Matter of JOSEPH CORNACCHIA. Variance to the Zoning
Ordinance, Article III, Section 100-33, as disapproved, for
permission to construct an accessory shed in frontyard area.
Property Location: 835 Kimberly Lane, Southold, County Tax Map
No. 1000, Section 070, Block 13, Lot 20.5. .
WHEREAS, a public hearing was held and concluded on .March
15, 1990 in the matter of the Application of JOSEPH CORNACCHIA
under Appeal No. 3909; and
WHEREAS, at said hearing all those who desired to be heard.
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the east
side of Kimberely Lane, Town of Southold, and is identified on
the Suffolk County Tax Maps as District. 1000, Section . 070, Block ,
13 , Lot 20. 5.
2. This is an application for Variances from �the Zoning
Code Article III, Section 100-33, for permission to construct an
accessory shed in frontyard area.

3 . Article III, Section 100-33, of the Zoning Code, in .
the Agricultural-Conservation District and Low-Density
Residential R-80, R-120, R-200 and R-400 Districts, accessory
buildings and structures or other accessory uses may be located
in the required rear yard, subject to the following requirements: .
A. Such buildings shall not exceed eighteen ( 18) feet in
height.
B. Such buildings shall be set back no less than three
( 3) feet from any lot line.
C. All such buildings in the aggregate shall occupy not
more than forty percent ( 400) of the area of the required rear
yard.
4. The subject premises in question is improved with a
Log frame house, located approximately 17 . 3 feet from the
northwest corner of the house and 17 .9 feet .from the northeast
corner of the house, on this 1.260 acres.
5 . In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed accessory shed in any other
location in the frontyard area will require other variance
relief;
(c) that the area chosen for the accessory shed is not
unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.

RESOLVED, to GRANT a Variance in the matter of the
application of JOSEPH CORNACCHIA as applied under Appeal No.
3909, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the 10 X 20 ft. accessory shed remain one story
and be approximately 24 ft. from Kimberely Lane and 24 ft. from
the north property line.
2. That the accessory shed only be used for storage
purposes and 'only consist of electricity.

In reply to your inquiries, please be advised that the placement of a "line"was not intended
to be a subdivision, but rather a depiction of a full 40,000 sq. ft. area to be devoted to each
dwelling use. Therefore, future requests for building permits should be viewed as a single
parcel (unless a set-off or other type of subdivision is obtained from the Planning Board in
the future).

Dear Mr. Goeringer:
The above referenced Appeal concerned a building permit for renovations
proposed for the "second" single family dwelling located on the same lot. Your
determination allowed for the second dwelling, provided that a lot line be drawn
between the main house and accessory cottage. This new lot should constitute 6
minimum of 40,000 square feet. Is this considered an approved subdivision?
At this time, it does not appear that this lot line was ever recorded with the
County. The building department has also received a permit application for
additional construction at this location. Does your determination allow for
additional work without any further determinations? If yes, should the applicant be
required to record the change with the county before any additional permits are
written?
Please review your files and advise me as to how I should proceed with this
permit application. Thank you.

WHEREAS, a public hearing was held and concluded on May 15,
1990 in the matter of the Application of DAVID & MARY ANN
CREATO, under Appeal No. 3942; and
WHEREAS, at said hearing all ,those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:

R-120, R-200 and R-400 Districts, no building shall be erected
or altered which is arranged, intended or designed to be used in
whole or in part, for any uses except the following:
A. Permitted uses.
(1) . One-family dwellings, not to exceed one (1) dwelling
on each lot.
4. The subject premises is located at 3539 (ROW) of Cox
Neck Road, Mattituck, and is improved with a 1 1/2 Story frame
Cottage & Barn towards the northern end and towards the
southerly end is a 2 story frame house, also two accessory
sheds. Access to the property in question is from a 20'
Right-of-Way extending north from Cox Neck Road, all
improvements are shown on the survey dated February 23, 1990,
this parcel contains an Area of 3.16+- acres in this R-40 Zone
District.
5. In considering this application, the Board finds and
determines; (a) that the circumstances of this application are

of the neighborhood; (b) that the variance will not in turn
cause a substantial effect on the safety, health, welfare,

1. That the Board recognizes that this property lies in
the R-40 Zone district therefore permits to convert existing
cottage & barn into a second dwelling with a minimum of 40,000
sq. ft. for each dwelling.

