EXECUTVE SESSION
9:29 A.M. - Board discuss CSEA negotiations with Town Board Negotiator Charles
Graves.
WORK SESSION
10:10 A.M. - Dr. Eliot Epstein, EEA Environmental Consultants, presented his
analysis of the eight vendors who submitted requests for qualifications with respect
to the Town's Solid Waste Management Program. Dr. Epstein recommended that
the Town request formal proposals from the following vendors: Reidel (DANO) ,
Waste Processing Corporation (DANO) , Reuter, Inc. (Buhler-MI AG) , Bedminster
(Eweson) . Councilman Penny requested the inclusion of Fairfield, bringing the
total to five. After the proposals have been prepared the vendors will be requested
to make a presentation to the Town Board.--Gary Loesch, P.E. , Holzmacher, McLend
S Murrell, P.C. ,. presented H2M's proposal for engineering services for the program,
inc uding the services of EEA as a major subcontractor to H2M, assisting on various
phases of the work. The entire package, which would take the Town to the construction
stage, would be on a per diem basis with an upset budget of $145,000. The Board
agreed to accept the proposal and placed resolution no. 45 on the agenda.
11 :00 A.M. - For Discussion Items: (1) Offer of Rene Gendron to donate to the
Town a park,and :playground parcel: of.-land in".the subdivision of Vista Bluff. Town
Attorney Schondebare will research the legality of accepting this parcel. (2) Receipt
Recreation Center Guidelines from Recreation Director Kenneth Reeves. Board
reviewed and agreed to the guidelines.
11 :25 A.M. - Board audited outstanding vouchers.
11 :30 A.M. - Recess for lunch. Most Town Board members traveled'to Orient Point
to witness the execution of the contract for the purchase of Orient Point by the
County of Suffolk.
2:00 P.M. - Kevin McLaughlin,. Attorney for the West Creek Estates Property Owner's
Association, -net with the Boarcl to discuss the propose petition for a West. Creek
Estates Road Improvement District. In order that a petition may be circulated,-
the maximum cost for the improvements of the roads must be determined. The
Board decided that the most. practical measure would be 'to engage 'the 'servi.ce.5
of Sidney Bowrie& Son, Engineers, to determine the cost of the improvements, and
the Bowne' .fee would be a charge against the:district when it is formed (see resoiutio
no. 43) .
2:05 P.M.,"=- Executive Administrator Lessard, along with Assessor Chairman Watts,
Assessor ;:harris, Justice Court Clerk Stulsky, met with the Board to review a proposed
plan to revise-,the office space in the Town Hall, pending the construction of an
addition. The temporary plan' would be to set off two offices for the Assessors
in their outer office area, and utilize the two existing Assessor offices for the
Justice Court through the construction of an adjoining doorway; relocation of clostes
to be included,_ and the addition of a doorway beside the Assessor's counter/window.
The Bgard also proposes to convert the existing Board Room into the Assistant
Town ';Cftorney's Office, and use Justice Price's office for a meeting room. Those
present agreed to the alterations on a temporary basis pending the construction
of the addition.--A meeting will be held on Wednesday, January 20th, with the
Bowne engineering firm to discuss the proposed addition.

2:35 P.M. - Frank Bear, .Chairman of the Water Advisory Committee, and Planner
Valerie Scopaz, met with the Board to review the Watershed Protection Study with
the Board, and request its inclusion in the Southold Town Water Resources Manage-
ment Program. Board agreed (see resolution no. 46) .
2:55 P.M. - board reviewed proposed regular meeting resolutions. There was con-
siderable discussion relative to the Town Trustee position held by Councilwoman
Larsen. Mrs. Larsen has not resigned her Trustee position, and is not sure whether
she will, stating she could possibly fill her own vacancy. She stated the Board
of Elections is not sure whether Councilwoman and Trustee is a conflict of interest,
and she would possibly hold both positions. Town Attorney Schondebare will research
this question.

