Lundinb, the Lie6tenant Governor, spoke, and he
said'that ,the Federal Tax Reform will' give a two billion dollar windfall to the State of
New York, and he feels that it :should be used to lower the taxvrates, so that all the
taxpayers of New York State- benefit 'from this �actiofi. Also in' addition in' the openi n§
session the Honorable Edward V. Regan, Comptroller of New York State;. was one of
the speakers, and to highlight the jisi of what* he said' he feels that he supports very
strongly a Constitutional change in: legislation so that if 'the State passes. legislation.
that they also pay for whatithey are passing. Twelve states in' the Unitdd States
have made this 'Cons titu'tioh al change, and he feels this :is 'the direction New York
State should go. Another session that I attended, the main'speaker was Henry
Williams, who is 'Commisgioher of-the DEC. To highlight some of- his 't-alk, .he feels
that the DEC will' be--and I shared this 'with the Town Board early in' the day--that
they will' be tightening up on their:regulations as far as burning is 'concerned, as a
way of ridding ourselves of the tons of garbage that we now produce. He feels that
they still' have a very strong concern on the health and environmental issues in' re-
lation to -emissions coming from these plants. He suggested that all towns before they
make a determination
termination as to what dir6ctiofi they're going to go, is 'to determinb what-
their:waste stream is'so
'so that this 'would be a supportive thing in`deciding. what
direction the town should go indisposing of all their 'refuse. He also suggested that
all towns take a very close look at alternate technologies. in.':additibil to burning. He
talked in: relatioh--bedause one of'our concerns, and I think I can speak for the Board,
we feel that we will' have to go into a recycling program, in' addition to whatever method
we reach a conclusion on in' ridding 'ourselves of all this 'garbage, but he said that he
has been talking to businbsses interested in'working with both recycling of plastics and
rubber tires. ' The one concern that these companieg Have not--they're ready to jump
right into New York State and become a part of this 'recycling, process--but their'one
concern is that if 'New York State can guarantee the quantities that would make it ,
feasible for them to set up these businesses within' New York State. He' also said-' -
and I thought this 'was interesting--that we talk about recycling, but their estimate
show that 60 'million dollars a year in'deposit. :returns are not returned, so that tells
you how- many cans—empty cans and bottles are still going- into the landfill:, .although
there is a deposit 'law. Also one little thing that he shared with us that he had learned
the day before, was the fact that earth worms go through the plastic'lin6rs in' landfills
and leave lots of little holes, so I don't know how they're going to solve this 'problem,
but I thought it 'was interesting. I also attended Federal Dollars and What's- -Next,
Property Taxation and Agriculture, the Assessment.of Farmland, Creative Financing,
Definition of Family 'Exclusionary Zoning. I did' have the privil6dge--being the only
one that attended the Association of Towns meetings, to serve as the Delegate rep-
resenting Southold, so I was able to attend the Annual Meeting which was held on
Monday morning. There were many State issues -that were passed in' relation to solid'
waste disposal, State shared revenue. This4as interesting because they do not support
revenue sharing. They feel that you send a'dollar to the federal government, and in'
return you may get fifty cents worth of services. They feel very strongly that money
being collected to do and provide services on a local level, that local officials have the
expertise to get a value from that dollars worth, rather than it 'going up to the top
and funneling down and not getting as much from the dollar as you.may if'it 'was
collected locally and spent locally. So it :was interesting. We felt, gee, we're-!going
to go home. and tell all our people that we don't support revenue sharing, but that
w-as the feeling of your towns in' New York State. Also, there was a resolution in-
relation to--as an example of veteran's benefitg and other benefits that are provided.
Again it 'relates to the fact that if 'the State passes legislation that it !should be 2
burden of the State to supply- the money. They're continuing to work on tort liability
and insurance, local control of mining. I have shared a copy of this 'with all Town
Board members and I'm .sure Judy will' have it 'on file if'you are interested in' seeing
all of the action that was passed at the Annual Meeting. I won't take the time to 7,0

