WORK SESSION
Present: Supervisor Francis 'J. Murphy, Councilman Paul Stoutenburgh, Councilman
James A. Schondebare, Councilwoman Jean W. Cochran, Councilman George-L. Penny

9: 15 A.M. - Community Development Administrator James McMahon discussed with the
Board the possible donation of the,hatchery i portion.of. the Plock property,._near Reydon
Shores, Southold, to the Town. . The. Board will' meet with. Mr. Plock in' the near future
to discuss the donation. Mr. McMahon also discussed the draft proposal for the-:1987 .
Community Development budget.---Supervisor Murphy reviewed with the Board the
proposed zoning of the Plock property with respect to that of the Dunn property
adjoining it. The: Board determined that.the R-40 designation was only on the Plock
property and they are unwilling to consider any other changes to the proposed zoning
map - hearing to be held on January 22nd.--T,he Board discussed at length suggestion
of Supervisor Murphy to go ahead with the Environmental Assessment and then go out
for requests for proposals for /the Landfill project.. Board discussed pros and cons and
decided they should meet with the DEC for further direction. Councilman. Penny ex-
pressed his opinion the Board should wait for the results from the weighing station
before proceeding any further.
10:.05 A.M. - Board met with Val Stype, Jr. , Stype Insurance, to discuss their
insurance proposal and review certain options. At the conclusion of the review,
Mr. Stype. agreed to submit 'a list of the changes made during this `meeting and
agreed upon by the. Board.
11 :35 A.M. - Garrett Strang., Architect, met with the. Board to discuss the recent
problems encountered with respect to the cesspool locations at the Dog Pound kennel
construction site. He will contact the :contractor Richard Saetta to prepare a change
order i n' an amount not to exceed $500 (see resolution no. 14).
11 :45 A.M. - Board reviewed Regular Meeting resolutions., and off agenda items:
Deferred Compensation - will seek other proposals; reappointment of William Weiheimer
to the Board of Assessment Review (see resolution -no. 17) ; letter from Thomas Cramer
relative to cost for SEQR. review. Board to review further; possibility of meeting with
Commissioners of the Fishers .Island Garbage S Refuse District on January 20th - Town
to pay travel expense (see resolution no. 19) .
12: 15 P.M. - Recess for lunch.
1 :15 P.M. - Councilmen Schondebare, Cochran,. Penny, and Community Development
Administrator McMahon met with Diane Carroll and Donald Bracken, contractors for
the Costello property at Moore's-Lane and Route 48, Greenport, to discuss possible
federal or state funding, and clarification of some of the procedures set forth in: the
Affordable Housing Law.

A Regular Meeting of the Southold- Town Board was held on Tuesday, January
6, 1987. at the Southold Town Hall, Maine Road, Southold, New York. Supervisor
Murphy opened the meeting at 7:30 P.M. with the Pledge of.Allegiance to the Flag.

SUPERVISOR MURPHY: . On behalf of the Town Board, we' wish everybody the best
for the. New Year. Moving on to the first order of business is 'a resolution setting
the next meeting date for January 20th, 1987, 7:'3.0 P.M. , Southold Town Hall.

RESOLVED that the next regular meeting of the Southold Town Board will' be held
at 7: 30 P.M. , Tuesday, January, 20, •1987, at the Southold Town Hall, Main' Road,
Southold, New York.

COUNCILMAN PENNY: I attended my first committee meeting last night, being the
Water Advisory Committee, and I'm sure the chairman, Pau'I Stoutenburgh, will' be
reporting on that. Thank you.
SUPERVISOR MURPHY: Jay?
COUNCILMAN SCHONDEBARE : Nothing, Frank. Thank you.
SUPERVISOR MURPHY: Paul? .
COUNCILMAN STOUTENBURGH : I will report on that Water Advisory meetin' ' that we
both attended. It was kind of revealing because Joe Baler, who is 'not a member of
that, but part of our committee in' the sense of bringing in' material to us, he's sort
of our representative that gives us the official standing of, the Health Department.
He brought in some figures that were rather startling. Seventeen percent of the
wells, private wells ins our Town, are contaminated with Nitrates. And there are
13% more that have Nitrates in them, giving almost a .total of 300 of our wells having
Nitrates in them. Which gives you some idea of the contamination just from Nitrates.
Then Aldecarb, which is the Temik! problem, 11% of the wells have to have filters
on them. And- then there's .12% that there's .an additional amount, so, we have again
almost 25o'--another 25% that have Temik in them. So it 'gives an idea of our real
problem of quality; is `a real problem in this Town. And the funny part about this '
thing--it's not funny, I guess, but the odd part about it 'is `that they only used