JUSTICE EDW.ARDS : Just that our Affordable. Housing Program on the Island is
going well. The property is all in order and they're just getting down to the
design stage now, getting a plot diagram to give to the Planning Board and get
their acceptance. We're really looking forward -on the Island to getting some afford-
able housing for the young folks that are now wanting to move to the Island and
work over there. And that's it, Frank. Thank you.
DEPUTY SUPERVISOR *KUJAWSKI : Ellen?
COUNCILWOMAN LARSEN : I had the-opportunity to attend the Martin Luther Kin
Memorial Service at the A.M.E. Baptist Church in Greenport this weekend. It
was a wonderful revival meeting almost, and ecumenical service in honor of Dr.
King. Also I have set the meeting of the Inland Waterways Committee for February
10th. I see Ilene sitting in the audience. I'm sure that will be of interest to the
Trustees. And everything as far as the permit securing for the dredging seems
to be going,along very well. And that's all, Frank.
DEPUTY SUPERVISOR KUJAWSKI : Thanks, Ellen. Jean?
COUNCILWOMAN COCHRAN : Yes, on the 6th I attended a meeting of the Green
and we had to .chuckle a little bit because actually all .the brick you see piled up
down on the corner isn't our brick. Evidentially when we did the Sell A Brick
Day we had brick delivered to the site; when company came out with the brick
they thought it was our order again--it happens to belong to Jim Gray for the
new complex here, but we're wor-king-it out. with the company. We might even
end up having a little better deal. -And also we accepted the bid for putting in
the brickways which will be done as soon as weather permits. In addition I 've
spent quite a bit of my time this week working on trying to solve the problem here
in Town Hall. You know that we have a shortage of space. We did come up with
a bandaide solution this morning as far as trying to get some things settled at
this point, but we will continue, I hope, to look at long range planning 'and a more
permanent solution to our problem. Thank you.

COUNCILWOMAN COCHRAN : I do have one more thing. I would like to say that
this noon some of us did go down to Orient. It was a very nice ceremony where
County Executive signed the contract for the purchase of Orient Point, and it was
exciting and nicely done. Thank you.
DEPUTY SUPERVISOR KUJAWSKI : George?
COUNCILMAN PENNY: Yes, on the 6th. I attend a meeting of the Local Waterfront
Revitalization Committee. addressing the Town Local Waterfront Revitalization Plan.
We've broken the Town up into. the waterfront. of the areas of the Town, up into
nine areas, and they're meeting further to discuss that tonight. As a matter of
fact their meeting is concurrent with this meeting right now, so we can't attend
them both. On the 12th I attend a meeting of the Water Advisory Committee, which
I'm sure the chaiir.man. will report on. On the 16th, which was Saturday, I attended
the Annual Meeting of the North. Fork Animal Welfare League, where they elected
their president and reviewed .some of their by-laws. And. that is the grog that
has a contract with the Town and they run the Town Dog Shelter, and they' are
doing job--they had a change of administration, and they're doing an excellent
job down there and they're looking to renew their contract which will be the subject
of many discussions from now until July. And that's all. Thank you.
DEPUTY SUPERVISOR KUJAWSKI : Thank you, George. Ruth?
COUNCILWOMAN OLIVA: Yes, on January 6th I also attended the Waterfront Revital-
ization Committee, that George. has reported on.. On January 7th I went with the
Greenport Utility ,Committee down to the Department of Health Services to discuss
about a demonstration project for the denitrification of wellfield No. 63 in Greenport,
which looks very promising. On January 11th .I went to the Long Island Regional
Planning Board with* Planner Valerie, Scopaz and .Bob Villa to present our Water
Recharge Corridor Area as a critical recharge area. for the North Fork. We have
never been included in Southold in that because we do not meet all the criteria,
but because of Valerie's excellent presentation the committee did vote to include
us in this study, which is very important because: it will tell us really what water
we have, what we don't have, and then we will be included perhaps in some funds
to -acquire some of the property. On January 12th the Water Advisory Committee
met and we have recommended to the Town Board to make our Water Recharge Corridor
a Water Overlay District with 10 acre zoning. Much work still has to be done on
this so that equitable details can be worked out for the property owners, and these
could include acquisition, transfer of development rights, clusting outside the water
area, or purchase of development rights, but there's still plenty more to be done.
On January 14th I traveled to the DEC to speak with Dick Ryan of the Real Property
Division to see if we could apply for some EQBA funds also for our.`water recharge
area, and that looks rather promising. I attended the ZBA meeting that night.
On January 17th I was very privileged to attend the memorial service to Dr. Martin
Luther King at the A.M.E. Zion Baptist Church in Greenport. It was an inspiring
and beautiful ceremoney. And of course today, I guess the culmination of eight
years of work, to see that Orient Point was finally acquired. It certainly was
just a wonderful, wonderful experience. Thank you.
DEPUTY SUPERVISOR KUJAWSKI : Thanks, Ruth. For the Supervisor's Report,
I guess it's obvious that the Supervisor is still recuperating from a back injury.
He did put in a full day today, but was obviously in pain when he. left, and really
had nothing new to report on that. It's going to take time and maybe if he'd stay
off his feet a little bit more it might speed up a little bit:; but it's tough to keep
him down, expecially on a day like today with so much going on. For a personal
note I was very pleased with what happened today, and I found myself replacing
Frank Bear on the Suffolk County Board of Trustees several years ago, and
immediately being handed the Suffolk County Legislature's Acquisition Program.
The Board of Trustees, as you know, was given the authority to set up the properties
and the order of priority to be acquired with Mr. Cohalan's Open.Space Program.
We rated Orient .Point as the number one property to be acquired, but the way
things had, been, going lately it didn't look like it was going to work out. Robins
Island, 'by 'the way, was number two. So one out of two has now fallen into place,
in fact quite unexpectedly, but that`s- the way these things happen I've been told.
So it was really a historic day today.-
11 . PUBLIC NOTICES.
DEPUTY SUPERVISOR KUJAWSKI : Regarding the Public Notices , there are two.
1 . New York State Department of Environmental Conservation, Notice of
Complete Application of Joseph Finora to construct a single family dwelling and
associated sanitary system approximately 60 feet from tidal wetlands. A variance
of 1"571 at is requested to the. required 75 foot setback from tidal wetlands. . Property
located on the south side of James Creek on the north side of East Legion Avenue,
Mattituck.

