Penny IV (ill) . 1:00 P.M. - The Town Board reviewed the agenda for the Organizational Meeting to be held at 3:00 p.m. EXECUTIVE SESSION 2:00 P.M. - The Board discussed personnel matters and PBA contract negotiations. 2:35 P.M. - Work Session adjourned. ORGANIZATIONAL MEETING 3:00 P.M. The Organizational Meeting of the Southold Town Board was held at 3:00 P.M. , Tuesday, January 3, 1989, at the Southold Town Hall, Main Road, Southold, New York. Supervisor Murphy opened the meeting with the Pledge of Allegiance to the Flag'. Present: Supervisor Francis J. Murphy Justice Raymond W. Edwards Councilwoman Jean W. Cochran Councilwoman Ruth D. Oliva Councilwoman Ellen M. Larsen Town Clerk Judith T. Terry- Absent: Councilman George L. Penny IV (ill) SUPERVISOR MURPHY: There's only resolutions and appointment today. The first one is an appointment of mine, and I appoint Frank A. Kujawski, Jr., as a Deputy Supervisor of the Town of Southold for the term of January 1, 1989 through December 31, 1989. 1 .-SUPERVISOR'S APPOINTMENT (a)Supervisor Francis J. Murphy appointed Frank A. Kujawski, Jr. as Deputy Super- visor of the Town of Southold for the term January 1, 1989 through December 31, 1988. SUPERVISOR MURPHY: 1 (b:) is a resolution setting the annual salary of Frank Kujawski. 4�.8" JANUARY 3, 1989 1 .-Moved by Councilwoman Cochran, seconded by Justice Edwards, (b)WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable; now, therefor, be it RESOLVED that the annual salary of Frank A. Kujawski, Jr., Deputy Supervisor of the Town of Southold, be and hereby is set at $2,347.00 per annum, effective January 1, 1989, and the same shall be paid in regular bi-weekly payments. 1 .-Vote of the Town Board: Ayes :Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 2 is to designate depositories. 2.-Moved by Justice Edwards, seconded by Councilwoman Larsen, WHEREAS, Section 64 of the Town Law requires the Town Board to designate, by resolution, banks in the State in which the Supervisor or other officers of the Town shall deposit all money coming into their hands by virtue of their office; and WHEREAS, the Town Board may require any bank, so designated, to deposit with such .Board bonds or certificates of the United States, of the State of New York, or any county, town, city, village or school district of the State of New York, as security for such funds so deposited, but such bond or certificate shall be subject to the approval of the Town Board and shall be deposited in such place and held under such conditions as the Town Board may determine; now, therefore, be it RESOLVED that the following banks are hereby designated as depositories and the following amounts of securities are hereby required, to wit: Bank of. New York $1,000,000.00 Norstar Bank $1,000,000.00 Suffolk County National Bank (Tax Receiver's Account only) $5,000,000.00 The North Fork Bank 8 Trust Company $3,000,000.00 The North Fork Bank & Trust Company (Tax Receiver's Account only) $1,500,000.00 Connecticut National Bank $ 500,000.00 AND BE IT FURTHER RESOLVED that authorization for increase and decrease of secutities shall be subject to the approval of the Supervisor. 2.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 3 is to authorize to invest money. -3.-Moved by Councilwoman Oliva, seconded by Justice Edwards, WHEREAS, Section 11 of the general Municipal Law requires that the Town Board may authorize the Supervisor, the chief fiscal officer of the town, to invest moneys not required for immediate expenditure; now, therefore, be it RESOLVED that the Supervisor is hereby authorized to deposit or invest moneys not required for immediate expenditure in special time deposit accounts, or certifi- cates of deposit issued by a bank or trust company located and authorized to do business in this State, provided, however, that such time deposit accounts or certificates of deposit shall be payable within such time as the proceeds shall be needed to meet expenditures for which such moneys were obtained, and provided further that such time deposit accouts or certificates of deposit be secured in the manner provided in Section 11 of the General Municipal Law. 3.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 4 is to authorize a signature stamp. 4.