Tasker. (10:50 'a.m.). 9:09 A.M. -. Board audited outstanding vouchers. EXECUTIVE SESSION 9:30 'A.M. -. Board met-with Executive Administrator Victor Lessard to discuss pend- ing litigation and personnel. ' 9:4:0 A.M. -: Executive Administrator Lessard discussed the Catapano house trailer which was placed on the property at, Roulte 25, east of South Harbor Road, Southold, without a permit. A letter. from Mr. Catapano's attorney,- Paul A. Caminiff 'request- ing reconsideration of the. Board's denial of the permit, was discussed. Mr. Catapano wishes to maintain`.the trailer as. a. residence for his 'night watchman, but the Zoning Code does not provide for the location of new trailers within* the town. The matter was "efer.red to the,Codec -Committee for study and recommendation. ' 9:50 A.M. - Director of Youth Services James McMahon and Youth Counselor MaryAnn Fleischman met with the. Board to report effectiveness'of the 1986 ToughLove Program. This is 'self--.help program for parents troubled by teenage behavior. The statistical breakdown for .-1.986 revealed 248 contacts with 52 individuals. Parents from Montauk to Calverton travel to `the Southold Town meetings. Mr. McMahon and Ms. Fleischman outlined the nature Hof the program and other connecting groups they have contact with for support services. 10:20 A.M. - Bessie'E. Swann, Executive Director of North. Fork Housing Alliance, Inc. , and her associate Frederick Reiter, met with the. Board to review the. 1986 Annual Program Summary for the Alliance. Mrs. Swann explained their Advocacy and Counseling Program for the Community Development. Block Grant funds .for housing assistance performed within�Southold and Riverhead Towns, rendering service to 224 families in:Southold Town during :198'6, and placing/relocating 29 displaced/evicted families. They.rehabilitated 13 private homes and corrected code violations; three rental units were rehabilitated through the new Southold Town Rental Rehabilitation Program. One new home was completed and .the selected family is 'being assisted in� obtaining a low interest mortgage. The sale price of $7.8,000 will' be subsidized by the Town's special Community Development Block. Grant. The. Lakeside Garden Apart- ments complex in� Greenport, containing 16 rental units is 'being occupied now. Families have been certified and leases executed; 119 persons were. on the waiting list. Mrs. Swann reviewed the 'subsidies secured in`:1986; grant solicitation requests; housing management program; loan/grant application assistance; and :1987 project planning. 11 :00 A.M. - Town Planner David' Emilita met with the Board to discuss the SEQR review fee of Thomas Cramer, Meadow Lane residence application. The state and Town Environmental Review fees were discussed. . Mr. Emilita advised the Board that the appeal of Mr. Cramer concerning the amount of the fee should properly be before the Town Trustees, the lead agency. The Trustees should require Mr. Cramer to document the total cost of the project before a final determination can be made. 11 :30 A.M. - Jack Ruehl, New York Telephone, appeared before the Board to present a proposal for Enhanced 911 for the Town. E911 provides automatic*number and location identification to the dispatcher .at Police Headquarters, displaying the caller's telephone number and exact address, even from a coin' telephone, as soon as the phone call is answered. A further feature enables the dispatcher/attendant to press the appropriate transfer button and the call is 'automatically routed to the property agency, i.e. fire department. The system would drastically reduce false alarms and prankster calls since E911 will display their exact address and telephone number immediately and 486 FEBRUARY 3, 1987 the police can respond within minutes. The increased cost to the Town would be $2,229.59 (plus the -current $616.74 current network cost per month) ,. and a one-time $10,'608.'36 installation charge for the system. A more comprehensive presentation will' be made at 8:00. P.M. this �evering, at which time the fire ,services will' be in' attendance. 