2. U. S. Army Corps of Engineers, Public Notice, application of Stirling
Cove Condominiums for a a pier assembly extension and installation of piles, piers,
floats and wave barriers, Stirling Basin, Greenport. Comments by February 8, 1988.
III . COMMUNICATIONS.
DEPUTY SUPERVISOR KUJAWSKI : There are several communications.
1. Letter from Our Lady of Ostrabrama Roman Catholic Church thanking
the Town for the use of o.ur cherry-picker to repair a window in the uppermost
part of the church.
2. Letter from The Long Island Rail Road advising that electric service from
Ronkonkoma on their main line will begin on an interim basis on December'28th,
with full electric service to start on January 18th, and will reduce the travel time
of their riders by as much as 30 minutes with direct no change service to Penn
Station .
3. Letter from The Coastal Management .Corporation, Rowayton, Connecticut,
offering the: services of their firm in the waterfront development of the proposed
launching ramp for the Mattituck Inlet.
IV. PUBLIC HEARINGS. . (8:00 P.M. - Acquisition of development rights in the
agricultural lands of Joyce P. Terry.)
` V. RESOLUTIONS.
DEPUTY SUPERVISOR KUJAWSKI : I'd like to remind you that if anyone has any
comments regarding the resolutians.that the Board will be acting upon, this would
be the opportunity for you to stand up and make your comments known. There
will be another opportunity at the end of the meeting when the resolutions are
finished. Does anyone have a comment to make?
JUSTICE EDWARDS : I would like to make a comment. On Resolution No. 1, which
was presented at the. last meeting, and that's sending a .request to the Governor
to schedule a special election for a vacant Town.�Trustee position. It seems that
Councilwoman Larsen proposed to place in her place she. suggested our Deputy
Supervisor, and of course could not get the amount of votes to put that into order,
and so now she has decided to stay on as a Trustee and as a_ Councilperson. But
we're going to continue to put this resolution in there and it's only fair to the
Town that we have a board--a five member board on the Trustees and not continue
until the November election with four, or with Councilwoman Larsen staying on
on both jobs as Councilperson and Board of Trustees. Thank you, Frank.
DEPUTY SUPERVISOR KUJAWSKI : Does anyone else have any comments regarding
any of the resolutions? (No response.) Okay, then I think we could begin. Is
there a motion on the first resolution?
1.-Moved by Justice Edwards, seconded by Councilwoman Cochran, it was
RESOLVED that. the Town Board of the Town of Southold hereby sends a request
to Governor Mario Cuomo to schedule a special election for the vacant Town Trustee
position. .
I.-Vote of the Town Board :
COUNCILWOMAN LARSEN: No. My feeling is still that the Trustee position does
not warrant a special election. Pursuant to Trustee Smith and Trustee Bredemeyer's
letter to the Town Board regarding a special election, in my experience I only
ran in General Elections for the Town Board--for Trustee position. The position
was vacant for a year and a half, of which a four member board functioned quite
well. I think it would behoove the Town Board to fill the vacancy to look for a
candidate that does not belong--is not political. It's obvious that the Board is
balanced with the 'three-three vote on this. That Jeff certainly has every. right
to seek re-election. I feel that that can wait until November. Tjie Republicans
have offerett- eff. We have offered Frank. We offered Frank in the spirit that
he would vote.,certainly on all the applications, but we offered him in the spirit
that he' would not involve himself in the organizational aspects of_ the Trustees.
in other words, he would--at their- organizational meeting he would not be a part
of it. It wasn't to have him as a non-voting member, it was only in a non-political
tone that he would not interfere with that, in that he wouldn't seek re-election.
He is an experienced Trustee member and it's obvious that the Republican members
of the party do not--of the Town Board do not want to support Frank. I don't
feel that we should run another special election. , The Trustees did run for four
months--excuse me--eighteen months with only- four Trustees. Of that time there
was only one particular application that wasn't settled--that was Mr. Silverman.
So I feel that we could fill the position until the time of the General Election. The
GoweA4,or has the right to call for a special election. I f he calls for a special election
so be it. But I still stand that I do not feel that the Trustees are incapable of
functioning with a four member board. So my vote is No.