Temik for three years and then it was stopped, and you can see ini those three years
250 of the households in' this 'Town have Temik' in' them in' just three years. So you
can see how we're playing with these things that we're not quite sure of and how
they can be a tremendous problem in' the future to all of us. There are at least
about a thousand filters on the homes in' this 'Town. . About a thousand filters are
now required on wells just in` this 'Town of Southold alone. And they get about
between eight and ten filters additional every week. In other words, they find
new problems. . They're continually testing and they're adding eight to ten every
week. The Water Advisory Committee is working on a Water Management Plan. .
Hopefully in' the future we will' have overlays of maps that will' give us an idea
of where the best water isi and possibly an area that could be set aside in' the
future for future water resources. This �is 'something we're hoping is`going to be,
and this iswhat they're working on right now. We had assignments for everybody
on the committee, but through the holidays, I'm afraid, some of the assignments
didn't get done and so we couldn't do as much as we wanted to, and so we're looking
for a much better do their'homework kind of thing next time. So that's about all
have to report, Frank.

11 . PUBLIC NOTICES.
SUPERVISOR MURPHY: Moving on to the second item on .the agenda, Public'Notices.
1. Designation. of a restricted highway on Route 25, between. Aldrich Lane
and the Railroad. Bridge. They're going to do reconstruction, and it 'wi.11' be restricted
until 'June 30th, :1988, the scheduled completion. date.
2. Notice from the Public'Service Commission on a prehearing conference on
the Lighting Company's .electric'rate increase. There will' be one in' New York, and
one in' Riverhead .on Tuesday, February loth, Suffolk County Center Board 'Room,
Nugent Drive, Riverhead.
111 . COMMUNICATIONS.
SUPERVISOR MURPHY : 1. From Gladys Csajko resigning as. the Director of the
Shelter for the North Fork Animal Welfare League. I'm very .sorry to see her go.
She did a great service for this 'community.
2. From a local attorney (Michael J. Hall) expressing thanks to the entire
Building Department for doing a very good job during the year. And it's really
nice to hear these and I think it's very important that everybody knows about it.
It's a very tough job and they're always under a lot of pressure and it's .always
good to hear somebody say something nice..
3. From Richard Saetta who has a contract problems with the excavation at
the Dog Pound. Hopefully our architect will be able to resolve this 'tomorrow.
IV. PUBLIC HEARING.
SUPERVISOR MURPHY: We have a public hearing scheduled for tonight at 8:00
o'clock (Zehner, . formerly Southport, change of zone hearing)..
V. RESOLUTIONS.
SUPERVISOR MURPHY: We'll .move on to Resolutions. The first one is `an author-
ization to go to bid'
1. Moved by Councilman Stoutenburgh, seconded by Councilman Penny, it.'was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs the Town Clerk to advertise'for bids for the purchase of six' (6) new :1987
Special Police automobiles, with a trade-in of five (5) vehicles, for the Southold
Town Police Department.
1.-Vote of the Town Board : Ayes: Councilman Penny, Councilwoman Cochran, Council-'
man Schondebare, Councilman Stoutenburgh, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY : Number 2 is to authorize to go to bid' for an unmarked
police car.
2. Moved by Councilman Stoutenburgh, seconded by Councilman Penny, it 'was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs. the Town Clerk to advertise for bids for the purchase of one (1) new 1987
police vehicle for the Southold Town Police Department.

SUPERVISOR MURPHY: Number 3 is to authorize advertisement for the DEC's local

3. Moved by Councilwoman Cochran, seconded by Councilman. Stoutenburgh, it 'was
RESOLVED that the Town. Board of the Town of Southold hereby authorizes and
directs the Town Clerk to place a display ad in'T.he Long Island Traveler-Watchman
and The Suffolk Times advising the public that members of the New York State
Department of Environmental Conservation .will' meet at the ,Southold Town Hall, Main'
Road, Southold, New York, on Thursday, January 29,' 1987, at 7:00 P.M. to answer
questions regarding local issues.
SUPERVISOR MURPHY: I'd .like to comment on that. This 'is 'a new policy of the
DEC. I think one trying to clean up their'image and get closer to the people. And
what it 'is, this 'is the first of the hearings on the- 13th towns on Long Island, and
they're trying it 'out here to see how it 'goes over. They iwant input from the peopl
They want to come and make themselves, all of their various departments, available
to_.people_. I f'.a_nyonp hac so_m ethi nc- specif c'they would li ke to _ask the,,-DEC,,-if`you'
let me know before hand and I wilI' make sure that someone from the DEC is 'here to
answer that question. Harold. Berger, the Regional Director, is `expected to be here,
as well as various senior staff members insanitation, water, wetlands and that. So
if anyone has any special interest, please let me know and we'll make sure that some-
one is 'here.