12:.05 P.M. For Discussion Items: (1') Agreements with special' Town Attorneys Lark, Cron, Yakaboski. The Board wishes to specify a salary of $100.00 per hour each, and insert a clause whereby the attorneys agree not to.appear before any board or Town. Court-while they are under contract to the Town. (2) Discussed 'the Board's . desire' for reintroduction by the NYS Senate and Assembly: of."An Act establishing the Southold Land Preservation. Bank to preserve, acquire; hold and manage certain' real property .in' the Town of Southold, County of Suffolk and providing for the repeal of certain provisions upon expiration thereof," (see resolution no. '19)'. (3) Letter from Suffolk County Archaeological Association/Nassau County Archaeological. The Supervisor will" contact Professor Walter Smith of the. NYS Archaeological Society., Long Island Chapter, Southold, to request his 'associa- - tion to compile a listing for -Southold Towr►`. '4) Letter from Dimension Cabe Services advising iof the completion of the rebuild within the franchise area and requesting the reduction of their Construction Bond .from $750,000 to $50,'000, . as per the franchise agreement. Town Attorney Tasker advised the. Board they should obtain' confirmation from the other entities (Villages of Quogue, Westhampton Beach, Sag Harbor., South- ampton, and. Greenport) that the 'rebuild has: been completed in'their�areas before the Board agrees to the bond reduction. Supervisor Murphy will' make the necessary contacts relative to this.' (5) Fishers Island Sewer District in'the Fort Wright area has been completed and.is 'now operational. The system is 'owned by the Town and the annual maintenance charges will" be billed by the Town. There are 58 units on the system and it 'was agreed that the Town Clerk's .Office would process the semi- annual maintenance charge billings since it 'had been determined earlier that the receipt of Ahe feesi: would be processed by the. Town .Clerk's...Office!.: (6) t Supervisor. Murphy advised the Board that two of the Nutrition vans have been involved in' accidents, and both were totalled. Bids for.one van will be received .on February 5th, but the situation is 'critical and he has received a price of $82. 00 'a day for.a van and driver from Sunrise Coach Lines to alleviate the situation. ' The Board wished to wait 'for the bid opening to, determine how long it "would take. for the delivery of the van. (7) A Civil 'Service List,containing the names of 17 individuals .interested in' the position of. Building Inspecto has been received. . Boa rd.::agreed to interview all 17 applicants as soon as p4'ssible (February :19th) . . (8) Councilman. Stoutenburgh asked the. Board .to consider the issuance of free permits to seniors over the age of 65 or 70.' This 'would mean an -amendment to the. She'll.fish. Ordinance and it 'will be reviewed by the Code Committee at their next meeting. '(9) - Discussed. staffing the Accounting Department. There are two interested applicants on the civil serivice Account Clerk list, one being Barbara Rudder who is --currently employed in' the Supervisor's Office. The Board agreed to appoint Mrs. Rudder (see resolution no. 22)', and the other applicant Jeanne Ruland,, if she is 'interested and satisfactory to the Board following. an interview on February 5th. They also agreed to appoint John Cushman III to the provisional position of Accountant (see resolution no. 23) . (1'0) Request from the Southold Town Fire Chiefs Council "for the appointment of Jerry Diffley as alternate representative to the Fire Rescue Emergency Services Commission, in' place of Edward Loper. This 'will' be done upon receipt of Mr. Loper's .resignation. EXECUTVE SESSION 12:45 P.M. - Discussed personnel. 1:.45 P.M. - Recess for lunch. - . - i 3:05 P.M. - Work Session reconvened and off-agenda items were discussed: Use of the Senior/Youth Center by the Youth Services Adult Advisory Committee for every Friday night, February through July. Since the committee has not submitted their ' structure and guidelines and rules for the use of the Center, the Board agreed to the use of the Center Friday nights. for structured programs 'during the month of February in' hopes the guidelines will' be submitted before the end of the month.--- _ Board will' meet with the Village of Greenport Trustees at 7: 30 P.M. , Thursday, . February 5th to discuss the Wastewater Treatment Facility and other matters of mutual concern.---Board wilFmeet at 8:30 A.M. , Tuesday, February 10th with Gary Loesch, Holzmacher, McLendon 8 Murrell, P.C. , to review the plants and specifications for the proposed weighing facility at the landfill:---Councilwoman Cochran advised the Board that the Kiwanis !Club would like to donate a gazebo for the proposed new Town park at the corner of Route 25 and Youngs Avenue, which is 'currently owned by Nature Conservancy and will' soon be transferred to the Town. Board will' be happy to accept the donation.