into it; but I think if 'you did' ask for a copy you'd .find it 'very interesting. There
is 'from time to time some criticism of the fact that towns spend money to go to the
Association of Towns, but if:you see the entire picture, the Association of Towns, we
are a member of this 'group, and they do serve as .a lobby group for small towns and
villages in' relation to the State and the Federal government. I was not entirely happy
with all of the sessions that I attended that we set up for Town Board members, but
feel the concept and the opportunity to attend has merit; and I think it 'behooves me,
which P am going to do, I am going to write a letter to the Executive. Director of the
Association of. Towns requesting that When they. set up their 'agenda that it gives us
something more than what they presently share with us in' the way of speakers. One
afternoon I took the time to attend the session for Town Attorneys--excuse me, Bob;
but I did--and I found that more stimulating and informative than the sessions they
set. up for Town. Boards. So I don't think it''s .a matter of the concept in` what. they'
doing, it .'think it's a matter of they have to upgrade the material' that they're sharing
with town government. Thank you, Frank.

JUSTICE EDWARDS : Yes, on the 12th of February the DEC visited Fishers Island.
Two of the members came over:to check on some wetland violations, and I think they
wrote up a few things. They promised to come back on the Island, and I don't believe.
they stopped work on any job, but they did' put some future holds on a couple of the
projects. l also went to the Association of Towns in' New York City, and had twelve
hours of Justice Schooling that I have to go through every year, so it 'was fun being
down in'the City, and it 'was also enjoyable going to these classes and learning about
some of the new rules and regulations. Also this '.afternoon two members of the Fishers
Island Garbage Commission came over here and gave a little presentation on the engineer-
ing work that has been done on our incinerator plant on Fishers Island, which . I believe
is :i n' the permit stage now with the DEC, and we're going to put two incinerators in'
there and they're going to be down near the Ai rport/School area. I think we're a
little further along than'Southold Town, of course it's :a little smaller project, but. the
Garbage District did' get right in'there right at the beginning and they're working on
it very hard. The boys had a nice time coming over. They came by ferry--two ferrys
and back again'. Also down at the Association of.Towns--there's :a place outside of
Hartford, Connecticut, that recycles tires, and they buy old tires and grind them up
and they use them for fuel, and there was a nice demonstration that one of these
companies had there. Also at the Associatioh ,of Towns you can.meet a lot of these
manufacturers and distributors and they have their wares and it's .just educational..tc}
see the different things that are available--not only in' publications, but also in' hard-

put a patent on it; and it's .something that the baymen and fishermen could use.
It's a scale to see if'you're legal as far as clams:, scallops, crabs, and i.t 'floats too.
So it's something we've been talking about for a long time.

met with you`this afternoon regarding the Declaration of Covenants and Restrictions
on John Costello's :property, which appears as Item 46 on your agenda. I am happy
to announce that the Covenants and Restrictions have been executed both by Mr.
Costello and by the representative of the mortgagee, who is 'here this 'evening..
think there was one question that the mortgagee had on the consent of the mortgagee
form, where it states that the mortgage is 'hereby 'subordinated to the Covenants and
Restrictions, and I'd .like to address to the Board, _ and specifically Mr. Tasker, whether
or not that language would be required, or whether just the consent.without that
language would be sufficient? The mortgagee would perfer not to have that .language
in'there i f'it's .not necessary.
TOWN ATTORNEY. TASKER : Well, I have no objection to the language not being in'
there. In other words that the mortgagee just consent to the covenants. I don't
know how the rest of the Board feels.
SUPERVISOR MURPHY: Does anyone have any objection to that? (Town Board has