COUNCILMAN PENNY: I'm confused`:' 'Is' fhis'"position open or is it not open?
COUNCILWOMAN LARSEN : What do you mean by open or not open?
COUNCILMAN PENNY: Well, I heard today that the position was not vacated yet.
COUNCILWOMAN LARSEN : No. There's a vacancy there. The question is that
can I fill the Trustee vacancy as a Councilperson? That's all. There's no apparent---
.COUNCILMAN PENNY': There is a vacancy?
COUNCILWOMAN LARSEN : Yes---I don't know if there is or not. Yes--I-" don't
know, I'm not a lawyer, I'm not into the judicial and the lawyer aspects of the
whole thing. But in other words as myself as a Town Councilperson there's no
apparent conflict of interest, so if the Trustees feel that they want the fifth member
so much I am!.willing to accept that responsibility and sit as a Trustee until the
General Election in November. I would like to see the Town Board fill the vacancy.
f they can't fill the vacancy--come to an agreement, all of us, on filling the vacancy,
soliciting people who can best fit the position of Trustee, people with a background
in wetlands--people--that is strictly deals with wetlands., so you're not looking
for anything else if someone has some marine background I'm sure there are people
out there that could fill it in until November, and then in November at the time
of the General Election have a General.. Election, but I. don't see any purpose in
calling a special election for it. They can function quite well. John Bednoski
was on the-Board at the time when there were only four people. Al, is there now.
So was John and Henry, and there was no problem.. I sat in the audience for
a year and a half and they never 'held up any business. The only thing that was
held up was Mr. Silverman. When I came .on the Board I supported the Silverman
application, but a year later they came in for an extension on the dredging permit.
So even though they had to wait several months-I 'm not sure exactly how many--
for that permit to be decided, even when it was decided-.At still wasn't completed.
So they can----
COUNCILMAN PENNY: When we get to the point--if we find out that legally you
can't fill both spots---.
COUNCILWOMAN. LARSEN : Then I can't fill both spots.
COUNCILMAN PENNY: Then we can go back to the special election.
COUNCILWOMAN LARSEN : Or we can go back to the point where the Town Board
can fill the vacancy. There's a history of many times where a vacancy has been
filled from people either being on the Trustee Board and were appointed to finish
a vacancy on the Council position. This. is -.not unheard of that the Town Board '
has ever filled vacancies. It's even occurred on this Board many times where people
were brought from another department and filled a vacancy. I just don't see the
point in holding a special election. Perhaps the election will be held in May, when
you can just as well either fill the vacancy from the Town Board, Obviously there's
not going to be any political people put in it, because we're not going to agree
on it. So if we can find a qualified person to fill the Trustee position, so be it.
Why not? And we can do it.
COUNCILMAN PENNY: My position is \very clear. I have already told Jeff Goubeaud
that I would not appoint him or anybody else for the position. This is not political.
I have said that I would support a special election. I would not even vote myself
for a Republican for this position, and I think Jeff was shocked when I said that.
So this is 'not partisan, this is a philosophy, and this Board--especially this Board
as it stands, and the Board that I was on for .the last two years, -never appointed
anybody to anything. It's a philosophy of a board.
COUNCILWOMAN LARSEN : It's your philosophy.
COUNCI LMAN. PENNY: And my philosophy i! ,,that I don't appoint--- _
COUNCILWOMAN COCHRAN : Mr: Ehairman. Point of parlimentary procedure.