-Moved by Councilwoman Cochran, seconded by Justice Edwards, it was RESOLVED that a facsimile signature be and hereby is authorized to pay all checks, drafts and other instruments for payment of money drawn upon the accounts of the Town of Southold by Supervisor Francis J. Murphy, in amounts not to exceed $2,500.00, on the following banks: The Bank of New York Norstar Bank Suffolk County National Bank The North Fork Bank 8 Trust Company , Connecticut National Bank 4.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. JANUARY 3, 1989 49 SUPERVISOR MURPHY: Number five is designate the official newspaper as of February 1st. 5a.-Moved by Justice Edwards, seconded by Councilwoman Larsen, it was RESOLVED that The Suffolk Times, Mattituck, New York, a new!paper regularly published in the Town of Southold, which has been entered as a second class mail matter, be and the same is hereby designated, effective February 1, 1989, as the official newspaper of the Town of Southold, for the publication of all notices, resolutions, ordinances, and other matter required to be published. 5a.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 5b is to designate an additional newspaper. 5b.-Moved by Councilwoman Larsen, seconded by Councilwoman Cochran, it was RESOLVED that The Long Island Traveler-Watchman, Southold, New York, a newspaper regularly published in the Town of Southold, which has been entered as a second class mail matter, be and the same is hereby designated, effective February 1, 1989, as an additional newspaper of the Town of Southold for the publication of all notices, resolutions, ordinances and other matter required to be published-. 5b.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 6 is to establish a petty cash fund. 6.-Moved by Councilwoman Oliva, seconded by Councilwoman Cochran, it was RESOLVED that pursuant to Section 64(1-a) of the Town Law, a petty cash fund is hereby established in the following amounts for the following officers: Town Clerk Judith T. Terry $200.00 Justice Frederick J. Tedeschi $200.00 Justice William H. Price, Jr. $200.00 Justice Raymond W. Edwards $200.00 Police Chief H. Jacobs - (gate attendants at Landfill) $200.00 Historian Antonia Booth $100.00 Recreation Superintendent Kenneth Reeves $100.00 6.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 7a is.toaLthorize the Highway Superintendent to purchase equipment. 7a.-Moved by Councilwoman Cochran, seconded by Justice Edwards, it was RESOLVED that pursuant to Section 142(1-A) of the Highway Law, the Southold Town Superintendent of Highways be and he hereby is authorized to purchase equipment, tools, snow plows and other implements and devices without prior approval of the Town Board in the amount not to exceed $5,000.00 for any one item during the period from January 1, 1989 through December 31, 1989. 7a.-Vote of the Town Board: Ayes:Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 7b is for the Commissioner of Public Works. 7b.-Moved by Justice Edwards, seconded by Councilwoman Cochran, it was RESOLVED by the Town Board of the Town of Southold that the Commissioner of Public Works be and he hereby is authorized to purchase necessary supplies and equipment, without prior resolution of the Town Board, in an amount not to exceed $5,000.00 for any one item during the period from January 1, 1989 through December 31, 1989.. 7b.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 8 is to designate the alternate .and the delegate to the Association of Towns. 50 JANUARY 3, 1989 8.-Moved by Councilwoman Larsen, seconded by Councilwoman Oliva, it was RESOLVED that Supervisor Francis J. Murphy be and he hereby is designated to represent the Town of Southold at the annual meeting of the Association of Towns of the State of New York, to be held in New York City on February 19, 20, 21, 22 1989, and to cast the vote of the Town of Southold pursuant to Section 6 of Article III of the Constitution and By-Laws of the Association of Towns; and be it further RESOLVED that Councilwoman Jean W. Cochran, be and hereby is designated to act as the alternate delegate, to cast the vote of the Town of Southold at the annual meeting of the Association of Towns in the absence of Supervisor Francis J. Murphy. 8.-Vote of the Town Board: Ayes: Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 9 is to set an allowance for the Association meeting. 9.-Moved by Councilwoman Oliva, seconded by Justice Edwards, it was RESOLVED-that those officers and employees of the Town of Southold attending the annual meeting of the Association of Towns of the State of New York be and hereby are allowed $600.00 per officer and employee for the actual and neces- sary expenses to travel, meals, and lodging incurred while attending said meeting. .9.