SUPERVISOR MURPHY: Number 4 is 'an urgent action by our Association of Towns
on municipal liability.
4. Moved by Councilman Penny, seconded by Councilman Stoutenburgh,
WHEREAS, in':1985. the Assembly Standingi.Committee on Local Governments issued a
report entitled "Deep Pockets- a Study of Municipal Tort Liability" .which concluded
that municipal tort liability had entered a crisi's 'stage and ithat insurance was both
unavailable and unaffordable to hundreds of New York State local governments, and
WHEREAS, in'.,1986 the New York State Legislature and the' Governor began to address
this 'problem by enacting laws which modified the tort system in° New York and estab-
lished certain insurance reforms, and
WHEREAS, despite these new laws, insurance remains unaffordable for our torn, and
in' some instances, unavailable; now, therefore, be it
RESOLVED that the .1986 legislation which modified joint and several liability so that,
in' the case of non-economic damages, if the defendant was found to be less than 50c'
responsible for the tortious act, it 'would pay only its share of the award, -be .extended
to totally abolish the joint and_several liability doctrine for, both economic and non-
economic 'damages, and be it hereby
FURTHER RESOLVED that a limitation of $250,000 be imposed for non-economic'
damages until 'such time as a mechanism is 'established which would provide more
uniform standards or schedules for compensation of non-economic'damages, and
be it 'hereby
FURTHER RESOLVED that the defense of assumption of risk be modified so that
an equitable personal responsibility statute for sports and recreational activities
be imposed on the basis 'that fairness dictates that one who voluntarily assumes
a known risk and is 'then injured because of that risk should bear the: consequences
of one's own behavior, and be it hereby
FURTHER RESOLVED that a contingency fee schedule simi'lar.to that which was
included as part of the 1985 medical malpractice legislation be imposed, and be it '
hereby
FURTHER RESOLVED that certain procedural reforms be enacted, including:
(a) Requiring plaintiffs and defendants to certify the truthfulness of the
allegations contained in' their 'respective pleadings;
(b) Changing the process for jury selection to adopt the Federal process;
and
(c) Requiring all Appellate Divisions of the state to allow bifurcation for
personal injury trials, and
be it heireby
FURTHER RESOLVED that the present version of court-annexed arbitration be
extended so that arbitrators would be permitted to hear cases and make awards
up to $25,000,' and be it hereby
FURTHER RESOLVED that the statute of limitations is 'notichanged in' the area of
"toxic tort" cases beyond what occurred in'1986; and be it '
FURTHER RESOLVED that a suitable copy of this •Resolution be forwarded to the
Association of Towns who should be urged to adopt this 'as part of their resolutions
and legislative program at the annual ,meeting in' February, .1987.

speed survey on Henry's Lane.

RESOLVED that the Town Board of th`6"`'own' f `Southold hereby requests the
New York State Department of Transportation to conduct a speed survey, for the
purpose of reducing the speed limit.' on Henry's Lane, Peconjc, New York.

SUPERVISOR MURPHY: Number 6 is 'a trailer permit renewal for Sam Brown in
Cutchogue.
6. Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it was
RESOLVED that the application of Samuel G. Brown for renewal of a single family
house trailer permit;_ for trailer located at the west side of Tuthill Road, Cutchogue,
New York, .which permit expires on January 15, :1987, be --and--hereby 6s r� anted for
a six (6) month period.

SUPERVISOR MURPHY: Number 7 is 'a transfer of funds.

RESOLVED that the Town. Board of the Town of Southold hereby authorizes the
transfer of $7,000 00 from the General Fund Whole Town :1986 Unexpended Balance
to Historical Property, Contractual A7520.4.

SUPERVISOR MURPHY: Number 9 is to appoint Wayne Doucette as a Highway
Department Laborer on Fishers Island.

RESOLVED that the Town Board of the Town of Southold hereby appoints Wayne
Alan Doucette as a Highway Department Laborer at Fishers Island, effective
January 16, 1987, at a salary of .$9. 11 per hour; said appointment to be contingent
upon successfully completing a six' (6) month probationary period.

RESOLVED that the Town. Board of the Town of Southold hereby accepts, with
regret, the resignation of Arleen Oliver, part-time Clerk Typist for the Board of
Town Trustees, effective close of business January 16, 1987.

SUPERVISOR MURPHY: Number 12 is 'to make an appointment to the Landmark
Preservation Commission.