COUNCILWOMAN COCHRAN : You're to welathy, Judge. You don't qualify under

COUNCILMAN PENNY; Just for people in the audience here, this sounds like a
lot of jibberish,.,.but -they changed the overall proposal. They were going to split
a parcel into two sections and have a different zone on each one, and they've decid
that now they're going to amend-that -and come back in and look for one overall
blanket zone to cover the same parcel. It read a little confusing, but if you know
what's going on it's not too bad.

lines. Then picking it up to the east of Mattituck;,_nlet, again 3,000 foot wide,

coming up we have a Fishers Island Civic Association meeting and also will be the
first official work visit for Larry Penny the Environmental Consultant who has been
hired by the Town to take care of Fishers Island. A week ago yesterday we had
a sit-down meeting on the Island with probably 850 of the contractors, and Town
Officials came over, and it was very, very, very productive meeting, and the
contractors are looking forward to working closer with the Building Department,
the various County and State agencies, and Mr. Penny. And I think it's going

Patricia Moore of Mattituck was appointed to the Riverhead Town Board as a full-
time Attorney for $39,500.00. My question to you is, was she ever approached
to be the Attorney for Southold Town? The full-time Attorney? (No response.)
Well, it seems to me it's very odd that the woman lived in Mattituck, but was she
approached or not?
COUNCILMAN PENNY: She's a practicing attorney in Southold Town at the time,
and really .I_ think in due respect,`.all of our :discussions of personnel have been
in Executive Session.
FRANK CARLIN : It doesn't matter. You went down to the-Suffolk District Attorney
to find one, don't use that as an excuse. Just say you didn't do it and be honest
with me, all right? Question number two for Mr. Schondebare. You stated 1n the
December 31, 1987 issue of The Mattituck Watchman-Traveler that if you. were chosen
as the Attorney for Southold Town you'd make all the Work Sessions. Is that right?

FRANK CARLIN : Okay. Now, let me see. I sat down at my computer and put
some information in.
COUNCILWOMAN COCHRAN : It's a lot hours isn't it?
FRANK CARLIN'.: It sure is.
COUNCILWOMAN COCHRAN : It sure is. I'm trying to cut back this year.
FRANK CARLIN :. If you work 24 hours a day, 360 days, without stopping.. . .
COUNCILWOMAN COCHRAN : Of course I figured mine after deductions.
FRANK CARLIN : Can I finish, please? That comes to 8, 760 hours. Divide that
into last year's salary, which is $15, 975.00----1 didn't take this year's salary,
but I also have that calibrated--that comes to $1 . 82 per hour. Now, you're going
to have to work 365 days, 24 hours a day.
COUNCILWOMAN COCHRAN : That's true.
FRANK CARLIN : Now, I gave you a break and I covered that at 12 hours a day,
360 dais---we're up $3. 64. Now I went to 40 hours, 52 weeks, that brings you
to $7. 64. For you to be able to make--for you to be able to make 39� an hour,
you would have to work 41,000 hours--that would be 1,708 days at 4. 6 years. It's
impossible. Would you please answer that.