---Justice Edwards reported on the recent Fishers Island Civic Association meeting: request for a Conservation Advisory Committee member from Fishers Island; F.I . Conservancy would be willing to add $10,000 to the ERM F. I. water study to obtain a more comprehensive plan; need for drainage construction on Crescent Avenue, F.I . , in front of the Mobile station, where the road runoff leaches into the ground; the metal dump is -being removed; Jim Hancock is 'at Stony; Brook today meeting with FEBRUARY 3, 1987 8 7 the DEC on the incinerator; need.for;;affor-dable housing.---Councilman Stoutenburgh requested input from the Board members for locations of old/and or historical trees within the Town.---Councilman Penny: request for a resolution (no. 24) for Town to dedicate the 7th Street Sewer to the Village of Greenport; his 'review of the Village of Greenport's operating and maintenance '1987 budget for the Wastewater Pretreatment Facility, which he recently received. Supervisor Murphy advised this ' was received before preparation of the Town Budget in' September and provision was made for a capital reserve as well as increased anticipated operating and maintenance costs. Councilman Penny will discuss this with the Village Board at the February 5th joint meeting. He advised he recently learned that Ferran Construction, the general contract for the Wastewater facility, may return to the job site. to make certain' correction, Councilman Penny asked the. Board to obtain' an estimate of the number of employees whill would take advantage of the Deferred Compensation Plan before putting it 'in` place. The cost to the Town may be too high for only a handfull of employees. As Chairman of the Street Light Committee, Councilman Penny advised he has been asked 'foK,.tihe installation of a street light at the entrance to Founders Village, Youngs Avenue, Southold. The. Board agreed it is necessary and he will' contact Commissioner of Public' Works Jacobs .relative to installing this .light.---Councilman Stoutenburgh submitted a proposed letter from the Farmland Committee, drafted by' committee member Robert . Villa, requesting the Board to consider another bond issue for the November ballot for the purchase of lands that are either environmentally sensitive, such as welands along our many waterways, or that should be purchased to retain'open space, or for future water supply purposes. The purchases could be either outright purchases or just the development rights similar to the farmland program. The Farmland Committee would be willing to assume the extra duties associated with, the program. Board agreed this would be an extremely good program. 4:00 P.M. -. A Regular Meeting of the Southold Town Board was held on Tuesday, February 3, 11987, at the Southold Town Hall, Main Road, Southold, New York. Supervisor Murphy opened the meeting at 7:30 P.M. with .the Pledge of Allegiance to the. Flag. Present: Supervisor Francis 'J. Murphy Justice Raymond W. Tasker SUPERVISOR MURPHY: Thank you. The first order df business I'd like a resolution approving the audit 'of the bills of February 3rd, 1987.' Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it 'was RESOLVED that the following audited bills be and hereby are ordered paid General Fund Whole Town bills in the amount of $46,758.85 ; General Fund Part Town bills in:the amount of $ 35,968.36 Highway Department bills in�.the amount of. $13,822.81; Fishers Island Ferry District bills in' the amount of $4,6273. 32- Scavenger Waste Plant bills in' the amount of $2,342. 13; Agricultural Lands Capital Account bills in` the amount of $200.'00. Scavenger Wastewater District bills in the amount of $4,480.00. Eddie''Sidor for his 'years as Juvenile Aide Officer in' the Town of Southold. I would like to ask his 'very good friend Council-' woman Jean Cochran to present and read the resolution. ;Eddie; will' you and Althea come on up. COUNCILWOMAN COCHRAN: There are some areas that I do not get involved in' as far as the Police Department is 'concerned, -but last week 1. was reviewing some of the services that are provided and some of the grants we've received. that are provided to the community, and I felt it 'was very important in' relation to not only positive action of the Police Department, but also a positive action' in' serving the youth of our community, so it 'gives me a great deal of pleasure to read this 'resolution on behalf of the Town Board. Moved by Councilwoman Cochran, seconded by the Entire Town Board, WHEREAS, the Town Board of'thd(.Town .of Southold wishes to recognize and honor the chievements of JUVENILE AIDE OFFICER. EDWARD SIDOR, who has given generously. of.his time and expertiese in' his 'faithful service to the Town and its residents as Juvenile Aide Officer since April 1 , 1982; and WHEREAS,. Officer Sidor, during his 'five years in' this position, has provided leader- ship'; assistance and direction to the youth of the community; established and maintai J . a working relatioiiship'with the schools; initiated a safety education program within' is community; and has advised and worked in' the best interests of the youth in'the community; now, therefore, . be it ' RESOLVED that the Town Board of the Town of Southold hereby expresses their most sincere appreciation to Edward Sidor for his 'wholehearted cooperation and untiring efforts to make our Town a better place in'which to live; and be it 'further. The Following Member of this 'Depart- ment is-Commended for Exceptional Police Duty. Sergeant 'Edward Sidor. Since the inception of the Southold Town Juvenile Aide Bureau in'March, '1982'. Edward Sidor has developed the. Bureau into a functional and highly acredited unit: Edward Sid or has brought acclaim' to himself, :the Department and the police profession as .a result of his 'devotion to duty and the youth of the Town of. Southold. The officer is 'here- by awarded the Exceptional Duty Bar to be worn above his 'shiel'd. A copy of this order shall be placed in' the officer's personnel file." And ;I signed it.' COUNCILWOMAN COCHRAN: You wanted to say something? _ SERGEANT SIDOR: I just realized that--well, those of you that know me, know that I have a tendancy to start talking, so---I (have a captive audience---any how, would just like to express my thanks to the present Town Board and some past members, ex-members of the Town Board that I'm sure are not here tonight, for their complete support and backing that I received. I feel that I've been successful, or the programs have been very good, because of the fact that from all these Town Board members I have gotten their complete backing, never had a problem. They've always gone along with whatever I've requested. I do appreciate that, and 1'd also FEBRUARY 3, 1987 489 like to mention that 1'd like to thank the Chief and the Lieutenant from our depart- ment for their trust and their'freedom`that•tliey. gave me in' being able to establish this: Without that freedom, without the trust, the free-hand that I did' get, it would have been very difficult to set up something when we started off. SUPERVISOR MURPHY: Ed, thank you. You did` a great job. Thank you for your efforts; and I know your successor, hopefully will learn from you equally as well. Come on in'Martin. This is 'Martin' Flatley who's going to take over Eddies job. Good luck, Martin. Do as well. Thank you. I. REPORTS. SUPERVISOR MURPHY: Moving on to reports. I would like to ask the Councilmen if 'they have anything report. Pd .like to start off on my right with Councilman Penny. COUNCILMAN PENNY: Yes, thank you. On the 21st we had a meeting of the Kenny's Beach Shoreline Erosion Control Committee. It'was a regularly scheduled monthly meeting, and this 'is 'a committee that we've established with members of the DEC and that State and the County governments, and we're trying to rectify, or work out a possible solution for a very severe erosion. problem on the Sound. This 'was a regular meeting. We discussed .the fact that we are addressing 13,000 feet of shoreline, and the tremendous costs involved with this.' It:becomes quite �a figure when you figure that you're going to be somewhere to do a good erosion control project, you.have to be addressing somewhere between .$300 and. ;$90'0 a foot with structures and sand, and so that is 'why we're applying to the State for funding and hoping to get a lot of these costs off-set if'anything ever does go through. Just as a point of information, the Coastal Erosion.Management Zone, the CEHA, the Coastal Erosion Hazards Act is 'going to be up for review. : There is 'not going to be a local.meeting here in the Town Hall. It will' be in' Riverhead, and we should. get a better clarification of the dates in' the 'future, but it's tentatively set for 2:'00 P.M. in' the Riverhead Town Hall on the 19th of March, and 7:00 P,M. at the County Center 'on the same day. On the 27th we met, the Kenny's .Beach Committee, and quite a few members from .the Town Board, met with the State representatives of the DEC, Russ Wege, Roman Rocozi" 'Jay Tanski from Sea