-Vote of the Town Board: Ayes :Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 10. is set an allowance for your own vehicle. 10.-Moved by Justice Edwards, seconded by Councilwoman Oliva, it was RESOLVED that any Town official, elected or appointed, who is required to use his own automobile in the performance of his duty, be compensated for travel expenses necessarily and actually incurred in carrying out the duties of his office, at a rate not to exceed twenty ($.20) cents per mile. 10.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 11 is a resolution authorizing the engaging of the services of E. F. Kaldor, C.P.A.,P.C. to make the annual audit of the books and records of the Town, at a total fee of $13,000.00. 1 offer that. 11 .-Moved by Supervisor Murphy, seconded by Councilwoman Cochran WHEREAS, Section 123 of the Town Law provides that town officials and employees who receive and disburse moneys of the Town shall, on or before January 20th, account to the Town Board for all moneys received and disbursed by them in the previous fiscal year, unless the Town shall engage the services of a certified public accountant, or public accountant prior to January 20th; and WHEREAS, the Town Board deems it necessary to engage a public accountant to prepare the aforesaid annual accounting for all Town officers and employees; now, therefore, be it RESOLVED that the Town Board of the Town of"Southold hereby engages the services of E. F. Kaldor, C.P.A., P.C. to make the annual audit of the books and records of the officers and employees of the Town for the year ended December 31, 1988, at a total fee of $13,000.00. (Financial and Internal Controls Audits - Town Audit: $9,000.00; Grant Audits: $2,000.00; Compliance Audit of Federal Projects: $2,000.00) . _ 11 .-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 12 is to set the annual salaries of the following elected officials. 12.-Moved by Councilwoman Larsen, seconded by Justice Edwards WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable and that the salaries of the members of the Town Board, the elected Town Clerk and the elected Superintendent of Highways shall not be fixed in an amount in excess of the amounts pursuant to SEction 108 of the Town Law; now, therefore, be it RESOLVED that the annual salaries of the following elected town officials shall be as follows, to wit: Supervisor Francis J. SUPERVISOR MURPHY: Number 13 is to set salaries of the following appointed officials. 13.-Moved by Councilwoman Cochran, seconded .by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby sets the following per annum salaries for the following appointed officials or employees, effective January 1, 1989 through December 31, 1989 Town Attorney James A. Schondebare $27,000.00 Assistant Town Attorney Robert H. Berntsson $42,500.00 Deputy Superintendent of Highways Charles H. King $35,000.00 Deputy Commissioner of Public Works Thomas H. Gannon $34,026.00- Community Development Administrator James C. McMahon $36,188.00 Bookkeeper John A. Cushman 11 $37,500.00 Confidential Secretary to the Supervisor Ruthanne Woodhull .$25,000.00 Cordinator of Handicapped Recreation M. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 14 is to extend the contract of our Chief of police. 14.-Moved by Councilwoman Oliva, seconded by Councilwoman Larsen, it was RESOLVED that the Town Board of the Town of Southold hereby extends the 1988 contractual agreement between the Town of Southold and Chief of Police Harold D. Winters until such time as there is an executed 1989-1990 Contract. 14.-Vote of the Town Board: Ayes: Councilwoman Larsen, Councilwoman Oliva, Justice Edwards, Supervisor Murphy. Abstain: Councilwoman Cochran. SUPERVISOR MURPHY: Number 15 is to appoint the Chairman of the Board of Assessors. 15.