FRANK CARLIN : And one more comment I have for Mrs. Larsen. I doubt very
much if you can hold two elected official positions. It would be a possible conflict
of interest, and tomorrow I intend to find out. It's almost impossible to be elected
and hold two elected official positions. Let's be honest with ourselves. Thank
you very much.
JUSTICE EDWARDS : Mr. Carlin, Mrs. Oliva and I feel let out. What happened?
FRANK CARLIN : I'm.giving you a break for a change. Look: .at George. George
has been sitting there.
COUNCILWOMAN COCHRAN : You left him alone.
COUNCILMAN PENNY: I don't write any letters to the editor, I don't say anything.
JUSTICE EDWARDS : Well thanks, Frank, I appreciate it.
FRANK CARLIN : You see, Mrs. Cochran, when I met you this evening and you` "
said, "What are you going to speak about tonight?" I said, "It's confidential."
COUNCILWOMAN COCHRAN: You said it was confidential. And I said, "What about
the Freedom of Information Act?" And you said, "It doesn't apply here."
FRANK CARLIN: I didn't want to do this. From the bottom of my heart I didn't
want to do this.
COUNCI LWOMAN COCHRAN : Frank, part .of a job is sitting here and responding,
or being on the firing line. I have no difficulty with that. I feel I'm mature enough
to handle it, and we'll sit down some day-and compare notes.
FRANK CARLIN : I also have that figured out for your new salary too. It's $1. 93
now.
COUNCI LWOMAN••COCHRAN : Thank you.
DEPUTY SU NVISOR KUJAWSKI : Are there any more comments? Yes?
LORNA'TUTHI LL: I would like to ask what is being done about curtailing the
establishment of the retail busin'en-7!n the middle of a residential area on Boisseau
Avenue? We mad a protest about that a couple of months ago and alerted the Build-
ing Department, but it still continues to be advertised, and we'd like to know why
something isn't being done fo stop it? And, what has happened, because we've
given them all the information.
COUNCILMAN PENNY: We don't have any communications on- this. We 'don't get
those communications, Mrs. Tuthill. Do you have an area?
COUNCCI LWOMAN COCHRAN : Is that the last house on the right going up Boisseau
Avenue.

COUNCILWOMAN COCHRAN : The old,..W._heeler house. Is that what's in there,
a gift shop?
LORNA TUTHILL: They're. trying to establish a bed and breakfast, and a business
of antiques, gifts and memorabilia. They put advertisements in The'Traveler two
weeks, and then stopped--I think,nobody came to their open house that they were
advertising the Saturday after Thanksgiving. We have given the information, copies
of the ads, pictures of the house with the products hanging in the yard, and in
the windows, to Mr. Lessard. They advertise over the telephone. If you dial
the number 765-2900, which is also the number of the house, they will give you
a little speil':about what they have for sale and about the bed and breakfast, but
nobody in the neighborhood has received any notification of its desire to a variance.
COUNCILWOMAN LARSEN : And when did you transmit this information to the Build-
ing Department?
LORNA TUTHILL: The first of December, as soon as these things came out in
the paper. We watched it progress from Halloween-time when they put the wind-
socks out in the yard, and then they became Thanksgiving windsocks, and then
Christmas windsocks, and then there was a blackboard out in the yard advertising
bed and breakfast coming soon. Now, you can't miss it because they've got something
they call a Christmas schooner in the .front yard with a dilapidated Santa Claus
and what looks like a pile of trash there. That's what it looks to us. But we're
particularly concerned about the fact that they're trying to establish a store.
COUNCILWOMAN COCHRAN : I would think he'd give it to the. code enforcement.
We have a Code Enforcement Officer now. I'll check with Victor.
DEPUTY SUPERVISOR KUJAWSKI : Anything else? (No response.) If not, and
no one on the Town 'Board_ has anything else to add--Jay, you've been rather quiet,
do you have anything to add as Town Attorney?
TOWN ATTORNEY SCHONDEBARE : No, thank you.
DEPUTY SUPERVISOR KUJAWSKI : Okay. A motion to close?
Moved by Councilman Penny, seconded :by Councilwoman Cochran, it was
REOSLVED that this Town Board.."meeting be and hereby is adjourned at 8:45 P.M.