MR. McLAUGHLIN: I have the fully executed copy of the Declarations of Covenants
and Restrictions with me, along with a cover letter and a check. for the filing--

speak on tonight, Frank, is 'E911. Really, what's .the difference between E911
and: 911? Actually, Frank, when you call for the police, a policeman, you get
your response right? If you call for the fire department, response, right? - Call
for an ambulance, response, right? So what do you need--you say that you want
to 'pump something through Syracuse for, and spend $35,000 for this 'system a year,
compared to $7,500, 1'dl is}`, v.ou rr_:ai for. S'0,n00 to install the system.
Doesn't make sense, Frank, for this 'system, and the telephone company .will' probably
change a few printed boards in' the sub-station and make a few connections and. you'll .
have your system. . This system is 'operating what we have now. You're trying to hold
a budget down. .Every year the budget keeps. going up more. Fourteen point four
percent this 'year. You can't keep it 'down, Frank, by doing this '-spending $35,000
versus $7,500, you can't.. It's .not right. I mean, like I say, you calf 911 you get
your response. There's so many things that we can put this money to, Frank. We
need computers in'this 'Town, we don't have yet, which I've been after for two years.
Is' your. Town Highway computerized?
SUPERVISOR MURPHY: Yes.
MR. CARLIN: Good, one on me.
SUPERVISOR MURPHY: Police Department too.
MR. CARLIN: I know the police is: Another important one is 'the Tax Receiver's
Department to be computerized. No. . I went in' there to pay my tax bill.' in' January
and I looked at that contraption they've. got in'there, which I seen 32 years ago when
come into Town. Looks like it 'come over on the Mayflower. If anybody needs a
computer, that department needs a computer. I f'you're going to spend $35,000, tak
that money and put it 'into something we can use here. Bring us up to date. We'vE
been getting along with' 911, there's .no problem. When you make the call to 911, wl
do they ask for, the Police Department, or Fire Department? Your telephone number,
your name and address. It"s the same thing you're going to go to Syracuse, so what's
_ the. difference. What difference if 'it's direct or goes to Syracuse? . Just to put on a
computer, to save on a computer? . Doesn't make sense. And you're talking about
$27,500 more that could be put to better use, and. 1'd .li.ke to see it 'go to a computer,
even if you:.can:only get one for at least the Tax Receiver's Department---and ..the
Clerk's .Department, which I think they need. Think about it.' Let's start shaving
some money in'this Town. The taxpayers are paying enough money. The budget is '
going up every year, and these little things can reduce our money in'ou.r budget.
When you reduce the budget you reduce the taxes. Southampton this 'year can go
with a zero budget, and I don't know the reason why Southold can't.. So we must
try. Thank you.

JUSTICE EDWARDS : Do you want to explain that, Frank?
SUPERVISOR MURPHY: Do you want a couple of answers? E911 is 'exactly what
it 'says, is 'an expanded: 911 system. It's an instant .identification of a phone caller.
It has a tremendous potential' this 'town where we have a lot of old people, and if
somebody sick and panics, it has a tremendous potential', or an accident where
we're not sure exactly the location, will' help the Police Department eliminate crank
calls, and it 'will' also help the families who have latchkey children, young children
at home by themselves. -I_f_aparent qot hurt, 'or if 'they got scared, that they woul
be able to pick up the phone and we, the Police Department, would know exactly
where the phone was coming from. Basically that's it.' Curt.
CURTIS HORTON : I'm . here tonight to represent the Cutchogue Fire District. I'm
Chairman of the Board in' Cutchogue, and I just want to tell everybody, the Town
Board and everying, that we came here the other night for a presentation which was
given by the Telephone. Company, and everything,, and I think it was very well
We are very much in' favor of this system for more than one reason. We have an
independent answering service right in'our fire district, but we do get many calls
from the Police Department. A good example was last Sunday. We had a call last.
Sunday, Bridge Lane, accident, upside down, roll-over. It wasn't at Bridge Lane,
it 'ended up it was i n'Mattituck. If you had this 'Enhanced.-911 the location would
have been there. Somebody could have been dead because of the results of this:
mean and like that. This 'is 'the main" purpose, I think, maybe 11m.wrong. When

you get a call--m.any people moving in' here, they don't know where they are. I'1i .
go back a few years ago--I think Paul could vouch for this-�-he used to know every-
body on Nassau Point--w.e don't anymore. We know very few of them, because so

excited, ,.they're not sure--they say, well where do you live? I don't know. What's .
your street number? s. I don't know. This 'way here they would know. We .are hoping
in:Cutchogue anyway, that what they told us the other night, that within' a couple
of years--and it 'may be our expense, which .we would be willing to go. for--that we
can have it instantly switched to our dispatching station. We thank you.

that was here, and realizing that we can save lives, I feel that it's .a well worthwhile
thing. 1 only wish you'd seen the demonstration.