17 property line. The shed is approximately 10
18 by 20 , and 20 feet is the most recent
19 change, I assume, running along the distance
20 of Kimberly Lane. I have a copy of the
21 Suffolk County Tax Map indicating this and
22 surrounding properties in the area.

7 MR. WADE: It is for garden equip-

9 THE CHAIRMAN: Will there be any
10 utilities in there?
11 MR. WADE: No.
12 THE CHAIRMAN: No electricity or
13 plumbing?
14 MR. WADE: Nothing.
15 THE CHAIRMAN: It will be hidden
16 amongst the . . . what kind of foliage do you
17 have there?
18 MR. WADE:: Well , there is going to be
19 more pine trees put in. He also has
20 landscaping, mountain laurel , things like
21 that .
22 THE CHAIRMAN: So will it be visible
23 from the road?
24 MR. WADE: B the time y the pine trees
25 go in, not at all .

2 THE CHAIRMAN: What is the reason for
3 the location in the front yard area rather.
4 than placing it in the side yard?
5 MR. WADE: It is on the waterfront.
6 You would not want to obstruct any view from
7 the other side of the house. Plus , that
8 spot. is the most secluded spot on the
9 property.

10 THE CHAIRMAN: The only thing 1-want
11 to mention is that the granting of this
12 particular shed really sets a precedent for
13 the neighborhood since actually the mansion,
14 so-to-speak, on the north side of this
15 particular house has no other accessory
16 structures except, I assume, the cabana on
17 the other side of the swimming pool .
18 MR. WADE:: Right. That is on a
19 separate property.
20 THE CHAIRMAN: That is about the only
21 precedent sitting there, is that cabana,
22 which is not as far forward . . . for the
23 record. ,

25 40 feet from the road. It is 24 feet from

3 THE CHAIRMAN: You are going to put
4 it . . . did you say 60?
5 MR. WADE: Forty feet from the
6 property line.
7, THE CHAIRMAN: You changed it from 24
s to 40 , I see, because turning around . . . .

10 16 feet from the road.
11 THE CHAIRMAN: Oh, right . So it is .
12 24 feet from the property line and it goes
13 actually 40 feet from the road.
14 MR. WADE: Right .
15 THE CHAIRMAN: All right. I under-
16 stand. We will see what we can do. We did
17 grant one down in the corner of Kimberly
18 Lane, but that gentleman had two front
19 yards . That is all the way down in the end
20 there . . . at the last meeting.
21 MR. WADE: Also, Roxanne Road comes
22 in directly behind this, where the shed is
23 going.

A. TIDAL WETLANDS:
(1) All lands generally covered or intermittently cov-
ered with,or which border on, tidal waters, or lands
lying beneath tidal waters, which at mean low tide
are covered by tidal waters to a maximum depth of
five (5) feet, including,* but not limited to banks,
bogs, salt marsh, swamps, meadows, flats or other
low lying lands subject to tidal action;
(2) All banks, hogs, meadows, flats and tidal marsh
subject to such tides and upon which grows or may
grow some or any of the following: salt hay, black
grass, saltworts, sea lavender, tall cordgrass, high
bush, cattails, groundsel, marshmallow and low
march cordgrass;and/or
(3) All land immediately adjacent to a tidal wetland as
defined in Subsection A(2) and lying within seven-
ty-five (75) feet landward of the most landward
edge of such a tidal wetland.
B. FRESHWATER WETLANDS:
(1) "Freshwater wetlands" as defined in Article 24, Ti-
tle 1, § 24-0107, Subdivisions 1(a) to 1(d) inclusive,
of the Environmental Conservation Law of the State
of New York;and
(2) All land immediately adjacent to a"freshwater wet-
land,"as defined in Subsection B(1)and lying with-
in seventy-five(75) feet landward of the most land-