-Moved by Councilwoman Cochran, seconded by Councilwoman Oliva WHEREAS, Section 22B of the Town Law allows the Town Board of any town having more than one assessor to establish the office of Chairman of the Town Assessors, who, in addition to his regular duties, shall perform such services in connection with assessment and taxation of property for state, county and town purposes as the Board shall direct; now, therefore, be it RESOLVED that Assessor Charles C. Watts be and he hereby is designated to hold the office of Chairman-ofthe Board of Assessors until the first ay o anuary next succeeding such designation, at the pleasure of the Town Board, all in accordance with Section 22B of the Town Law; and be it.further RESOLVED that the Chairman of the Board of Assessors shall be responsible for furnishing to. the Town a detailed monthly report 'of activities with his depart- ment; and be it further RESOLVED that the compensation for such appointment be fixed at $1,000-00 per annum, payable in regular bi-weekly payments. 2 JANUARY 3, 1989 IS.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 16 is to appoint the Chairman of the Planning Board and set his salary. 16.-Moved by Justice Edwards, seconded by Councilwoman Oliva, it was RESOLVED that pursuant to Section 272 of the Town Law, Bennett Orlowski, Jr. is hereby designated Chairman of the Southold Town Planning Board for the calendar year 1989; and be it further RESOLVED that the Chairman of the Planning Board shall be responsible for furnishing to the Town Board a detailed monthly report of activities within his department; and be it further RESOLVED that the Chairman of the Southold Town Planning Board shall be paid a salary of $2,000.00 per annum, effective as of January 1, 1989, and the same shall be paid in regular bi-weekly payments. 16.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED: SUPERVISOR MURPHY: Number 17 is to appoint the Chairman of the Board of Appeals and set his salary. 17.-Moved by Councilwoman Oliva, seconded by Justice Edwards, it was RESOLVED that pursuant to Section 267-(1) of the Town Law, Gerard P. Goehrin er is hereby designated Chairman of the Southold Town Board of Appeals for the calendar year 1989; and be it further RESOLVED that the Chairman of the Board of Appeals shall be reponsible for furnishing to the Town Board a detailed monthly report of activities within his department; and be it further RESOLVED that the Chairman of the Southold Town Board of Appeals shall be paid a salary of $2,000.00 per annum, effective as of January 1, 1989, and the same shall paid in regular bi-weekly payments. 17.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution _was declared duly ADOPTED. SUPERVISOR MURPHY: Number 18 is to set the salaries of the Planning Board members and the Board of Appeals members. 18.-Moved by Justice Edwards, seconded by Councilwoman Oliva, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable; now, therefore, be it RESOLVED that the annual salaries of the members of the Planning Board and the Board of Appeals of the Town of Southold be and they hereby are fixed as follows for the calendar year 1989:, PLANNING BOARD Kenneth L. Edwards $6,065.00 George Ritchie Latham, Jr. $6,065.00 William F. Mullen, Jr. $6,065.00 Bennentt Orlowski, Jr. $6,065.00 Richard G. Sawicki $6,065.00 AND IT IS FURTHER RESOLVED that the member of the Planning Board and the members of the Board of Appeals be paid these salaries for their respective offices in regular bi-weekly payments, and the appointed officers or employees shall hol& such appointed offices or positions at the pleasure of the Town Board unless otherwise provided for by law; and be it further RESOLVED that the Town Clerk be instructed to file such certificates with the proper parties as is required by Section 30, Subdivision 3 of the Town Law. 18.-Vote of the Town Board: . Ayes:Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 19 is to set the salary of the Town Historian. JANUARY 3 1989 53 19.-Moved by Councilwoman Oliva, seconded by Justice Edwards, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable; now, therefore, be it RESOLVED that the annual salary of Antonia S. Booth, Historian, be fixed at $8,100.00 per annum, and she to hold such appointed office or position at the pleasure of the Town Board unless otherwise provided by law; and be it further RESOLVED that this salary be efeective January 1, 1989, and the same shall be paid in regular bi-weekly payments; and be it further RESOLVED that the Town Clerk be instructed to file such certificate with the proper parties as required by Section 30, Subdivision 3 of the Town Law. 19.-Vote of the Town Board: Ayes; Councilwoman Larsen, Councilwoman, Oliva.., . Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. SUPERVISOR MURPHY: Number 20 is to set the compensation for the Conservation Advisory Council. 20.