Grant was_ there, and Jean Gilman, again' from the DEC, and we actually. walked a good portion of,the shoreline between Duck.Pond Point and Horton Point, just to give the DEC people in' Albany an idea of the 'severity of what we were talking about. They agreed there was a problem, and that they will' be asking for funding in' the next budget. . Unfortunately this won't. come into effect until 'next year, but we're still' hopeful that one of our other applications for funding willgo through. On the 29th we attended a meeting of the DEC, it was a public'.hearing, and there were about 20 ' representatives of the DEC here and a lot of people from the public; and it 'was an open forum meeting. It was very good. It gave us a chance to ask any questions directly of the DEC. After the meeting we pigeon-.holed some of the members of the , DEC because there's .been, pressure on us to ack on the. T990 landfill' cut-off, and we're hopefully going to be setting up a meeting with the DEC and with our consultant H2M, because the DEC is 'pressuring us to move, move, move, and H2M is 'telling us to hold back, don't rush, let's .make sure we have all our ducks in:order. So we feel like as a Town Board we're between two different factions here, and so we're going to iron out these differences hopefully in` a meeting in- 'the very near future. On the 30th was down at the Scavenger Waste Plant . It was a regular routine visitation with Jim' Monsell and George Desmarais from H2M. We were discussing operating procedures and setting up a calendar of routine maintenance. On. the 2nd, which was last night, there was another meeting here on the Local Waterfront Revitalization Program address- ing the Coastal Zone Boundary. This 'was a meeting with the community to discuss areas of concern of the public.' We have funding from the State, about $30,000, 1 believe, to prepare this study, and what our consultants, which is 'Szepatowski , 'the planners, are trying to find out is 'they have concerns already from the Town Board and they want to find out any more concerns of the community that they could address in' this study, and then they're going to be proceeding with that forthwith. And that's basically all. Thank you. SUPERVISOR MURPHY: Jay? COUNCILMAN SCHONDEBARE: Yes, thank you, Frank. There was a meeting of the Code Committee, and we discussed an ordinance with regards to the regulation of outside exhibitions. We discussed the bed and breakfast and accessory apartments. Evidentially people are trying to have both the bed and breakfast, plus an accessory apartment all intone family dwelling. We'll;..discuss accessory structures that are on front lines on waterfront property and the need to always go to the ZBA. We're trying to straighten out that. We'll'.discuss a concept of.the architectural review board . for the Town. It has been recommended. There is 'a--I think Dick Ward proposed one for our perusal. And we'll :diiscuss the Trustees' jurisdiction on Long Island Sound and some of the questions that we have as to whether or not there. is 'such jurisdiction. There will be another meeting of the Code Committee. What I've done is 'to meet each Wednesday--the first Wednesday of the month. There's so much work that's been referred it that it's going to have to be an on-going basis: We have Chief Winters with his alarm system. He's .trying to correct some of the alarms that are tied up to i 4 9 0 FEBRUARY 3, 1987 1 the police headquarters, and the false alarms that always go in: He's recommended an ordinance to us to have us enact it: We'll discuss that' tomorrow night. Likewise we'll discuss tomorrow night the Landmark Preservation Law. I guess that people in' the community become familiar with it.: It's .quite encompassing and there's going to be a lot of surprises for some.people. This 'was .submitted, to the Code Committee by the Landmark 'Preservatioru;Commission for our review. And likewise we hopefully will' straighten out the permit 'process for having an outside fair; carnival or bazaar. Thank you, Frank. SUPERVISOR MURPHY: . Thank you, Jay. Paul? COUNCILMAN STOUTENBURGH : Well, we left out the very important one, the Maste Plan we all .attended here on that snowy night in' which we cancelled our Master Plan hearing, of course, I .hope: everyone understands it''s now February 11th. I also - attended the Erosion Committee in which we walked the beaches and saw some of the problems that George has already spoken about. I attended the Farmland Committee representing the Town Board there, and