COUNCILMAN STOUTENBURGH: No, I understand what you're doing. What we're
saying is :there's..additional benefits to this 'that we don't realize' until you understand
that all .you'd .have to do is 'dial that number and not say a word and .you'd .know you'd
have a response and people would know where the problem is coming from. And this '
is 'the problem: people get excited, they forget, they say the wrong thing, the kids
can remember, they don't give the right address and what have you, and this 'eliminates
all that, because it 'immediately puts on the screen where that call is 'coming from.
FRANK CARLIN : How do they know the condition of the caller. How do they know
i f he's a fire or a heart attack?
COUNCILMAN STOUTENBURGH: At least you're going to have somebody there, Frank.
You're going to have a policeman right there.
FRANK CARLIN : What if somebody walks down the road from an accident three miles
and goes to a pay telephone. and dials from there and the ambulance or police or rescue
goes to that area? .
COUNCILMAN STOUTENBURGH: You can't hit 'everything, Frank. I just want to
let you know I felt the same way you did', but I think it's .a worthwhile cause.
FRANK CARLIN: 1 understand.
COUNCILWOMAN COCHRAN: And one little interesting side-note. I believe it 'costs
$2. 09 per taxpayer?---A dollar fifty; per taxpayar for _ valu'able service.

the Highpoint concept changed--his :model houses never really sold, and he wound dip
selling off the entire property there as vacant lots. I have no interest i n'.this 'zone
change that. Herbert Mandel. is requesting right now. There are no contracts or agree-
ments between Herbert�.Mandel and myself,. and outside of any past business relation-

the laws of nineteen hundred forty-seven, relating to the creation of the Fishers Island
Ferry District in the Town of Southold, Suffolk County and providing for the election
of its officers and management of its affairs, in' relation to the sale or conveyance of
real property in' said'district." It is 'hereby declared that a necessity exists for the
enactment -of such legislation whereas the Town does not have the power to enact such
legislation by local law.

The Town. Board of the Town of .Southold, in' the County of Suffolk, New York,
hereby RESOLVED (by the favorable vote of not less than two-thirds. of all the members
of said`Town Board) AS FOLLOWS :
Section 1. . The Town of Southold, in�the County of Suffolk, New York (herein'
called "Town") , is hereby authorized to acquire and install a new radio communications
console in the radio room of the Police Headquarters in' said'Town. The estimated
maximum cost of said specific'object or purpose, including preliminary. costs and costs
incidental thereto and the financing thereof, is '$75,000 'and said amount is°hereby
appropriated therefor. ' !The plan of financing includes the issuance of'$75,000 serial'
bonds of the Town to finance said' appropriation, and the levy levy and collection of taxes
on all the taxable real property in' the Town to pay the principal of said bonds and
the interest thereon as the same shall become due and payable. ,
Section 2. Serial bonds of the Town in' the principal amount of $75,000, are
hereby authorized to be issued pursuant to the provisions of the Local Finance Law.,
constituting Chapter 33-a. of the Consolidated Laws of the State of New York (herein'
called "Law") to finance said' appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The. period of probable usefulness of said specific object or purpose for which
said' $75,-Ob0 serial bonds 'authorized pursuant to this 'resolution are to be issued, within'
the limitations of Section 11-. 00 a. 25 of the Law, is 'ten (10) years; however, , the bonds
authorized pursuant to this resolution or bond anticipation notes issued. in: anticipation
of the sale of such bonds shall mature no later than five (5) years from the date of
original issue of bonds or notes herein. authorized for such purpose.
(b) Current funds are not required by the Law to be provided as a down pay-
ment prior to the issuance of the bonds authorized by this 'resolution or any bond
anticipation notes issued in: anticipation thereof in' accordance with Section 107. 00 d. 4
of the Law.
(c) The proposed maturity of the bonds authorized by this resolution will' not
exceed five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in: anticipation of the sale of said� bonds shall contain` the
recital of validity as prescribed by Section 52. 00 of the Law and said bonds and any
notes issued in� anticipation of said bonds, shall be general obligations of the Town,
payable as to both principal and interest by general tax upon all the taxable real
property within the Town wjithout limitation of rate or amount. The faith and credit '
of the Town are hereby irrevocably pledged to the punctual payment of the principal
of and interest on said bonds and any notes issued ins anticipation of the sale of said
bonds and provision shall be made annually in' the budget of the Town by appropriation
for (a) the amortization and redemption of the bonds and any notes in antici'patioh -
thereof to mature in' such year and (b) the payment.of interest to be due and payable
W such year.
Section 5. Subject to the provisions of this.' resolution and of the Law and
pursuant to the provisions of Section 30. 00 relative to the authorization of the
issuance of bond anticipation notes and of Section 50. 00 and Sections 56. 00 'to'
60. 00 of the Law, and powers and duties of the. Town Board relative 'to authorizing
bond anticipation notes and prescribing the terms, form and contents and as .to the
sale and issuance of the bonds herein' authorized and of any bond anticipation notes
issued anticipation of said bonds, and the renewals of said notes, are hereby
delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) 'such obligations are authorized for an object or purpose for which
the Town is not authorized to expend money, or
(b) the provisions of law which should be complied with; at the date of
the publication of'such resolution are not substantially complied with,
and an action, suite or proceeding contesting such validity, is commenced within
twenty days after the date of such publication, or