-Moved by Councilwoman Larsen, seconded by Councilwoman Cochran, it was RESOLVED that the Town Board of the Town of Southold hereby sets the compen- sation of the members of the Southold Town Conservation Advisory Council, at $40.00 per meeting, which includes inspections, effective January 1, 1989 through December 31, 1-989. 20.-Vote of the Town Board: Ayes Councilwoman Larsen, Councilwoman Oliva, Councilwoman Cochran, Justice Edwards, Supervisor Murphy. This resolution was declared duly ADOPTED. JOSEPH CORNELL: Mr Murphy, first of all, I'm very happy we have members of the press here, because on numberous other occasions, I've asked why you don't have a microphone in front of each member of the Council. I don't under- stand why you still don't have it. You've got three of them separated up there, and most times I can't hear. It's very important that members of the press can, so I can read it in the, paper. I don't understand why you can!t have six up there for your members, as well as one for the Town Attorney, because like to hear him when he speaks. SUPERVISOR MURPHY: The point is well made, and it's an oversight. JOSEPH CORNELL: All right. Now, again, I'm asking, why don't you get a micro- phone for each member of the Town Board, so that we can hear? A lot of times I can't hear. I can't hear Ellen Larsen. The only one I can hear is you and Ruth. Another thing, I have one question to ask here. Your salary for the Town Attorney I' heard was $27,000.00. Is that correct? What's the salary for the Assistant Town Attorney? 5 QQ JANUARY 3, 1989 SUPERVISOR MURPHY: The Town Attorney is basically a part-time job, and the other attorney, his assistant that he works under, is a full-time job. The man is not allowed to have a law practice in the Town. Is not allowed to practice here. That was $42,500.00. JOSEPH CORNELL: I understand now. That's something I didn't. SUPERVISOR MURPHY: He's a full-time employee of the Town. JOSEPH CORNELL: He's full time? COUNCILWOMAN COCHRAN: Every day from 9 to 5. JOSEPH CORNELL: Who represents us now when you get somebody like Zara in here and everything else? Who represents us? SUPERVISOR MURPHY: The Town Attorney represents us on most all cases. JOSEPH CORNELL: That would be Schondebare? SUPERVISOR MURPHY: Yes, or Rob Berntsson. They both do. JOSEPH CORNELL: They both do? SUPERVISOR MURPHY: Right. There are special cases were certain types of law suits have to go out to a private firm, but mostly they're handled by in-house attorneys. J OSEPH CORNELL: I see. Thank you. Now I have one other question here. You're going to Fishers Island again. You have a couple of people here that have no compensation, but then you have one for $2,200.00, and another for $1,700.00 protecting. Protecting, what? What the wetlands or something on Fishers Island? What is that? What are they protecting there, Mr. Edwards? JUSTICE EDWARDS: They're harbor masters. They're like the bay constables. JOSEPH CORNELL: What are they really protecting on Fishers Island? JUSTICE EDWARDS: What are they protecting? They're making sure that the people that come over there from Connecticut are anchoring where they should. They're also patrolling the harbors to prevent the speeders, to ticket the speeders over there, and just to more or less patrol the waters in and around Fishers Island. JOSEPH CORNELL : Well, the moneys not that great, but I was curious to know why you have the things over there when you have a, resident, and so few people. JUSTICE EDWARDS: Well, resident of so few people, we pay 8% of your taxes over here in Southold, and these are people that are part of the budget of the Police Department. Actually it's the Police that are paying these people to patrol that area. Your Policemen, your Bay Constables do not get over to Fishers Island - on a regular basis, so we have our own police over there TOWN CLERK TERRY: How many people are there in the summer, Ray? JUSTICE EDWARDS: The population goes up to five thousand people in the summertime. JOSEPH CORNELL: We got forty some odd thousand out here, but we only have .21 . thousand normally. Right? JUSTICE EDWARDS: Yes. JOSEPH CORNELL: You can't base everything on summer residents. JUSTICE EDWARDS: Oh, no. No. SUPERVISOR MURPHY: They have a lot of water, and it really is necessary over there, on Fishers Island. We're very fortunate to have two people to be so dedicated and really to work for such a reasonable. . . . JOSEPH CORNELL: The amount of money is not that great. I was just curious.