they are reviewing three farms to come under their program. The Latham farm in'Orient, the Orville Terry farm out in' Orient, and also. the new one which has .just come into them, the Envi!ronmentals, which is in' Cutchogue, the Jim Cross farm, and they're proceeding to, review those farms to come under their'program. I was also at the DEC, the Code Committee, and the Waterfront Revitalization Program, which you already heard about. SUPERVISOR MURPHY: Thank you, Paul. Jean? COUNCILWOMAN COCHRAN: I think most of it-'-I also walked the beaches with Paul and George. I also attended the DEC meeting. I also attended the Waterfront Revital- ization, and you've' just been given a full report on those lareas, so I will' pass on to Judge Edwards. JUSTICE EDWARDS: I was also at the snowy Master Plan meeting, and the DEC meeting, and I think the DEC as a group is 'now going to come and visit 'the Town and find 'out the problems that the people have. I. can say we on Fishers Island are. extremely lucky because they've .been coming over there every summer. at the Town Father's Meeting, as long as I've been in'office' anyway, and that's close to five years, so we're lucky to have them come visi't 'us. Also there was some problems that I brought up. they're going to look into. This past weekend the Fishers Island Civic Association had their winter meeting. They meet four times a year and at this winter meeting there were a good 30 people I think that came over. These are peop that have homes on the Island, are concerned with the Island. Live down in Delawai-7 New York, Boston, Hartford, and 30 of them braved the weather and came down for the meeting to make their desires known. We are also looking forward to having.an aquifer study don on the Island. We've got some good thoughts on that. I brought that up with the Town Board today.. We have an economic'committee on the Island -that's trying to also boost the economy of the Island. We're looking at the downward enrollment of the school, and there's .two things :that's .causing that and the biggest problem is 'the affordable housing. The kids on the Island--no way in the world can they compete with the summer people when it 'comes to buying a house. So we have similar problems that you have, only on the Island, -only they're not on that big' a scale. All in all it''s been a busy couple of weeks. Thank you, Frank. Also all those restrictions and covenants were indicated on the site plan that was presented to the Town Board showing that half that parcel-- more than half the parcel was allocated. to AHD and. that was in' the application too. That the number of units :were going to be equal-=84 and 84, and the only other question that the Planning. TASKER: Basically speaking, as I understand it; John, and this ' comes from a recommendation of the Planning Board, I believe, that what you have-- you have a piece of property, I believe, which was something like 50 acres-- MR. COSTELLO: Forty-eight point-- TOWN ATTORNEY. TASKER : Forty-eight point something--let's .say for the sake of discussion you have 50 acres. You could have, under the Affordable Housing, appli for the whole 50 acres as affordable housing, in.which event under the Affordable Housing Law it''provide' s that one-half of all of the units must 'be affordable housing. You propose an alternative to that. To take half-of the property and have 100% of those parcels Affordable Housing. Now, since this 'will' be.different than the Code, different than the requirements, we wily have to have a covenant whereby you agree to do this; which will' follow the land and run with the land. That's one. The second one was the idea that the affordable housing section will' have to be built and developed at the same speed as the townhouse section. In other words, you couldn't built' all the townhouses in' the western section and then abandon the affordable housing. So that would have to be a restrictive covenant, and that's kind of outlined in' a letter to you of October 7th of 1986 from the Planning Board. That's where we picked it up, I think. MR. COSTELLO: Right. TOWN ATTORNEY TASKER: Now, we discussed it 'at the Work Session. this 'afternoon, and I asked the Town Board if'there are any other items or matters that should be addressed in' a Declaration of Restrictive Covenants. 1 don't know whether the Planning Board has any. Do you know whether they have required any others? MR. COSTELLO: They haven't required of. me, no. Does the Town Board require any more? I wasn't at the Work Session.