(c) such obligations are authorized in:violation of the provisions of the
constitution.
Section 7. . This bond resolution shall take effect immediately, and the Town
Clerk is *hereby 'authorized and directed to publish the foregoing resolution, in' full,

of the Law in' "The Long Island Traveler Watchman," a newspaper published in'Southold,

COUNCILMAN PENNY: Yes, I'd .like to make one, as far as divulgingg business
relationships, 1 have a very casual business relationship- with C-ostelFo Marine

Contracting, and John Costello...; �H-arcllyy_.--.one that any-body -could construe to be
a conflict of interest here, and also I have no businbss relationship'with the propo-sed
developers or contractors on this `subdivision. ' There are no agreements or permits
or anything in' effect that Would construe that. this 'Would be a conflict and that I
would gain' any advantage to this zone change. Thank you.
COUNCILMAN STOUTENBURGH: I'd like to make a statement here. First again; with
Your indulgence, let me again' reassure you my strong support for affordable housing.
Few, people could be against that. concept. On the other hand, this 'support comes
with certaiin: re' strictiohs attached to it.! One would be not to overburden Greenport
water supply, that is already pushed to its limits by new development. Also, creating
additional salt water intrusion by this :use of water into an already sensitive and limited
Greenport water area. It has been reported that the new well at Brecknock Hall has
been found to have salt in' it 'and this 'well, like the proposed Costello well, was to
A-booster the. Greenport's limited supply of water. And three, that Costello will be
sewered, which means all that sewer water will' be pumped into Long Island Sound,
as all sewer water is,: and not go back into the ground through cesspools, if'the
density were one acre or more, therefore building up the water supply below us,
and 'we all do this 'in'our own homes, most of us anyway. Affordable housing should
not put additional burdens on any Village resident. Examples could be where Green-
port's allocated electricity is bought at a 'certain' rate, and should they have to now,
with this 'extra amount of people, pay more, that means the people in' Greenport
Village would be paying the extra burden. And lastly, we have two acre zoning
proclaimed throughout this Town of'ours and should this 'proposed project go through,
it 'should not go through unless all the above problems that I've mentioned have been
mitigated. Now, some people might thing they have. I do not think they have. I
wily not vote against this . but I will* not support it: I will' abstain: I just want it
on the record that I think people should be looking into the environmental problems
that we're creating for our future residents in: this Town, and I realize.the importance
of this so-called project with the need for housing in' this 'Town, but I do think it '
should have been in: a better location where there was a much better supply of water-..