RESOLVED that the Town Board of the Town of Southold hereby appoints Joseph
L. Townsend, Jr. a member of the Southold Town Landmark Preservation Commission,
effective immediately, to fill the unexpired term of Louis Ji. Black to April 5, 1987;
he to serve in' said position without compensation.
12.-Vote of the Town Board : Ayes : Councilman Penny, Councilwoman Cochran, Council-'
man Schondebare, Councilman.Stoutenburgh, Supervisor Murphy.
This resolution was declared 'duly ADOPTED.
SUPERVISOR MURPHY: Number 13 is to execute an agreement.
13. Moved by Councilman Penny, seconded by Councilman -Stoutenburgh, it 'was
RESOLVED that the Town Boaird of the Town of Southold hereby authorizes and
directs Supervisor Francis 'J. Murphy to execute a contractual agreement between
the Town of Southold and Chief of Police Harold D. Winters for the period January
1, 1987 through December 31 , 19871, and set his compensation for such employment
at the annual salary of $60, 386. 00. .

SUPERVISOR MURPHY: Number 14 is to authorize a change order for the Dog Pound.

RESOLVED that the Town .Board of the Town of Southold hereby authorizes and
directs Supervisor Francis '.J. Murphy to execute a Change Order,. not to exceed
$500.00, to correct cesspool connections at the Kennel Building being constructed
at the Southold Town Dog Pound.
14.-Vote of the Town Board : Ayes: Councilman Penny, Councilwoman Cochran, Council-
man Schondebare, Councilman Stoutenburgh, Supervisor Murphy.

SUPERVISOR MURPHY: Number 15 is -to accept a resignation.

RESOLVED that the Town Board of the Town of Southold hereby accepts, with
regret, the resignation of Elizabeht Poh, Aide for the Senior Adult Day Care
Center, effective December 15, 1986.

Southold Town Nutrition Program.

RESOLVED that the Town Board of the Town of Southold hereby accepts, with
regret, the resignation of Marian Gordon, Aide for the Southold Town Nutrition
Center, effective December 12, 1986.

RESOLVED that the Town Board of the Town of" Southold hereby appoints William
Weinheimer a member of the Board of Assessment Review, for a five (5) yearterm,
effective February 22, 1987 through February 22, 1992.

man Schondebare, Councilman Stoutenburgh, Supervisor Murphy.

SUPERVISOR MURPHY: Number 18 is 'to authorize the application of a grant.
18. Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it 'was
RESOLVED that the Town Board of. the Town of Southold hereby authorizes and
directs 'Supervisor Francis 'J. Murphy to submit 'an application and proposal .to the
New York State Council, bn the. Arts fora Historic'Structures .Grant, to be utilized
by the Southold Town Landmark Preservation Commission.

of Commissioners for the Fishers Island Garbage District on January 20th.

RESOLVED that the Town Board of the Town of Southld hereby authorizes payment
of the round-trip' transportation costs for the Board of Commissioners of the Fishers
Island Garba a and Refuse District to meet with the Town Board on January 20, 1987.

January 1, 1987 - January 1, 1988
Landmark Insurance Company, Umbrella Policy, Part Town - $37, 600. 00

RESOLVED that the Town Board of th&7own of Southold hereby appoints Bradley
C. Conklin; Burton Potter Post No. 185, American Legion, Greenport, a member of
the Council on Veterans Affairs, effective immediately through December 31., 1987;
he to serve without compensation.

SUPERVISOR MURPHY: Yes. Thank you. Okay, anyone in the audience would
like to address the Town Board? (No response.) We'd like to remind everybody
of the public hearing on the Master Plan on January 22nd,. from 2:00 to 5:00 and
7:00 to 9:00. Anyone like to address the Town Board?
ED SIEGMANN: I'd just like to ask you a question. Is it: American built cars that
you specify for those Police vehicles, or can it 'be any vehicle?
COUNCILMAN STOUTENBURGH : Can't be done.
SUPERVISOR MURPHY: I don't think it can be done. We, normally specify the
brand that the Police Department is happy with. There's only two or three of
the auto dealers that make police car packages. It's a special package that's made.
That's why we go to bid early, because they only make a ,certain' nurfiber.
COUNCILMAN STOUTENBURGH :. Has to have certain' transmissions, certainengines. .
So there wouldn't be a standard car, you 'see, and I don't think a foreign car company
would make that car anyway.
SUPERVISOR MURPHY: Ford, Chevy and Plymouth are the only ones that make them.
Okay, at this time I would like to have a resolution to recess for the public hearing
(Zehner, formerly Southport, change of zone petition) . And we'll wait five or six'
minutes.
Moved by Councilman Schondebare, seconded by Councilman Stoutenburgh, it 'was
RESOLVED that a recess be called at this.'time, 7:5-0: P.M..; for the purpose of holding
a public'hearing.
